The standards shall meet or exceed nationally recognized emergency cardiovascular care guidelines. At a minimum, training standards shall require dispatchers to obtain certification in cardiopulmonary resuscitation and shall incorporate recognition protocols for out-of-hospital cardiac arrest, compression-only cardiopulmonary resuscitation instructions for callers, and continuing education as appropriate. The Office shall update such standards as frequently as necessary, but not more frequently than biennially, in order to keep the standards current with nationally recognized emergency cardiovascular care guidelines.C\n\nOn or before January 1, 2022, each PSAP shall provide training in TCPR to each dispatcher in its employ and shall provide its dispatchers with equipment necessary for the provision of TCPR. The training and equipment shall comply with the standards adopted by the Office pursuant to subsection B. Following completion of the initial training, each dispatcher&#8217;s training shall be updated or supplemented in order to reflect updates to the training standards.D\n\nAn operator of a PSAP may enter into a reciprocal agreement with the operator of another PSAP authorizing the initial PSAP to transfer callers to the other PSAP at times that the PSAP does not have a trained dispatcher on duty who is able to provide TCPR to a caller. If a PSAP transfers a caller under the provisions of this subsection, the transferring PSAP shall use an evidence-based protocol for the identification of a person in need of cardiopulmonary resuscitation and ensure that the PSAP to which calls are transferred uses dispatchers who meet the training requirements under subsection B to provide assistance on administering TCPR.E\n\nThe Office of Emergency Medical Services shall identify all public agencies and other persons that provide TCPR training that satisfies the requirements adopted under subsection B and set minimum standards for course approval, instruction, and examination, including online training modules based on nationally recognized guidelines. The Office shall implement a means to ensure that every dispatcher who has satisfactorily completed a training program and his employing PSAP receive a certificate of completion of the required TCPR training.F\n\nNo dispatcher who instructs a caller on TCPR shall be liable for any civil damages arising out of the instruction provided to the caller, except for acts or omissions intentionally designed to harm or for grossly negligent acts or omissions that result in harm to an individual. A caller may decline to receive TCPR. When a caller declines <span class=\"dictionary\">TCPR<\/span>, the <span class=\"dictionary\">dispatcher<\/span> has no obligation to provide such instruction. <a id=\"paragraph-300813\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-484.16_1\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> By January 1, 2024, each operator of a <span class=\"dictionary\">PSAP<\/span> shall implement a requirement that each of its <span class=\"dictionary\">dispatchers<\/span> shall by July 1, 2024, have completed an <span class=\"dictionary\"><span class=\"dictionary\">Emergency Medical Dispatch<\/span> education program<\/span> that complies with minimum standards established by the <span class=\"dictionary\">Office<\/span> of Emergency Medical Services. The <span class=\"dictionary\">Office<\/span> shall ensure that every <span class=\"dictionary\">dispatcher<\/span> who has satisfactorily completed an <span class=\"dictionary\"><span class=\"dictionary\">Emergency Medical Dispatch<\/span> education program<\/span> and his employing <span class=\"dictionary\">PSAP<\/span> receive a certificate of completion of the required education program. Following completion of the initial <span class=\"dictionary\"><span class=\"dictionary\">Emergency Medical Dispatch<\/span> education program<\/span>, each <span class=\"dictionary\">dispatcher<\/span>&#8217;s training shall be updated or supplemented in <span class=\"dictionary\">order<\/span> to reflect updates to the education program. <a id=\"paragraph-300814\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-484.16_1\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> Each <span class=\"dictionary\">PSAP<\/span> shall conduct ongoing quality assurance of its <span class=\"dictionary\">TCPR<\/span> program. <a id=\"paragraph-300815\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-484.16_1\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> The State <span class=\"dictionary\">Board<\/span> of Health shall adopt regulations in accordance with the provisions of the Administrative Process Act (&#xA7; <a class=\"law\" title=\"Short title; purpose\" href=\"\/2.2-4000\/\">2.2-4000<\/a> et seq.) as are necessary to implement the provisions of this section. <a id=\"paragraph-300816\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-484.16_1\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPSAP DISPATCHERS; TRAINING REQUIREMENTS (\u00a7 56-484.16:1)\n\nA. As used in this section:\n\t\t\t&#8220;Dispatcher&#8221; means an individual employed by a public safety\nanswering point, an emergency medical dispatch service provider, or both, who is\nqualified to answer incoming emergency telephone calls or provide for the\nappropriate emergency response either directly or through communication with the\nappropriate PSAP.\n\t\t\t&#8220;Emergency Medical Dispatch&#8221; means a systematic program of\nhandling medical calls pursuant to which trained dispatchers determine the\nnature and priority of the call, dispatch the appropriate response, and give the\ncaller instructions to help treat the caller until the arrival of the\nappropriate responder.\n\t\t\t&#8220;Emergency Medical Dispatch certification&#8221; means certification by\nan Office of Emergency Medical Services recognized emergency dispatch training\norganization meeting or exceeding standards by the National Highway Traffic\nSafety Administration and accepted and recognized by the American Society for\nTesting Materials (ASTM).\n\t\t\t&#8220;Emergency Medical Dispatch education program&#8221; means an Emergency\nMedical Dispatch certification education program that meets national criteria\nset forth by the National Highway Traffic Safety Administration.\n\t\t\t&#8220;High-quality telecommunicator cardiopulmonary resuscitation\ninstruction&#8221; or &#8220;TCPR&#8221; means the delivery by trained 911\ntelecommunicators of high-quality cardiopulmonary resuscitation instruction for\nacute events requiring cardiopulmonary resuscitation, including out-of-hospital\ncardiac arrests.\n\t\t\t&#8220;Office&#8221; means the Office of Emergency Medical Services within\nthe Department of Health.\n\nB. By July 1, 2021, the Office of Emergency Medical Services shall adopt\nstandards for training and equipment required for the provision of TCPR by\ndispatchers. The standards shall meet or exceed nationally recognized emergency\ncardiovascular care guidelines. At a minimum, training standards shall require\ndispatchers to obtain certification in cardiopulmonary resuscitation and shall\nincorporate recognition protocols for out-of-hospital cardiac arrest,\ncompression-only cardiopulmonary resuscitation instructions for callers, and\ncontinuing education as appropriate. The Office shall update such standards as\nfrequently as necessary, but not more frequently than biennially, in order to\nkeep the standards current with nationally recognized emergency cardiovascular\ncare guidelines.\n\nC. On or before January 1, 2022, each PSAP shall provide training in TCPR to\neach dispatcher in its employ and shall provide its dispatchers with equipment\nnecessary for the provision of TCPR. The training and equipment shall comply\nwith the standards adopted by the Office pursuant to subsection B. Following\ncompletion of the initial training, each dispatcher&#8217;s training shall be\nupdated or supplemented in order to reflect updates to the training standards.\n\nD. An operator of a PSAP may enter into a reciprocal agreement with the operator\nof another PSAP authorizing the initial PSAP to transfer callers to the other\nPSAP at times that the PSAP does not have a trained dispatcher on duty who is\nable to provide TCPR to a caller. If a PSAP transfers a caller under the\nprovisions of this subsection, the transferring PSAP shall use an evidence-based\nprotocol for the identification of a person in need of cardiopulmonary\nresuscitation and ensure that the PSAP to which calls are transferred uses\ndispatchers who meet the training requirements under subsection B to provide\nassistance on administering TCPR.\n\nE. The Office of Emergency Medical Services shall identify all public agencies\nand other persons that provide TCPR training that satisfies the requirements\nadopted under subsection B and set minimum standards for course approval,\ninstruction, and examination, including online training modules based on\nnationally recognized guidelines. The Office shall implement a means to ensure\nthat every dispatcher who has satisfactorily completed a training program and\nhis employing PSAP receive a certificate of completion of the required TCPR\ntraining.\n\nF. No dispatcher who instructs a caller on TCPR shall be liable for any civil\ndamages arising out of the instruction provided to the caller, except for acts\nor omissions intentionally designed to harm or for grossly negligent acts or\nomissions that result in harm to an individual. A caller may decline to receive\nTCPR. When a caller declines TCPR, the dispatcher has no obligation to provide\nsuch instruction.\n\nG. By January 1, 2024, each operator of a PSAP shall implement a requirement\nthat each of its dispatchers shall by July 1, 2024, have completed an Emergency\nMedical Dispatch education program that complies with minimum standards\nestablished by the Office of Emergency Medical Services. The Office shall ensure\nthat every dispatcher who has satisfactorily completed an Emergency Medical\nDispatch education program and his employing PSAP receive a certificate of\ncompletion of the required education program. Following completion of the\ninitial Emergency Medical Dispatch education program, each dispatcher&#8217;s\ntraining shall be updated or supplemented in order to reflect updates to the\neducation program.\n\nH. Each PSAP shall conduct ongoing quality assurance of its TCPR program.\n\nI.
