An asbestos project or asbestos abatement project shall not include nonfriable asbestos-containing roofing, flooring and siding materials which when installed, encapsulated or removed do not become friable.\n\t\t&#8220;Asbestos project designer&#8217;s license&#8221; means an authorization issued by the Board permitting a person to design an asbestos abatement project.\n\t\t&#8220;Asbestos project monitor&#8217;s license&#8221; means an authorization issued by the Board permitting a person to monitor an asbestos project, subject to Department regulations.\n\t\t&#8220;Asbestos supervisor&#8221; means any person so designated by an asbestos contractor who provides on-site supervision and direction to the workers engaged in asbestos projects.\n\t\t&#8220;Asbestos worker&#8217;s license&#8221; means an authorization issued by the Board permitting an individual to work on an asbestos project.\n\t\t&#8220;Board&#8221; means the Virginia Board for Asbestos, Lead, and Home Inspectors.\n\t\t&#8220;Friable&#8221; means that the material when dry may be crumbled, pulverized, or reduced to powder by hand pressure and includes previously nonfriable material after such previously nonfriable material becomes damaged to the extent that when dry it may be crumbled, pulverized, or reduced to powder by hand pressure.\n\t\t&#8220;Home inspection&#8221; means any inspection of a residential building for compensation conducted by a licensed home inspector. A home inspection shall include a written evaluation of the readily accessible components of a residential building, including heating, cooling, plumbing, and electrical systems; structural components; foundation; roof; masonry structure; exterior and interior components; and other related residential housing components. A home inspection may be limited in scope as provided in a home inspection contract, provided that such contract is not inconsistent with the provisions of this chapter or the regulations of the Board. For purposes of this chapter, residential building energy analysis alone, as defined in \u00a7 54.1-1144, shall not be considered a home inspection.\n\t\t&#8220;Home inspector&#8221; means a person who meets the criteria of education, experience, and testing required by this chapter and regulations of the Board and who has been licensed by the Board to perform home inspections.\n\t\t&#8220;Lead abatement&#8221; means any measure or set of measures designed to permanently eliminate lead-based paint hazards, including lead-contaminated dust or soil.\n\t\t&#8220;Lead-based paint&#8221; means paint or other surface coatings that contain lead equal to or in excess of 1.0 milligrams per square centimeter or more than 0.5 percent by weight.\n\t\t&#8220;Lead-based paint activity&#8221; means lead inspection, lead risk assessment, lead project design and abatement of lead-based paint and lead-based paint hazards, including lead-contaminated dust and lead-contaminated soil.\n\t\t&#8220;Lead-contaminated soil&#8221; means bare soil that contains lead at or in excess of levels identified by the Environmental Protection Agency.\n\t\t&#8220;Lead contractor&#8221; means a person who has met the Board&#8217;s requirements and has been issued a license by the Board to enter into contracts to perform lead abatements.\n\t\t&#8220;Lead inspection&#8221; means a surface-by-surface investigation to determine the presence of lead-based paint and the provisions of a report explaining the results of the investigation.\n\t\t&#8220;Lead inspector&#8221; means an individual who has been licensed by the Board to conduct lead inspections and abatement clearance testing.\n\t\t&#8220;Lead project design&#8221; means any descriptive form written as instructions or drafted as a plan describing the construction or setting up of a lead abatement project area and the work practices to be utilized during the lead abatement project.\n\t\t&#8220;Lead project designer&#8221; means an individual who has been licensed by the Board to prepare lead project designs.\n\t\t&#8220;Lead risk assessment&#8221; means (i) an on-site investigation to determine the existence, nature, severity and location of lead-based paint hazards and (ii) the provision of a report by the individual or the firm conducting the risk assessment, explaining the results of the investigation and options for reducing lead-based paint hazards.\n\t\t&#8220;Lead risk assessor&#8221; means an individual who has been licensed by the Board to conduct lead inspections, lead risk assessments and abatement clearance testing.\n\t\t&#8220;Lead supervisor&#8221; means an individual who has been licensed by the Board to supervise lead abatements.\n\t\t&#8220;Lead worker&#8221; or &#8220;lead abatement worker&#8221; means an individual who has been licensed by the Board to perform lead abatement.\n\t\t&#8220;Person&#8221; means a corporation, partnership, sole proprietorship, firm, enterprise, franchise, association or any other individual or entity.\n\t\t&#8220;Principal instructor&#8221; means the individual who has the primary responsibility for organizing and teaching an accredited asbestos training program, an accredited lead training program, or any combination thereof.\n\t\t&#8220;Residential building&#8221; means, for the purposes of home inspection, a structure consisting of one to four dwelling units used or occupied, or intended to be used or occupied, for residential purposes.\n\t\t&#8220;Training manager&#8221; means an authorization issued by the <span class=\"dictionary\">Board<\/span> to perform phase contrast, polarized light, or transmission electron microscopy on <span class=\"dictionary\">material<\/span> known or suspected to contain asbestos.\n\t\t&#8220;Asbestos contractor&#8217;s license&#8221; means an authorization issued by the <span class=\"dictionary\">Board<\/span> permitting a <span class=\"dictionary\">person<\/span> to enter into <span class=\"dictionary\">contracts<\/span> to perform an <span class=\"dictionary\">asbestos abatement project<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Asbestos-containing materials<\/span>&#8221; or &#8220;<span class=\"dictionary\">ACM<\/span>&#8221; means any <span class=\"dictionary\">material<\/span> or product which contains more than 1.0 percent asbestos or such other percentage as established by EPA final rule.\n\t\t&#8220;Asbestos inspector&#8217;s license&#8221; means an authorization issued by the <span class=\"dictionary\">Board<\/span> permitting a <span class=\"dictionary\">person<\/span> to perform on-site investigations to identify, classify, record, sample, test and prioritize by exposure potential <span class=\"dictionary\">asbestos-containing materials<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Asbestos management plan<\/span>&#8221; means a program designed to control or abate any potential risk to human health from asbestos.\n\t\t&#8220;Asbestos management planner&#8217;s license&#8221; means an authorization issued by the <span class=\"dictionary\">Board<\/span> permitting a <span class=\"dictionary\">person<\/span> to develop or alter an <span class=\"dictionary\">asbestos management plan<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Asbestos project<\/span>&#8221; or &#8220;<span class=\"dictionary\">asbestos abatement project<\/span>&#8221; means an activity involving job set-up for containment, removal, encapsulation, enclosure, encasement, renovation, repair, construction or alteration of an asbestos-containing <span class=\"dictionary\">material<\/span>. An <span class=\"dictionary\">asbestos project<\/span> or <span class=\"dictionary\">asbestos abatement project<\/span> shall not include nonfriable asbestos-containing roofing, flooring and siding materials which when installed, encapsulated or removed do not become <span class=\"dictionary\">friable<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Asbestos project<\/span> designer&#8217;s license&#8221; means an authorization issued by the <span class=\"dictionary\">Board<\/span> permitting a <span class=\"dictionary\">person<\/span> to design an <span class=\"dictionary\">asbestos abatement project<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Asbestos project<\/span> monitor&#8217;s license&#8221; means an authorization issued by the <span class=\"dictionary\">Board<\/span> permitting a <span class=\"dictionary\">person<\/span> to monitor an <span class=\"dictionary\">asbestos project<\/span>, subject to Department regulations.\n\t\t&#8220;<span class=\"dictionary\">Asbestos supervisor<\/span>&#8221; means any <span class=\"dictionary\">person<\/span> so designated by an asbestos contractor who provides on-site supervision and direction to the workers engaged in <span class=\"dictionary\">asbestos projects<\/span>.\n\t\t&#8220;Asbestos worker&#8217;s license&#8221; means an authorization issued by the <span class=\"dictionary\">Board<\/span> permitting an individual to work on an <span class=\"dictionary\">asbestos project<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Board<\/span>&#8221; means the Virginia <span class=\"dictionary\">Board<\/span> for Asbestos, Lead, and <span class=\"dictionary\">Home Inspectors<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Friable<\/span>&#8221; means that the <span class=\"dictionary\">material<\/span> when dry may be crumbled, pulverized, or reduced to powder by hand pressure and includes previously nonfriable <span class=\"dictionary\">material<\/span> after such previously nonfriable <span class=\"dictionary\">material<\/span> becomes damaged to the extent that when dry it may be crumbled, pulverized, or reduced to powder by hand pressure.\n\t\t&#8220;<span class=\"dictionary\">Home inspection<\/span>&#8221; means any inspection of a residential building for compensation conducted by a licensed <span class=\"dictionary\">home inspector<\/span>. A <span class=\"dictionary\">home inspection<\/span> shall include a written evaluation of the readily accessible components of a residential building, including heating, cooling, plumbing, and electrical systems; structural components; foundation; roof; masonry structure; exterior and interior components; and other related residential housing components. A <span class=\"dictionary\">home inspection<\/span> may be limited in scope as provided in a <span class=\"dictionary\">home inspection<\/span> <span class=\"dictionary\">contract<\/span>, provided that such <span class=\"dictionary\">contract<\/span> is not inconsistent with the provisions of this chapter or the regulations of the <span class=\"dictionary\">Board<\/span>. For purposes of this chapter, residential building energy analysis alone, as defined in \u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/54.1-1144\/\">54.1-1144<\/a>, shall not be considered a <span class=\"dictionary\">home inspection<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Home inspector<\/span>&#8221; means a <span class=\"dictionary\">person<\/span> who meets the criteria of education, experience, and testing required by this chapter and regulations of the <span class=\"dictionary\">Board<\/span> and who has been licensed by the <span class=\"dictionary\">Board<\/span> to perform <span class=\"dictionary\">home inspections<\/span>.\n\t\t&#8220;Lead abatement&#8221; means any measure or set of measures designed to permanently eliminate lead-based paint hazards, including lead-contaminated dust or soil.\n\t\t&#8220;Lead-based paint&#8221; means paint or other surface coatings that contain lead equal to or in excess of 1.0 milligrams per square centimeter or more than 0.5 percent by weight.\n\t\t&#8220;<span class=\"dictionary\">Lead-based paint activity<\/span>&#8221; means <span class=\"dictionary\">lead inspection<\/span>, <span class=\"dictionary\">lead risk assessment<\/span>, <span class=\"dictionary\">lead project design<\/span> and abatement of lead-based paint and lead-based paint hazards, including lead-contaminated dust and <span class=\"dictionary\">lead-contaminated soil<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Lead-contaminated soil<\/span>&#8221; means bare soil that contains lead at or in excess of levels identified by the Environmental Protection Agency.\n\t\t&#8220;<span class=\"dictionary\">Lead contractor<\/span>&#8221; means a <span class=\"dictionary\">person<\/span> who has met the <span class=\"dictionary\">Board<\/span>&#8217;s requirements and has been issued a license by the <span class=\"dictionary\">Board<\/span> to enter into <span class=\"dictionary\">contracts<\/span> to perform <span class=\"dictionary\">lead abatements<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Lead inspection<\/span>&#8221; means a surface-by-surface investigation to determine the presence of lead-based paint and the provisions of a report explaining the results of the investigation.\n\t\t&#8220;<span class=\"dictionary\">Lead inspector<\/span>&#8221; means an individual who has been licensed by the <span class=\"dictionary\">Board<\/span> to conduct <span class=\"dictionary\">lead inspections<\/span> and abatement clearance testing.\n\t\t&#8220;<span class=\"dictionary\">Lead project design<\/span>&#8221; means any descriptive form written as instructions or drafted as a plan describing the construction or setting up of a lead abatement project area and the work practices to be utilized during the lead abatement project.\n\t\t&#8220;<span class=\"dictionary\">Lead project designer<\/span>&#8221; means an individual who has been licensed by the <span class=\"dictionary\">Board<\/span> to prepare <span class=\"dictionary\">lead project designs<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Lead risk assessment<\/span>&#8221; means (i) an on-site investigation to determine the existence, nature, severity and location of lead-based paint hazards and (ii) the provision of a report by the individual or the firm conducting the risk assessment, explaining the results of the investigation and options for reducing lead-based paint hazards.\n\t\t&#8220;<span class=\"dictionary\">Lead risk assessor<\/span>&#8221; means an individual who has been licensed by the <span class=\"dictionary\">Board<\/span> to conduct <span class=\"dictionary\">lead inspections<\/span>, <span class=\"dictionary\">lead risk assessments<\/span> and abatement clearance testing.\n\t\t&#8220;<span class=\"dictionary\">Lead supervisor<\/span>&#8221; means an individual who has been licensed by the <span class=\"dictionary\">Board<\/span> to supervise <span class=\"dictionary\">lead abatements<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Lead worker<\/span>&#8221; or &#8220;<span class=\"dictionary\">lead abatement worker<\/span>&#8221; means an individual who has been licensed by the <span class=\"dictionary\">Board<\/span> to perform lead abatement.\n\t\t&#8220;<span class=\"dictionary\">Person<\/span>&#8221; means a corporation, partnership, sole proprietorship, firm, enterprise, franchise, association or any other individual or entity.\n\t\t&#8220;<span class=\"dictionary\">Principal instructor<\/span>&#8221; means the individual who has the primary responsibility for organizing and teaching an <span class=\"dictionary\">accredited asbestos training program<\/span>, an <span class=\"dictionary\">accredited lead training program<\/span>, or any combination thereof.\n\t\t&#8220;Residential building&#8221;
