Where such a third party has been designated by the tenant, the landlord shall mail the duplicate copy of any summons issued pursuant to &#xA7; 8.01-126 or notice to the designated third party at the same time the summons or notice is mailed to or served upon the tenant. Nothing in this subsection shall be construed to grant standing to any third party designated by the tenant to challenge actions of the landlord in which notice was mailed pursuant to this subsection. The failure of the landlord to give notice to a third party designated by the tenant shall not affect the validity of any judgment entered against the tenant.D\n\nA landlord or managing agent may enter into an agreement with a third-party service provider to maintain tenant records in electronic form or other medium. In such case, the landlord and managing agent shall not be liable under this section in the event of a breach of the electronic data of such third-party service provider, except in the case of gross negligence or intentional act. Nothing in this section shall be construed to require a landlord or managing agent to indemnify such third-party service provider.E\n\nA tenant may request a copy of his tenant records in paper or electronic form. If the rental agreement so provides, a landlord may charge a tenant requesting more than one copy of his records the actual costs of preparing copies of such records. <a id=\"paragraph-292914\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> The information is requested pursuant to a <span class=\"dictionary\">subpoena<\/span> in a civil case; <a id=\"paragraph-292915\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> The information is requested by a local commissioner of the revenue in accordance with &#xA7; <a class=\"law\" title=\"Apartment house, office building, shopping center, trailer camp, trailer court, self-service storage facility, marina, airport, and other owners or operators to file lists of tenants\" href=\"\/58.1-3901\/\">58.1-3901<\/a>; <a id=\"paragraph-292916\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> The information is requested by a <span class=\"dictionary\">contract<\/span> purchaser of the <span class=\"dictionary\">landlord<\/span>&#8217;s property, provided that the <span class=\"dictionary\">contract<\/span> purchaser agrees in writing to maintain the confidentiality of such information; <a id=\"paragraph-292917\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> The information is requested by a lender of the <span class=\"dictionary\">landlord<\/span> for financing or refinancing of the property; <a id=\"paragraph-292918\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> The information is requested by the commanding officer, military housing officer, or military attorney of the <span class=\"dictionary\">tenant<\/span>; <a id=\"paragraph-292919\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#A10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> The third <span class=\"dictionary\">party<\/span> is the <span class=\"dictionary\">landlord<\/span>&#8217;s attorney or the <span class=\"dictionary\">landlord<\/span>&#8217;s collection agency; <a id=\"paragraph-292920\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#A11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> The information is otherwise provided in the case of an emergency; <a id=\"paragraph-292921\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#A12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> The information is requested by the <span class=\"dictionary\">landlord<\/span> to be provided to the <span class=\"dictionary\">managing agent<\/span> or a successor to the <span class=\"dictionary\">managing agent<\/span>; or <a id=\"paragraph-292922\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#A13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> The information is requested by an employee or independent contractor of the United States to obtain census information pursuant to federal <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-292923\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#A14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Any information received by a <span class=\"dictionary\">landlord<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Application; deposit, fee, and additional information\" href=\"\/55.1-1203\/\">55.1-1203<\/a> shall remain a confidential <span class=\"dictionary\">tenant<\/span> record and shall not be released to any <span class=\"dictionary\">person<\/span> except in response to a <span class=\"dictionary\">subpoena<\/span>. <a id=\"paragraph-292924\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> A <span class=\"dictionary\">tenant<\/span> may designate a third <span class=\"dictionary\">party<\/span> to receive duplicate copies of a <span class=\"dictionary\">summons<\/span> that has been issued pursuant to &#xA7; <a class=\"law\" title=\"Summons for unlawful detainer issued by magistrate or clerk or judge of a general district court\" href=\"\/8.01-126\/\">8.01-126<\/a> and of <span class=\"dictionary\">written notices<\/span> from the <span class=\"dictionary\">landlord<\/span> relating to the tenancy. Where such a third <span class=\"dictionary\">party<\/span> has been designated by the <span class=\"dictionary\">tenant<\/span>, the <span class=\"dictionary\">landlord<\/span> shall mail the duplicate copy of any <span class=\"dictionary\">summons<\/span> issued pursuant to &#xA7; <a class=\"law\" title=\"Summons for unlawful detainer issued by magistrate or clerk or judge of a general district court\" href=\"\/8.01-126\/\">8.01-126<\/a> or <span class=\"dictionary\">notice<\/span> to the designated third <span class=\"dictionary\">party<\/span> at the same time the <span class=\"dictionary\">summons<\/span> or <span class=\"dictionary\">notice<\/span> is mailed to or served upon the <span class=\"dictionary\">tenant<\/span>. Nothing in this subsection shall be construed to grant standing to any third <span class=\"dictionary\">party<\/span> designated by the <span class=\"dictionary\">tenant<\/span> to challenge <span class=\"dictionary\">actions<\/span> of the <span class=\"dictionary\">landlord<\/span> in which <span class=\"dictionary\">notice<\/span> was mailed pursuant to this subsection. The failure of the <span class=\"dictionary\">landlord<\/span> to give <span class=\"dictionary\">notice<\/span> to a third <span class=\"dictionary\">party<\/span> designated by the <span class=\"dictionary\">tenant<\/span> shall not affect the validity of any <span class=\"dictionary\">judgment<\/span> entered against the <span class=\"dictionary\">tenant<\/span>. <a id=\"paragraph-292925\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> A <span class=\"dictionary\">landlord<\/span> or <span class=\"dictionary\">managing agent<\/span> may enter into an agreement with a third-<span class=\"dictionary\">party<\/span> service provider to maintain <span class=\"dictionary\">tenant records<\/span> in electronic form or other medium. In such case, the <span class=\"dictionary\">landlord<\/span> and <span class=\"dictionary\">managing agent<\/span> shall not be liable under this section in the event of a breach of the electronic data of such third-<span class=\"dictionary\">party<\/span> service provider, except in the case of gross <span class=\"dictionary\">negligence<\/span> or intentional act. Nothing in this section shall be construed to require a <span class=\"dictionary\">landlord<\/span> or <span class=\"dictionary\">managing agent<\/span> to indemnify such third-<span class=\"dictionary\">party<\/span> service provider. <a id=\"paragraph-292926\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> A tenant may request a copy of his <span class=\"dictionary\">tenant records<\/span> in paper or electronic form. If the <span class=\"dictionary\">rental agreement<\/span> so provides, a <span class=\"dictionary\">landlord<\/span> may charge a tenant requesting more than one copy of his records the actual costs of preparing copies of such records. However, if the <span class=\"dictionary\">landlord<\/span> makes available <span class=\"dictionary\">tenant records<\/span> to each tenant by electronic portal, the tenant shall not be required to pay for access to such portal. <a id=\"paragraph-292927\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1209\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCONFIDENTIALITY OF TENANT RECORDS (\u00a7 55.1-1209)\n\nA. No landlord or managing agent shall release information about a tenant or\nprospective tenant in the possession of the landlord or managing agent to a\nthird party unless:\n\n   1. The tenant or prospective tenant has given prior written consent;\n\n   2. The information is a matter of public record as defined in &#xA7; 2.2-3701;\n\n   3. The information is a summary of the tenant&#8217;s rent payment record,\n   including the amount of the tenant&#8217;s periodic rent payment;\n\n   4. The information is a copy of a material noncompliance notice that has not\n   been remedied or a termination notice given to the tenant under &#xA7;\n   55.1-1245 and the tenant did not remain in the premises after such notice was\n   given;\n\n   5. The information is requested by a local, state, or federal law-enforcement\n   or public safety official in the performance of his duties;\n\n   6. The information is requested pursuant to a subpoena in a civil case;\n\n   7. The information is requested by a local commissioner of the revenue in\n   accordance with &#xA7; 58.1-3901;\n\n   8. The information is requested by a contract purchaser of the\n   landlord&#8217;s property, provided that the contract purchaser agrees in\n   writing to maintain the confidentiality of such information;\n\n   9. The information is requested by a lender of the landlord for financing or\n   refinancing of the property;\n\n   10. The information is requested by the commanding officer, military housing\n   officer, or military attorney of the tenant;\n\n   11. The third party is the landlord&#8217;s attorney or the landlord&#8217;s\n   collection agency;\n\n   12. The information is otherwise provided in the case of an emergency;\n\n   13. The information is requested by the landlord to be provided to the\n   managing agent or a successor to the managing agent; or\n\n   14. The information is requested by an employee or independent contractor of\n   the United States to obtain census information pursuant to federal law.\n\nB. Any information received by a landlord pursuant to &#xA7; 55.1-1203 shall\nremain a confidential tenant record and shall not be released to any person\nexcept in response to a subpoena.\n\nC. A tenant may designate a third party to receive duplicate copies of a summons\nthat has been issued pursuant to &#xA7; 8.01-126 and of written notices from the\nlandlord relating to the tenancy. Where such a third party has been designated\nby the tenant, the landlord shall mail the duplicate copy of any summons issued\npursuant to &#xA7; 8.01-126 or notice to the designated third party at the same\ntime the summons or notice is mailed to or served upon the tenant. Nothing in\nthis subsection shall be construed to grant standing to any third party\ndesignated by the tenant to challenge actions of the landlord in which notice\nwas mailed pursuant to this subsection. The failure of the landlord to give\nnotice to a third party designated by the tenant shall not affect the validity\nof any judgment entered against the tenant.\n\nD. A landlord or managing agent may enter into an agreement with a third-party\nservice provider to maintain tenant records in electronic form or other medium.\nIn such case, the landlord and managing agent shall not be liable under this\nsection in the event of a breach of the electronic data of such third-party\nservice provider, except in the case of gross negligence or intentional act.\nNothing in this section shall be construed to require a landlord or managing\nagent to indemnify such third-party service provider.\n\nE.
