Subject to the provisions of subsections B, C, and E, upon request, any unit owner shall be provided a copy of such records and minutes. All financial books and records shall be kept in accordance with generally accepted accounting practices. The unit owners&#8217; association shall maintain individual assessment account records. The unit owners&#8217; association shall maintain a record of any recorded lien at least as long as the lien remains effective.B\n\nSubject to the provisions of subsection C, all books and records kept by or on behalf of the unit owners&#8217; association, including the unit owners&#8217; association membership list, and addresses and aggregate salary information of unit owners&#8217; association employees, shall be available for examination and copying by a unit owner in good standing or his authorized agent so long as the request is for a proper purpose related to his membership in the unit owners&#8217; association and not for pecuniary gain or commercial solicitation. Notwithstanding any provision of law to the contrary, this right of examination shall exist without reference to the duration of membership and may be exercised (i) only during reasonable business hours or at a mutually convenient time and location and (ii) upon five business days&#8217; written notice for a unit owner association managed by a common interest community manager and 10 business days&#8217; written notice for a self-managed unit owners&#8217; association, which notice shall reasonably identify the purpose for the request and the specific books and records of the unit owners&#8217; association requested.C\n\nBooks and records kept by or on behalf of a unit owners&#8217; association may be withheld from examination or copying by unit owners and contract purchasers to the extent that they are drafts not yet incorporated into the books and records of the unit owners&#8217; association or if such books and records concern:1\n\nPersonnel matters relating to specific, identified persons or a person&#8217;s medical records;2\n\nContracts, leases, and other commercial transactions to purchase or provide goods or services, currently in or under negotiation;3\n\nPending or probable litigation. Unfortunately, the 1980 \u201cActs\u201d aren\u2019t available online. It has been modified 14 times. Subject to the provisions of subsections B, C, and E, upon request, any <span class=\"dictionary\">unit owner<\/span> shall be provided a copy of such records and minutes. All financial books and records shall be kept in accordance with generally accepted accounting practices. The <span class=\"dictionary\">unit owners<\/span>&#8217; association shall maintain individual assessment account records. The <span class=\"dictionary\">unit owners<\/span>&#8217; association shall maintain a record of any recorded <span class=\"dictionary\">lien<\/span> at least as long as the <span class=\"dictionary\">lien<\/span> remains effective. <a id=\"paragraph-311044\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Subject to the provisions of subsection C, all books and records kept by or on behalf of the <span class=\"dictionary\">unit owners<\/span>&#8217; association, including the <span class=\"dictionary\">unit owners<\/span>&#8217; association membership list, and addresses and aggregate salary information of <span class=\"dictionary\">unit owners<\/span>&#8217; association employees, shall be available for examination and copying by a <span class=\"dictionary\">unit owner<\/span> in good standing or his authorized agent so long as the request is for a proper purpose related to his membership in the <span class=\"dictionary\">unit owners<\/span>&#8217; association and not for pecuniary gain or commercial solicitation. Notwithstanding any provision of <span class=\"dictionary\">law<\/span> to the contrary, this right of examination shall exist without reference to the duration of membership and may be exercised (i) only during reasonable business hours or at a mutually convenient time and location and (ii) upon five business days&#8217; written notice for a <span class=\"dictionary\">unit owner<\/span> association managed by a <span class=\"dictionary\">common interest community manager<\/span> and 10 business days&#8217; written notice for a self-managed <span class=\"dictionary\">unit owners<\/span>&#8217; association, which notice shall reasonably identify the purpose for the request and the specific books and records of the <span class=\"dictionary\">unit owners<\/span>&#8217; association requested. <a id=\"paragraph-311045\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Books and records kept by or on behalf of a <span class=\"dictionary\">unit owners<\/span>&#8217; association may be withheld from examination or copying by <span class=\"dictionary\">unit owners<\/span> and <span class=\"dictionary\">contract<\/span> <span class=\"dictionary\">purchasers<\/span> to the extent that they are drafts not yet incorporated into the books and records of the <span class=\"dictionary\">unit owners<\/span>&#8217; association or if such books and records concern: <a id=\"paragraph-311046\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Personnel matters relating to specific, identified <span class=\"dictionary\">persons<\/span> or a <span class=\"dictionary\">person<\/span>&#8217;s medical records; <a id=\"paragraph-311047\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> <span class=\"dictionary\">Contracts<\/span>, leases, and other commercial transactions to purchase or provide goods or services, currently in or under negotiation; <a id=\"paragraph-311048\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Pending or <span class=\"dictionary\">probable litigation<\/span>. For purposes of this subdivision, &#8220;<span class=\"dictionary\">probable litigation<\/span>&#8221; means those instances where there has been a specific threat of litigation from a <span class=\"dictionary\">person<\/span> or the legal <span class=\"dictionary\">counsel<\/span> of such <span class=\"dictionary\">person<\/span>; <a id=\"paragraph-311049\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Matters involving state or local administrative or other formal proceedings before a government tribunal for enforcement of the <span class=\"dictionary\">condominium<\/span> instruments or rules and regulations promulgated by the <span class=\"dictionary\">executive board<\/span>; <a id=\"paragraph-311050\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Communications with legal <span class=\"dictionary\">counsel<\/span> that relate to subdivisions 1 through 4 or that are protected by the attorney-client <span class=\"dictionary\">privilege<\/span> or the attorney work product doctrine; <a id=\"paragraph-311051\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#C5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Disclosure of information in violation of <span class=\"dictionary\">law<\/span>; <a id=\"paragraph-311052\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#C6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Meeting minutes or other confidential records of an executive session of the <span class=\"dictionary\">executive board<\/span> held pursuant to subsection C of &#xA7; <a class=\"law\" title=\"Meetings of unit owners&#039; association and executive board\" href=\"\/55.1-1949\/\">55.1-1949<\/a>; <a id=\"paragraph-311053\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#C7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Documentation, correspondence or management or <span class=\"dictionary\">executive board<\/span> reports compiled for or on behalf of the <span class=\"dictionary\">unit owners<\/span>&#8217; association or the <span class=\"dictionary\">executive board<\/span> by its agents or committees for consideration by the <span class=\"dictionary\">executive board<\/span> in executive session; or <a id=\"paragraph-311054\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#C8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Individual <span class=\"dictionary\">unit owner<\/span> or member files, other than those of the requesting <span class=\"dictionary\">unit owner<\/span>, including any individual <span class=\"dictionary\">unit owner<\/span>&#8217;s files kept by or on behalf of the <span class=\"dictionary\">unit owners<\/span>&#8217; association. <a id=\"paragraph-311055\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#C9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Books and records kept by or on behalf of a <span class=\"dictionary\">unit owners<\/span>&#8217; association shall be withheld from examination and copying in their entirety only to the extent that an exclusion from disclosure under subsection C applies to the entire content of such books and records. Otherwise, only those portions of the books and records containing information subject to an exclusion under subsection C may be withheld or redacted, and all portions of the books and records that are not so excluded shall be available for examination and copying, provided that the requesting member shall be responsible to the association for paying or reimbursing the association for any reasonable costs incurred by the association in responding to the request for the books and records and review for redaction of the same. <a id=\"paragraph-311056\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-1945\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Prior to providing copies of any books and records, the <span class=\"dictionary\">unit owners<\/span>&#8217; association may impose and collect a charge, not to exceed the reasonable costs of <span class=\"dictionary\">materials<\/span> and labor, incurred to provide such copies. Charges may be imposed only in accordance with a cost schedule adopted by the <span class=\"dictionary\">executive board<\/span> in accordance with this subsection.
