I, c. 248.","full_text":"As used in this article, unless the context requires a different meaning:\n\t\t&#8220;Automatic location identification&#8221; or &#8220;ALI&#8221; means a telecommunications network capability that enables the automatic display of information defining the geographical location of the telephone used to place a wireless enhanced 9-1-1 call.\n\t\t&#8220;Automatic number identification&#8221; or &#8220;ANI&#8221; means a telecommunications network capability that enables the automatic display of the telephone number used to place a wireless Enhanced 9-1-1 call.\n\t\t&#8220;Board&#8221; means the 9-1-1 Services Board created pursuant to this article.\n\t\t&#8220;Chief Information Officer&#8221; or &#8220;CIO&#8221; means the Chief Information Officer appointed pursuant to \u00a7 2.2-2005.\n\t\t&#8220;Coordinator&#8221; means the Virginia Public Safety Communications Systems Coordinator employed by the Division.\n\t\t&#8220;CMRS&#8221; means mobile telecommunications service as defined in the federal Mobile Telecommunications Sourcing Act, 4 U.S.C. \u00a7 124, as amended.\n\t\t&#8220;CMRS provider&#8221; means an entity authorized by the Federal Communications Commission to provide CMRS within the Commonwealth.\n\t\t&#8220;Division&#8221; means the Division of Public Safety Communications created in \u00a7 44-146.18:5.\n\t\t&#8220;Emergency services IP network&#8221; or &#8220;ESInet&#8221; means a shared public safety agency-managed Internet protocol (IP) network that (i) is used for emergency services communications, (ii) provides an IP transport infrastructure that is capable of carrying voice and data and that supports next generation 9-1-1 service core functions such as routing and location validation of emergency service requests, and (iii) is engineered, managed, and intended to support emergency public safety communications and 9-1-1 service.\n\t\t&#8220;Enhanced 9-1-1 service&#8221; or &#8220;E-911&#8243; means a service consisting of telephone network features and PSAPs provided for users of telephone systems enabling such users to reach a PSAP by dialing the digits &#8220;9-1-1.&#8221; Such service automatically directs 9-1-1 emergency telephone calls to the appropriate PSAPs by selective routing based on the geographical location from which the emergency call originated and provides the capability for ANI and ALI features.\n\t\t&#8220;ESInet point of interconnection&#8221; means the demarcation point at which the NG9-1-1 Service Provider receives and assumes responsibility for 9-1-1 call traffic from originating service providers.\n\t\t&#8220;Local exchange carrier&#8221; means any public service company granted a certificate to furnish public utility service for the provision of local exchange telephone service pursuant to Chapter 10.1 (\u00a7 56-265.1 et seq.) of Title 56.\n\t\t&#8220;Next generation 9-1-1 service&#8221; or &#8220;NG9-1-1&#8243; means a service that (i) consists of coordinated intrastate 9-1-1 IP networks serving residents of the Commonwealth with the routing of emergency service requests, by voice or data, across public safety ESInets; (ii) automatically directs 9-1-1 emergency telephone calls and other emergency service requests in data formats to the appropriate PSAPs by routing using geographical information system data; (iii) provides for ANI and ALI features; and (iv) interconnects with enhanced 9-1-1 service.\n\t\t&#8220;9-1-1 service&#8221; includes E-911 and NG9-1-1.\n\t\t&#8220;Originating service provider&#8221; means the local exchange carrier, VoIP provider, or CMRS provider that serves the end user over which a 9-1-1 call, 9-8-8 call, call to the crisis call center, as defined in \u00a7 37.2-311.1, or call to the NSPL, as defined in \u00a7 37.2-311.1, is made.\n\t\t&#8220;Place of primary use&#8221; has the meaning as defined in the federal Mobile Telecommunications Sourcing Act, 4 U.S.C. \u00a7 124, as amended.\n\t\t&#8220;Postpaid CMRS&#8221; means CMRS that is not prepaid CMRS, as defined in \u00a7 56-484.17:1.\n\t\t&#8220;Public safety answering point&#8221; or &#8220;PSAP&#8221; means a facility (i) equipped and staffed on a 24-hour basis to receive and process 9-1-1 calls or (ii) that intends to receive and process 9-1-1 calls and has notified CMRS providers in its jurisdiction of its intention to receive and process such calls.\n\t\t&#8220;VoIP service&#8221; means interconnected voice over Internet protocol service as defined in the Code of Federal Regulations, Title 47, Part 9, section 9.3, as amended.\n\t\t&#8220;Wireless E-911 Fund&#8221; means the fund created pursuant to \u00a7 56-484.17.\n\t\t&#8220;Wireless E-911 surcharge&#8221; means any <span class=\"dictionary\">public service company<\/span> granted a certificate to furnish public utility service for the provision of <span class=\"dictionary\">local exchange telephone service<\/span> pursuant to Chapter 10.1 (\u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/56-265.1\/\">56-265.1<\/a> et seq.) of Title 56.\n\t\t&#8220;Next generation 9-1-1 service&#8221; or &#8220;NG9-1-1&#8243; means a service that (i) consists of coordinated intrastate 9-1-1 IP networks serving residents of the Commonwealth with the routing of emergency service requests, by voice or data, across public safety <span class=\"dictionary\">ESInets<\/span>; (ii) automatically directs 9-1-1 emergency telephone calls and other emergency service requests in data formats to the appropriate <span class=\"dictionary\">PSAPs<\/span> by routing using geographical information system data; (iii) provides for <span class=\"dictionary\">ANI<\/span> and <span class=\"dictionary\">ALI<\/span> features; and (iv) interconnects with enhanced 9-1-1 service.\n\t\t&#8220;9-1-1 service&#8221; includes E-911 and NG9-1-1.\n\t\t&#8220;<span class=\"dictionary\">Originating service provider<\/span>&#8221; means the <span class=\"dictionary\">local exchange carrier<\/span>, VoIP provider, or <span class=\"dictionary\">CMRS provider<\/span> that serves the end user over which a 9-1-1 call, 9-8-8 call, call to the crisis call center, as defined in \u00a7&nbsp;<a class=\"law\" title=\"Comprehensive crisis system; Marcus alert system; powers and duties of the Department related to comprehensive mental health, substance abuse, and developmental disability crisis services\" href=\"\/37.2-311.1\/\">37.2-311.1<\/a>, or call to the NSPL, as defined in \u00a7&nbsp;<a class=\"law\" title=\"Comprehensive crisis system; Marcus alert system; powers and duties of the Department related to comprehensive mental health, substance abuse, and developmental disability crisis services\" href=\"\/37.2-311.1\/\">37.2-311.1<\/a>, is made.\n\t\t&#8220;Place of primary use&#8221; has the meaning as defined in the federal Mobile Telecommunications Sourcing Act, 4 U.S.C. \u00a7&nbsp;124, as amended.\n\t\t&#8220;<span class=\"dictionary\">Postpaid CMRS<\/span>&#8221; means CMRS that is not prepaid CMRS, as defined in \u00a7&nbsp;<a class=\"law\" title=\"Collection of prepaid wireless E-911 charge at point of sale; rate established\" href=\"\/56-484.17_1\/\">56-484.17:1<\/a>.\n\t\t&#8220;<span class=\"dictionary\">Public safety answering point<\/span>&#8221; or &#8220;<span class=\"dictionary\">PSAP<\/span>&#8221; means a facility (i) equipped and staffed on a 24-hour basis to receive and process 9-1-1 calls or (ii) that intends to receive and process 9-1-1 calls and has notified <span class=\"dictionary\">CMRS providers<\/span> in its <span class=\"dictionary\">jurisdiction<\/span> of its intention to receive and process such calls.\n\t\t&#8220;<span class=\"dictionary\">VoIP service<\/span>&#8221; means interconnected voice over Internet protocol service as defined in the Code of Federal Regulations, Title 47, Part 9, section 9.3, as amended.\n\t\t&#8220;Wireless E-911 Fund&#8221; means the fund created pursuant to \u00a7&nbsp;<a class=\"law\" title=\"Wireless E-911 Fund; uses of Fund; enforcement; audit required\" href=\"\/56-484.17\/\">56-484.17<\/a>.\n\t\t&#8220;Wireless E-911 surcharge&#8221; means a fee billed with respect to <span class=\"dictionary\">postpaid CMRS<\/span> customers by each <span class=\"dictionary\">CMRS provider<\/span> and CMRS reseller on each CMRS device capable of two-way interactive voice communication.<\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS (\u00a7 56-484.12)\n\nAs used in this article, unless the context requires a different meaning:\n\t\t&#8220;Automatic location identification&#8221; or &#8220;ALI&#8221; means a\ntelecommunications network capability that enables the automatic display of\ninformation defining the geographical location of the telephone used to place a\nwireless enhanced 9-1-1 call.\n\t\t&#8220;Automatic number identification&#8221; or &#8220;ANI&#8221; means a\ntelecommunications network capability that enables the automatic display of the\ntelephone number used to place a wireless Enhanced 9-1-1 call.\n\t\t&#8220;Board&#8221; means the 9-1-1 Services Board created pursuant to this\narticle.\n\t\t&#8220;Chief Information Officer&#8221; or &#8220;CIO&#8221; means the Chief\nInformation Officer appointed pursuant to \u00a7 2.2-2005.\n\t\t&#8220;Coordinator&#8221; means the Virginia Public Safety Communications\nSystems Coordinator employed by the Division.\n\t\t&#8220;CMRS&#8221; means mobile telecommunications service as defined in the\nfederal Mobile Telecommunications Sourcing Act, 4 U.S.C. \u00a7 124, as amended.\n\t\t&#8220;CMRS provider&#8221; means an entity authorized by the Federal\nCommunications Commission to provide CMRS within the Commonwealth.\n\t\t&#8220;Division&#8221; means the Division of Public Safety Communications\ncreated in \u00a7 44-146.18:5.\n\t\t&#8220;Emergency services IP network&#8221; or &#8220;ESInet&#8221; means a\nshared public safety agency-managed Internet protocol (IP) network that (i) is\nused for emergency services communications, (ii) provides an IP transport\ninfrastructure that is capable of carrying voice and data and that supports next\ngeneration 9-1-1 service core functions such as routing and location validation\nof emergency service requests, and (iii) is engineered, managed, and intended to\nsupport emergency public safety communications and 9-1-1 service.\n\t\t&#8220;Enhanced 9-1-1 service&#8221; or &#8220;E-911&#8243; means a service\nconsisting of telephone network features and PSAPs provided for users of\ntelephone systems enabling such users to reach a PSAP by dialing the digits\n&#8220;9-1-1.&#8221; Such service automatically directs 9-1-1 emergency\ntelephone calls to the appropriate PSAPs by selective routing based on the\ngeographical location from which the emergency call originated and provides the\ncapability for ANI and ALI features.\n\t\t&#8220;ESInet point of interconnection&#8221; means the demarcation point at\nwhich the NG9-1-1 Service Provider receives and assumes responsibility for 9-1-1\ncall traffic from originating service providers.\n\t\t&#8220;Local exchange carrier&#8221; means any public service company granted\na certificate to furnish public utility service for the provision of local\nexchange telephone service pursuant to Chapter 10.1 (\u00a7 56-265.1 et seq.) of\nTitle 56.\n\t\t&#8220;Next generation 9-1-1 service&#8221; or &#8220;NG9-1-1&#8243; means a\nservice that (i) consists of coordinated intrastate 9-1-1 IP networks serving\nresidents of the Commonwealth with the routing of emergency service requests, by\nvoice or data, across public safety ESInets; (ii) automatically directs 9-1-1\nemergency telephone calls and other emergency service requests in data formats\nto the appropriate PSAPs by routing using geographical information system data;\n(iii) provides for ANI and ALI features;
