Such program shall not authorize the donation of Schedule II-V controlled substances if so prohibited by federal law. No drugs shall be re-dispensed unless the integrity of the drug can be assured. Such program shall accept eligible prescription drugs from individuals, including those residing in nursing homes, assisted living facilities, or intermediate care facilities established for individuals with intellectual disability (ICF\/IID), licensed hospitals, or any facility operated by the Department of Behavioral Health and Developmental Services. Such program shall not authorize the donation of Schedule II-V <span class=\"dictionary\">controlled substances<\/span> if so prohibited by federal <span class=\"dictionary\">law<\/span>. No drugs shall be re-dispensed unless the integrity of the drug can be assured. Such program shall accept eligible <span class=\"dictionary\">prescription drugs<\/span> from individuals, including those residing in nursing homes, assisted living facilities, or intermediate care facilities established for individuals with intellectual disability (ICF\/IID), licensed hospitals, or any facility operated by the Department of Behavioral Health and Developmental Services. Additionally, such program shall accept eligible <span class=\"dictionary\">prescription drugs<\/span> from an <span class=\"dictionary\">agent<\/span> pursuant to a <span class=\"dictionary\">power of attorney<\/span>, a decedent&#8217;s personal representative, a legal guardian of an incapacitated <span class=\"dictionary\">person<\/span>, or a <span class=\"dictionary\">guardian ad litem<\/span> donated on behalf of the represented individual. <a id=\"paragraph-223474\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3411.1\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Unused <span class=\"dictionary\">prescription drugs<\/span> dispensed for use by <span class=\"dictionary\">persons<\/span> eligible for coverage under Title XIX or Title XXI of the Social Security Act, as amended, may be donated pursuant to this section unless such donation is prohibited. <a id=\"paragraph-223475\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3411.1\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> A pharmaceutical <span class=\"dictionary\">manufacturer<\/span> shall not be liable for any claim or injury arising from the storage, donation, acceptance, transfer, or <span class=\"dictionary\">dispensing<\/span> of any drug provided to a patient or any other activity undertaken in accordance with a drug distribution program established pursuant to this section. <a id=\"paragraph-223476\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3411.1\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Nothing in this section shall be construed to create any new or additional liability, or to abrogate any liability that may exist, applicable to a pharmaceutical <span class=\"dictionary\">manufacturer<\/span> for its products separately from the storage, donation, acceptance, transfer, or <span class=\"dictionary\">dispensing<\/span> of any drug provided to a patient in accordance with a drug distribution program established pursuant to this section. <a id=\"paragraph-223477\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3411.1\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> In the absence of bad faith or gross <span class=\"dictionary\">negligence<\/span>, no <span class=\"dictionary\">person<\/span> that donates, accepts, or <span class=\"dictionary\">dispenses<\/span> unused <span class=\"dictionary\">prescription drugs<\/span> in accordance with this section and <span class=\"dictionary\">Board<\/span> regulations shall be subject to criminal or civil liability for matters arising from the donation, acceptance, or <span class=\"dictionary\">dispensing<\/span> of such unused <span class=\"dictionary\">prescription drugs<\/span>. <a id=\"paragraph-223478\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3411.1\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPROHIBITION ON RETURNS, EXCHANGES, OR RE-DISPENSING OF DRUGS; EXCEPTIONS (\u00a7\n54.1-3411.1)\n\nA. The Board shall promulgate regulations to establish a prescription drug\ndonation program for accepting unused previously dispensed prescription drugs\nthat meet the criteria set forth in subdivision A 2, for the purpose of\nre-dispensing such drugs to indigent patients, either through hospitals or\nthrough clinics organized in whole or in part for the delivery of health care\nservices to the indigent.
