A pharmacy that chooses to participate in a <span class=\"dictionary\">pharmacy drug disposal program<\/span> shall notify the <span class=\"dictionary\">Board<\/span>, and the <span class=\"dictionary\">Board<\/span> shall maintain a list of all pharmacies in the Commonwealth that have chosen to participate in a <span class=\"dictionary\">pharmacy drug disposal program<\/span> on a website maintained by the <span class=\"dictionary\">Board<\/span>. <a id=\"paragraph-238060\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3411.2\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> No <span class=\"dictionary\">person<\/span> that participates in a <span class=\"dictionary\">pharmacy drug disposal program<\/span> shall be liable for any theft, <span class=\"dictionary\">robbery<\/span>, or other criminal act related to its participation in the <span class=\"dictionary\">pharmacy drug disposal program<\/span> nor shall such <span class=\"dictionary\">person<\/span> be liable for acts of simple <span class=\"dictionary\">negligence<\/span> in the collection, storage, or destruction of <span class=\"dictionary\">prescription drugs<\/span> collected through such <span class=\"dictionary\">pharmacy drug disposal program<\/span>, provided that the pharmacy practice site is acting in good faith and in accordance with applicable state and federal <span class=\"dictionary\">law<\/span> and regulations. <a id=\"paragraph-238061\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3411.2\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> In <span class=\"dictionary\">order<\/span> to mitigate the risk of <span class=\"dictionary\">diversion<\/span> of drugs upon the death of a patient, any hospice licensed by the Department or exempt from licensure pursuant to &#xA7; <a class=\"law\" title=\"Exemptions from article\" href=\"\/32.1-162.2\/\">32.1-162.2<\/a> shall develop policies and procedures for the disposal of drugs, including opioids, dispensed as part of the hospice plan of care. Such disposal shall be (i) performed in a manner that complies with all state and federal requirements for the safe disposal of drugs by a licensed nurse, physician assistant, or physician who is employed by or has entered into a <span class=\"dictionary\">contract<\/span> with the hospice program; (ii) witnessed by a member of the patient&#8217;s family or a second employee of the hospice program who is licensed by a health regulatory <span class=\"dictionary\">board<\/span> within the Department of Health Professions; and (iii) documented in the patient&#8217;s medical record. <a id=\"paragraph-238062\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3411.2\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPRESCRIPTION DRUG DISPOSAL PROGRAMS (\u00a7 54.1-3411.2)\n\nA. As used in this section:\n\t\t\t&#8220;Authorized pharmacy disposal site&#8221; means a pharmacy that\nqualifies as a collection site pursuant to 21 C.F.R &#xA7; 1317.40.\n\t\t\t&#8220;Pharmacy drug disposal program&#8221; means any voluntary drug\ndisposal program located at or operated in accordance with state and federal law\nby a pharmacy.\n\nB. A pharmacy may participate in a pharmacy drug disposal program in accordance\nwith state and federal law regarding proper collection, storage, and destruction\nof prescription drugs, including controlled and noncontrolled substances. A\npharmacy that chooses to participate in a pharmacy drug disposal program shall\nnotify the Board, and the Board shall maintain a list of all pharmacies in the\nCommonwealth that have chosen to participate in a pharmacy drug disposal program\non a website maintained by the Board.\n\nC. No person that participates in a pharmacy drug disposal program shall be\nliable for any theft, robbery, or other criminal act related to its\nparticipation in the pharmacy drug disposal program nor shall such person be\nliable for acts of simple negligence in the collection, storage, or destruction\nof prescription drugs collected through such pharmacy drug disposal program,\nprovided that the pharmacy practice site is acting in good faith and in\naccordance with applicable state and federal law and regulations.\n\nD. In order to mitigate the risk of diversion of drugs upon the death of a\npatient, any hospice licensed by the Department or exempt from licensure\npursuant to &#xA7; 32.1-162.2 shall develop policies and procedures for the\ndisposal of drugs, including opioids, dispensed as part of the hospice plan of\ncare.
