The time-share instrument shall contain the following:1\n\nThe name of the time-share project, which shall include or be followed by a qualifying adjective or term outlined in &#xA7; 55.1-2205;2\n\nThe name of the locality and the state or situs in which the time-share project is situated;3\n\nThe legal description, street address, or other description sufficient to identify the time-share project;4\n\nA legally sufficient description of the real estate constituting the time-share project;5\n\nA statement of the form of time-share program, i.e., whether it is a time-share estate or time-share use;6\n\nIdentification of time periods by letter, name, number, or combination thereof;7\n\nIdentification of time-shares and, where applicable, the method by which additional time-shares may be created or withdrawn;8\n\nThe formula, fraction, or percentage of the common expenses and any voting rights assigned to each time-share;9\n\nAny restrictions on the use, occupancy, enjoyment, alteration, or alienation of time-shares;10\n\nThe ownership interest, if any, in personal property available to time-share owners;11\n\nThe program by which the managing entity, if any, will provide management of the project;12\n\nThe period for which units are designated and committed to the time-share program and the property classification of the units at the expiration of such period;13\n\nAny provision for amending the time-share instrument;14\n\nA description of the events, including condemnation and damage or destruction, upon which the time-share program may or shall be terminated before the expiration of its full term and the consequences of such termination, including the manner in which the time-share project or the proceeds from the disposition of such project shall be held or distributed among owners;15\n\nA statement of whether or not the developer reserves the right to add to or delete any incidental benefit; and16\n\nSuch other matters as the developer deems appropriate.B\n\nIn order to create a time-share program for a time-share use project, the developer shall (i) execute and record a time-share instrument as required by subsection A or (ii) execute a time-share instrument that takes the form of and is a part of the contract that contains the information required by subsection A.C\n\nIf the developer explicitly reserves the right to develop additional time-shares, the time-share instrument shall also contain the following:1\n\nA legally sufficient description of all land that may be added to the time-share project, which shall be referred to as &#8220;additional land&#8221;;2\n\nA statement outlining the order in which portions of the additional land may be subjected to the exercise of each development right or a statement that no assurances are made in that regard;3\n\nA statement of the time limit upon which the option to develop shall expire, together with a statement of the circumstances, if any, that will terminate that option prior to the expiration of the specified time limit;4\n\nA statement of the maximum number of units that may be added to the time-share project, if known, or, if the maximum number of units that may be added to the time-share project is not known, a statement to that effect; and5\n\nA statement of the property classification of the additional land if the developer fails to exercise the development rights as reserved in the time-share instrument.","order_by":null,"text":{"0":{"id":208140,"text":"In order to create a time-share program for a time-share estate project, the developer shall execute a time-share instrument prepared and executed in accordance with this chapter and record it in the clerk&#8217;s office where such time-share project is located. <a id=\"paragraph-208154\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-2208\/#A14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A15\" class=\"indent-1\"><p><span class=\"prefix-number\">15.<\/span> A statement of whether or not the <span class=\"dictionary\">developer<\/span> reserves the right to add to or delete any <span class=\"dictionary\">incidental benefit<\/span>; and <a id=\"paragraph-208155\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-2208\/#A15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A16\" class=\"indent-1\"><p><span class=\"prefix-number\">16.<\/span> Such other matters as the <span class=\"dictionary\">developer<\/span> deems appropriate. <a id=\"paragraph-208156\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-2208\/#A16\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> In <span class=\"dictionary\">order<\/span> to create a <span class=\"dictionary\">time-share program<\/span> for a <span class=\"dictionary\">time-share use<\/span> project, the <span class=\"dictionary\">developer<\/span> shall (i) execute and record a <span class=\"dictionary\">time-share instrument<\/span> as required by subsection A or (ii) execute a <span class=\"dictionary\">time-share instrument<\/span> that takes the form of and is a part of the <span class=\"dictionary\">contract<\/span> that contains the information required by subsection A. <a id=\"paragraph-208157\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-2208\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> If the <span class=\"dictionary\">developer<\/span> explicitly reserves the right to develop additional <span class=\"dictionary\">time-shares<\/span>, the <span class=\"dictionary\">time-share instrument<\/span> shall also contain the following: <a id=\"paragraph-208158\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-2208\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> A legally sufficient description of all land that may be added to the <span class=\"dictionary\">time-share project<\/span>, which shall be referred to as &#8220;<span class=\"dictionary\">additional land<\/span>&#8221;; <a id=\"paragraph-208159\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-2208\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> A statement outlining the <span class=\"dictionary\">order<\/span> in which portions of the <span class=\"dictionary\">additional land<\/span> may be subjected to the exercise of each <span class=\"dictionary\">development right<\/span> or a statement that no assurances are made in that regard; <a id=\"paragraph-208160\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-2208\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> A statement of the time limit upon which the option to develop shall expire, together with a statement of the circumstances, if any, that will terminate that option prior to the expiration of the specified time limit; <a id=\"paragraph-208161\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-2208\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> A statement of the maximum number of <span class=\"dictionary\">units<\/span> that may be added to the <span class=\"dictionary\">time-share project<\/span>, if known, or, if the maximum number of <span class=\"dictionary\">units<\/span> that may be added to the <span class=\"dictionary\">time-share project<\/span> is not known, a statement to that effect; and <a id=\"paragraph-208162\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-2208\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> A statement of the property classification of the <span class=\"dictionary\">additional land<\/span> if the <span class=\"dictionary\">developer<\/span> fails to exercise the <span class=\"dictionary\">development rights<\/span> as reserved in the <span class=\"dictionary\">time-share instrument<\/span>. <a id=\"paragraph-208163\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/55.1-2208\/#C5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nINSTRUMENTS (\u00a7 55.1-2208)\n\nA. In order to create a time-share program for a time-share estate project, the\ndeveloper shall execute a time-share instrument prepared and executed in\naccordance with this chapter and record it in the clerk&#8217;s office where\nsuch time-share project is located. The time-share instrument shall contain the\nfollowing:\n\n   1. The name of the time-share project, which shall include or be followed by a\n   qualifying adjective or term outlined in &#xA7; 55.1-2205;\n\n   2. The name of the locality and the state or situs in which the time-share\n   project is situated;\n\n   3. The legal description, street address, or other description sufficient to\n   identify the time-share project;\n\n   4. A legally sufficient description of the real estate constituting the\n   time-share project;\n\n   5. A statement of the form of time-share program, i.e., whether it is a\n   time-share estate or time-share use;\n\n   6. Identification of time periods by letter, name, number, or combination\n   thereof;\n\n   7. Identification of time-shares and, where applicable, the method by which\n   additional time-shares may be created or withdrawn;\n\n   8. The formula, fraction, or percentage of the common expenses and any voting\n   rights assigned to each time-share;\n\n   9. Any restrictions on the use, occupancy, enjoyment, alteration, or\n   alienation of time-shares;\n\n   10. The ownership interest, if any, in personal property available to\n   time-share owners;\n\n   11. The program by which the managing entity, if any, will provide management\n   of the project;\n\n   12. The period for which units are designated and committed to the time-share\n   program and the property classification of the units at the expiration of such\n   period;\n\n   13. Any provision for amending the time-share instrument;\n\n   14. A description of the events, including condemnation and damage or\n   destruction, upon which the time-share program may or shall be terminated\n   before the expiration of its full term and the consequences of such\n   termination, including the manner in which the time-share project or the\n   proceeds from the disposition of such project shall be held or distributed\n   among owners;\n\n   15. A statement of whether or not the developer reserves the right to add to\n   or delete any incidental benefit; and\n\n   16. Such other matters as the developer deems appropriate.\n\nB. In order to create a time-share program for a time-share use project, the\ndeveloper shall (i) execute and record a time-share instrument as required by\nsubsection A or (ii) execute a time-share instrument that takes the form of and\nis a part of the contract that contains the information required by subsection\nA.\n\nC. If the developer explicitly reserves the right to develop additional\ntime-shares, the time-share instrument shall also contain the following:\n\n   1. A legally sufficient description of all land that may be added to the\n   time-share project, which shall be referred to as &#8220;additional\n   land&#8221;;\n\n   2. A statement outlining the order in which portions of the additional land\n   may be subjected to the exercise of each development right or a statement that\n   no assurances are made in that regard;\n\n   3. A statement of the time limit upon which the option to develop shall\n   expire, together with a statement of the circumstances, if any, that will\n   terminate that option prior to the expiration of the specified time limit;\n\n   4. A statement of the maximum number of units that may be added to the\n   time-share project, if known, or, if the maximum number of units that may be\n   added to the time-share project is not known, a statement to that effect; and\n\n   5.
