{"formats":[{"name":"JSON","format":"json","url":"\/downloads\/2025\/code-json\/56-585.7.json"},{"name":"Plain Text","format":"text","url":"\/downloads\/2025\/code-text\/56-585.7.txt"},{"name":"XML","format":"xml","url":"\/downloads\/2025\/code-xml\/56-585.7.xml"},{"name":"HTML","format":"html","url":"\/downloads\/2025\/code-html\/56-585.7.html"}],"law_id":63065,"edition_id":1,"section_id":63065,"structure_id":13084,"section_number":"56-585.7","catch_line":"On-bill tariff program; electric cooperatives","history":"2020, c. 807; 2024, c. 607.","full_text":"A\n\nAs used in this section:\n\t\t\t&#8220;Cooperative&#8221; means a utility consumer services cooperative.\n\t\t\t&#8220;Eligible customer&#8221; means a member-consumer receiving service from a cooperative that (i) has asked to participate in the cooperative&#8217;s on-bill tariff program and (ii) has been determined by the cooperative to be eligible to participate in its on-bill tariff program.\n\t\t\t&#8220;Energy efficiency measures&#8221; means any installation, improvement, addition, or equipment approved by the cooperative for purpose of its on-bill tariff program that has the primary purpose of improving the energy efficiency of the premises and reducing its consumption of energy, including heating and air conditioning systems, water heaters, weatherization, insulation, window and door modifications, appliances, and automatic or Internet-connected energy control systems. &#8220;Energy efficiency measures&#8221; does not include (i) energy conservation measures to improve the energy efficiency of premises constructed within five years prior to an eligible customer&#8217;s request to participate in an on-bill tariff program or premises that are under initial construction or (ii) the electrification of any process or activity primarily fueled by natural gas.\n\t\t\t&#8220;Energy savings charge&#8221; means the charge placed by the cooperative on the monthly billing statement of an eligible customer or subsequent customers in order to recover the costs of the energy efficiency measures installed at the eligible customer&#8217;s premises.\n\t\t\t&#8220;On-bill tariff agreement&#8221; means an agreement between an eligible customer and a cooperative that provides for the terms, conditions, payments, and costs, including financing or capital costs, of the installation of energy efficiency measures at a premises to be paid by or through the cooperative and repaid by the eligible customer or subsequent customer at the same premises by means of an energy savings charge.\n\t\t\t&#8220;On-bill tariff program&#8221; means a voluntary tariff program that allows eligible customers (i) to arrange through the cooperative for its provision and installation, including by its chosen vendors, of energy efficiency measures at the customer&#8217;s premises without an upfront payment and (ii) to pay back over time the cost of the energy efficiency measures through an energy savings charge.\n\t\t\t&#8220;Program costs&#8221; means a participating cooperative&#8217;s (i) identified, projected, and actual costs to design, implement, and operate its on-bill tariff program, including costs to request and evaluate vendor proposals and manage the vendors; (ii) administrative, labor, and marketing charges; (iii) costs of obtaining funds used by the cooperative to pay for the energy efficiency measures; (iv) write-offs for unpaid energy savings charges after reasonable collection efforts; and (v) reasonable margin.B\n\nOn or after January 1, 2021, notwithstanding any other provision of law, a cooperative may, without Commission approval, upon an affirmative resolution of its board of directors and without the requirement of any filing other than as required in this subsection, propose, establish, and implement an on-bill tariff program for energy efficiency measures, provided that such program adheres to the provisions of this section. This regulated, tariffed program shall be reviewable by the Commission at the cooperative&#8217;s next general rate proceeding. A cooperative shall recover the program costs through a new rate schedule established by this section or otherwise through its rates. A cooperative shall file a copy of any such new rate schedule with the Commission for informational purposes.C\n\nAt least 120 days prior to making an informational filing as described in subsection B, a cooperative shall conduct a stakeholder process to design the on-bill tariff program collaboratively with interested parties. Such stakeholder process shall be open to the cooperative&#8217;s membership and invited guests and shall include an opportunity to participate for low-income and middle-income advocates, energy efficiency advocates, affordable housing advocates, and the staff of the Commission. The stakeholder process shall examine and recommend, among other things, appropriate additional consumer safeguards for potential adoption by the cooperative, including oversight of third-party vendors and appropriate methods for notifying customers that vendors are subject to the Virginia Consumer Protection Act (&#xA7; 59.1-196 et seq.). The stakeholder process shall allow for remote or electronic participation and may include multiple cooperatives or be coordinated, convened, and facilitated by a group or association of cooperatives. The meetings of the stakeholders may be held anywhere in the Commonwealth. The cooperative shall include documentation concerning the stakeholder process in its informational filing to the Commission.D\n\nA cooperative&#8217;s on-bill tariff program shall include criteria for selecting eligible customers; limits on the individual and aggregate amounts of energy efficiency measures for each eligible customer; limits on the overall amount available under the on-bill tariff program; generally applicable repayment terms; and qualifications of potential vendors that will market or install energy efficiency measures. Multiple cooperatives may collaborate to create a similar structure for on-bill tariff programs.E\n\nAn on-bill tariff agreement shall:1\n\nSpecify that the eligible customer or subsequent customers at the premises shall only be responsible for the payment of the energy savings charge upon satisfactory installation of the energy efficiency measures as set forth in their on-bill tariff agreement;2\n\nSpecify that the cooperative may recover the costs, including financing or capital costs, of installing the energy efficiency measures at an eligible customer&#8217;s premises through the energy savings charge;3\n\nProvide for the inclusion of an energy savings charge that is stated as a separate line item on the eligible customer&#8217;s or subsequent customer&#8217;s utility bill;4\n\nProvide that an eligible customer shall enter into an on-bill tariff agreement to participate in the on-bill tariff program;5\n\nProvide that the cooperative may apply the energy savings charge to the meter or bill of subsequent customers at the premises and that the then-current eligible customer is required to notify the subsequent customer of the on-bill tariff agreement and the energy savings charge;6\n\nDeem amounts due under the tariff to be amounts owed for regulated electric service and for which an eligible customer is subject to disconnection of service pursuant to the cooperative&#8217;s existing policies for disconnection;7\n\nProvide that any loan or financing interest rate or cost of capital, or their equivalent, that is provided to the eligible customer pursuant to an on-bill tariff agreement shall be less than prevailing market rates;8\n\nProvide that payments for energy-saving charges made by eligible and subsequent customers shall be retained by the cooperative and amounts credited against the appropriate category of program costs; and9\n\nResult in deemed savings that are reasonably projected, based on the customer&#8217;s energy utilization and rates at the beginning of the term, to result in lower energy bills for the customer, and that allocate a portion of the gross cost savings resulting from the energy efficiency measures to the eligible customer and the remaining portion to the cooperative to recover the program costs.F\n\nCustomers having a grievance or complaints against an on-bill tariff program shall have recourse to the informal and formal procedures of the Commission.","order_by":null,"text":{"0":{"id":229997,"text":"As used in this section:\n\t\t\t&#8220;Cooperative&#8221; means a utility consumer services <span class=\"dictionary\">cooperative<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Eligible customer<\/span>&#8221; means a member-consumer receiving service from a <span class=\"dictionary\">cooperative<\/span> that (i) has asked to participate in the <span class=\"dictionary\">cooperative<\/span>&#8217;s <span class=\"dictionary\">on-bill tariff program<\/span> and (ii) has been determined by the <span class=\"dictionary\">cooperative<\/span> to be eligible to participate in its <span class=\"dictionary\">on-bill tariff program<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Energy efficiency measures<\/span>&#8221; means any installation, improvement, addition, or equipment approved by the <span class=\"dictionary\">cooperative<\/span> for purpose of its <span class=\"dictionary\">on-bill tariff program<\/span> that has the primary purpose of improving the energy efficiency of the premises and reducing its consumption of energy, including heating and air conditioning systems, water heaters, weatherization, insulation, window and door modifications, appliances, and automatic or Internet-connected energy control systems. &#8220;<span class=\"dictionary\">Energy efficiency measures<\/span>&#8221; does not include (i) energy conservation measures to improve the energy efficiency of premises constructed within five years prior to an <span class=\"dictionary\">eligible customer<\/span>&#8217;s request to participate in an <span class=\"dictionary\">on-bill tariff program<\/span> or premises that are under initial construction or (ii) the <span class=\"dictionary\">electrification<\/span> of any process or activity primarily fueled by natural gas.\n\t\t\t&#8220;<span class=\"dictionary\">Energy savings charge<\/span>&#8221; means the charge placed by the <span class=\"dictionary\">cooperative<\/span> on the monthly billing statement of an <span class=\"dictionary\">eligible customer<\/span> or subsequent customers in <span class=\"dictionary\">order<\/span> to recover the costs of the <span class=\"dictionary\">energy efficiency measures<\/span> installed at the <span class=\"dictionary\">eligible customer<\/span>&#8217;s premises.\n\t\t\t&#8220;<span class=\"dictionary\">On-bill tariff agreement<\/span>&#8221; means an agreement between an <span class=\"dictionary\">eligible customer<\/span> and a <span class=\"dictionary\">cooperative<\/span> that provides for the terms, conditions, payments, and costs, including financing or capital costs, of the installation of <span class=\"dictionary\">energy efficiency measures<\/span> at a premises to be paid by or through the <span class=\"dictionary\">cooperative<\/span> and repaid by the <span class=\"dictionary\">eligible customer<\/span> or subsequent customer at the same premises by means of an <span class=\"dictionary\">energy savings charge<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">On-bill tariff program<\/span>&#8221; means a voluntary tariff program that allows <span class=\"dictionary\">eligible customers<\/span> (i) to arrange through the <span class=\"dictionary\">cooperative<\/span> for its provision and installation, including by its chosen vendors, of <span class=\"dictionary\">energy efficiency measures<\/span> at the customer&#8217;s premises without an upfront payment and (ii) to pay back over time the cost of the <span class=\"dictionary\">energy efficiency measures<\/span> through an <span class=\"dictionary\">energy savings charge<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Program costs<\/span>&#8221; means a participating <span class=\"dictionary\">cooperative<\/span>&#8217;s (i) identified, projected, and actual costs to design, implement, and operate its <span class=\"dictionary\">on-bill tariff program<\/span>, including costs to request and evaluate vendor proposals and manage the vendors; (ii) administrative, labor, and marketing charges; (iii) costs of obtaining funds used by the <span class=\"dictionary\">cooperative<\/span> to pay for the <span class=\"dictionary\">energy efficiency measures<\/span>; (iv) write-offs for unpaid <span class=\"dictionary\">energy savings charges<\/span> after reasonable collection efforts; and (v) reasonable margin. <a id=\"paragraph-229997\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> On or after January 1, 2021, notwithstanding any other provision of <span class=\"dictionary\">law<\/span>, a <span class=\"dictionary\">cooperative<\/span> may, without <span class=\"dictionary\">Commission<\/span> approval, upon an affirmative resolution of its board of directors and without the requirement of any filing other than as required in this subsection, propose, establish, and implement an <span class=\"dictionary\">on-bill tariff program<\/span> for <span class=\"dictionary\">energy efficiency measures<\/span>, provided that such program adheres to the provisions of this section. This regulated, tariffed program shall be reviewable by the <span class=\"dictionary\">Commission<\/span> at the <span class=\"dictionary\">cooperative<\/span>&#8217;s next general <span class=\"dictionary\">rate<\/span> proceeding. A <span class=\"dictionary\">cooperative<\/span> shall recover the <span class=\"dictionary\">program costs<\/span> through a new <span class=\"dictionary\">rate<\/span> schedule established by this section or otherwise through its <span class=\"dictionary\">rates<\/span>. A <span class=\"dictionary\">cooperative<\/span> shall file a copy of any such new <span class=\"dictionary\">rate<\/span> schedule with the <span class=\"dictionary\">Commission<\/span> for informational purposes. <a id=\"paragraph-229998\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> At least 120 days prior to making an informational filing as described in subsection B, a <span class=\"dictionary\">cooperative<\/span> shall conduct a stakeholder process to design the <span class=\"dictionary\">on-bill tariff program<\/span> collaboratively with interested parties. Such stakeholder process shall be open to the <span class=\"dictionary\">cooperative<\/span>&#8217;s membership and invited guests and shall include an opportunity to participate for low-income and middle-income advocates, energy efficiency advocates, affordable housing advocates, and the staff of the <span class=\"dictionary\">Commission<\/span>. The stakeholder process shall examine and recommend, among other things, appropriate additional consumer safeguards for potential adoption by the <span class=\"dictionary\">cooperative<\/span>, including oversight of third-<span class=\"dictionary\">party<\/span> vendors and appropriate methods for notifying customers that vendors are subject to the Virginia Consumer Protection Act (&#xA7; <a class=\"law\" title=\"Title\" href=\"\/59.1-196\/\">59.1-196<\/a> et seq.). The stakeholder process shall allow for remote or electronic participation and may include multiple <span class=\"dictionary\">cooperatives<\/span> or be coordinated, convened, and facilitated by a group or association of <span class=\"dictionary\">cooperatives<\/span>. The meetings of the stakeholders may be held anywhere in the Commonwealth. The <span class=\"dictionary\">cooperative<\/span> shall include documentation concerning the stakeholder process in its informational filing to the <span class=\"dictionary\">Commission<\/span>. <a id=\"paragraph-229999\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> A <span class=\"dictionary\">cooperative<\/span>&#8217;s <span class=\"dictionary\">on-bill tariff program<\/span> shall include criteria for selecting <span class=\"dictionary\">eligible customers<\/span>; limits on the individual and aggregate amounts of <span class=\"dictionary\">energy efficiency measures<\/span> for each <span class=\"dictionary\">eligible customer<\/span>; limits on the overall amount available under the <span class=\"dictionary\">on-bill tariff program<\/span>; generally applicable repayment terms; and qualifications of potential vendors that will market or install <span class=\"dictionary\">energy efficiency measures<\/span>. Multiple <span class=\"dictionary\">cooperatives<\/span> may collaborate to create a similar structure for <span class=\"dictionary\">on-bill tariff programs<\/span>. <a id=\"paragraph-230000\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> An <span class=\"dictionary\">on-bill tariff agreement<\/span> shall: <a id=\"paragraph-230001\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Specify that the <span class=\"dictionary\">eligible customer<\/span> or subsequent customers at the premises shall only be responsible for the payment of the <span class=\"dictionary\">energy savings charge<\/span> upon satisfactory installation of the <span class=\"dictionary\">energy efficiency measures<\/span> as set forth in their <span class=\"dictionary\">on-bill tariff agreement<\/span>; <a id=\"paragraph-230002\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#E1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Specify that the <span class=\"dictionary\">cooperative<\/span> may recover the costs, including financing or capital costs, of installing the <span class=\"dictionary\">energy efficiency measures<\/span> at an <span class=\"dictionary\">eligible customer<\/span>&#8217;s premises through the <span class=\"dictionary\">energy savings charge<\/span>; <a id=\"paragraph-230003\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#E2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Provide for the inclusion of an <span class=\"dictionary\">energy savings charge<\/span> that is stated as a separate line item on the <span class=\"dictionary\">eligible customer<\/span>&#8217;s or subsequent customer&#8217;s utility bill; <a id=\"paragraph-230004\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#E3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Provide that an <span class=\"dictionary\">eligible customer<\/span> shall enter into an <span class=\"dictionary\">on-bill tariff agreement<\/span> to participate in the <span class=\"dictionary\">on-bill tariff program<\/span>; <a id=\"paragraph-230005\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#E4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Provide that the <span class=\"dictionary\">cooperative<\/span> may apply the <span class=\"dictionary\">energy savings charge<\/span> to the meter or bill of subsequent customers at the premises and that the then-current <span class=\"dictionary\">eligible customer<\/span> is required to notify the subsequent customer of the <span class=\"dictionary\">on-bill tariff agreement<\/span> and the <span class=\"dictionary\">energy savings charge<\/span>; <a id=\"paragraph-230006\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#E5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Deem amounts due under the tariff to be amounts owed for regulated electric service and for which an <span class=\"dictionary\">eligible customer<\/span> is subject to disconnection of service pursuant to the <span class=\"dictionary\">cooperative<\/span>&#8217;s existing policies for disconnection; <a id=\"paragraph-230007\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#E6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Provide that any loan or financing interest <span class=\"dictionary\">rate<\/span> or cost of capital, or their equivalent, that is provided to the <span class=\"dictionary\">eligible customer<\/span> pursuant to an <span class=\"dictionary\">on-bill tariff agreement<\/span> shall be less than prevailing market <span class=\"dictionary\">rates<\/span>; <a id=\"paragraph-230008\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#E7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Provide that payments for energy-saving charges made by eligible and subsequent customers shall be retained by the <span class=\"dictionary\">cooperative<\/span> and amounts credited against the appropriate category of <span class=\"dictionary\">program costs<\/span>; and <a id=\"paragraph-230009\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#E8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Result in deemed savings that are reasonably projected, based on the customer&#8217;s energy utilization and <span class=\"dictionary\">rates<\/span> at the beginning of the term, to result in lower energy bills for the customer, and that allocate a portion of the gross cost savings resulting from the <span class=\"dictionary\">energy efficiency measures<\/span> to the <span class=\"dictionary\">eligible customer<\/span> and the remaining portion to the <span class=\"dictionary\">cooperative<\/span> to recover the <span class=\"dictionary\">program costs<\/span>. <a id=\"paragraph-230010\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#E9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> Customers having a grievance or complaints against an <span class=\"dictionary\">on-bill tariff program<\/span> shall have recourse to the informal and formal procedures of the <span class=\"dictionary\">Commission<\/span>. <a id=\"paragraph-230011\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-585.7\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nON-BILL TARIFF PROGRAM; As used in this section:\n\t\t\t&#8220;Cooperative&#8221; means a utility consumer services cooperative.\n\t\t\t&#8220;Eligible customer&#8221; means a member-consumer receiving service\nfrom a cooperative that (i) has asked to participate in the cooperative&#8217;s\non-bill tariff program and (ii) has been determined by the cooperative to be\neligible to participate in its on-bill tariff program.\n\t\t\t&#8220;Energy efficiency measures&#8221; means any installation, improvement,\naddition, or equipment approved by the cooperative for purpose of its on-bill\ntariff program that has the primary purpose of improving the energy efficiency\nof the premises and reducing its consumption of energy, including heating and\nair conditioning systems, water heaters, weatherization, insulation, window and\ndoor modifications, appliances, and automatic or Internet-connected energy\ncontrol systems. &#8220;Energy efficiency measures&#8221; does not include (i)\nenergy conservation measures to improve the energy efficiency of premises\nconstructed within five years prior to an eligible customer&#8217;s request to\nparticipate in an on-bill tariff program or premises that are under initial\nconstruction or (ii) the electrification of any process or activity primarily\nfueled by natural gas.\n\t\t\t&#8220;Energy savings charge&#8221; means the charge placed by the\ncooperative on the monthly billing statement of an eligible customer or\nsubsequent customers in order to recover the costs of the energy efficiency\nmeasures installed at the eligible customer&#8217;s premises.\n\t\t\t&#8220;On-bill tariff agreement&#8221; means an agreement between an eligible\ncustomer and a cooperative that provides for the terms, conditions, payments,\nand costs, including financing or capital costs, of the installation of energy\nefficiency measures at a premises to be paid by or through the cooperative and\nrepaid by the eligible customer or subsequent customer at the same premises by\nmeans of an energy savings charge.\n\t\t\t&#8220;On-bill tariff program&#8221; means a voluntary tariff program that\nallows eligible customers (i) to arrange through the cooperative for its\nprovision and installation, including by its chosen vendors, of energy\nefficiency measures at the customer&#8217;s premises without an upfront payment\nand (ii) to pay back over time the cost of the energy efficiency measures\nthrough an energy savings charge.\n\t\t\t&#8220;Program costs&#8221; means a participating cooperative&#8217;s (i)\nidentified, projected, and actual costs to design, implement, and operate its\non-bill tariff program, including costs to request and evaluate vendor proposals\nand manage the vendors; (ii) administrative, labor, and marketing charges; (iii)\ncosts of obtaining funds used by the cooperative to pay for the energy\nefficiency measures; (iv) write-offs for unpaid energy savings charges after\nreasonable collection efforts; and (v) reasonable margin.\n\nB. On or after January 1, 2021, notwithstanding any other provision of law, a\ncooperative may, without Commission approval, upon an affirmative resolution of\nits board of directors and without the requirement of any filing other than as\nrequired in this subsection, propose, establish, and implement an on-bill tariff\nprogram for energy efficiency measures, provided that such program adheres to\nthe provisions of this section. This regulated, tariffed program shall be\nreviewable by the Commission at the cooperative&#8217;s next general rate\nproceeding. A cooperative shall recover the program costs through a new rate\nschedule established by this section or otherwise through its rates. A\ncooperative shall file a copy of any such new rate schedule with the Commission\nfor informational purposes.\n\nC. At least 120 days prior to making an informational filing as described in\nsubsection B, a cooperative shall conduct a stakeholder process to design the\non-bill tariff program collaboratively with interested parties. Such stakeholder\nprocess shall be open to the cooperative&#8217;s membership and invited guests\nand shall include an opportunity to participate for low-income and middle-income\nadvocates, energy efficiency advocates, affordable housing advocates, and the\nstaff of the Commission. The stakeholder process shall examine and recommend,\namong other things, appropriate additional consumer safeguards for potential\nadoption by the cooperative, including oversight of third-party vendors and\nappropriate methods for notifying customers that vendors are subject to the\nVirginia Consumer Protection Act (&#xA7; 59.1-196 et seq.). The stakeholder\nprocess shall allow for remote or electronic participation and may include\nmultiple cooperatives or be coordinated, convened, and facilitated by a group or\nassociation of cooperatives. The meetings of the stakeholders may be held\nanywhere in the Commonwealth. The cooperative shall include documentation\nconcerning the stakeholder process in its informational filing to the\nCommission.\n\nD. A cooperative&#8217;s on-bill tariff program shall include criteria for\nselecting eligible customers; limits on the individual and aggregate amounts of\nenergy efficiency measures for each eligible customer; limits on the overall\namount available under the on-bill tariff program; generally applicable\nrepayment terms; and qualifications of potential vendors that will market or\ninstall energy efficiency measures. Multiple cooperatives may collaborate to\ncreate a similar structure for on-bill tariff programs.\n\nE. An on-bill tariff agreement shall:\n\n   1. Specify that the eligible customer or subsequent customers at the premises\n   shall only be responsible for the payment of the energy savings charge upon\n   satisfactory installation of the energy efficiency measures as set forth in\n   their on-bill tariff agreement;\n\n   2. Specify that the cooperative may recover the costs, including financing or\n   capital costs, of installing the energy efficiency measures at an eligible\n   customer&#8217;s premises through the energy savings charge;\n\n   3. Provide for the inclusion of an energy savings charge that is stated as a\n   separate line item on the eligible customer&#8217;s or subsequent\n   customer&#8217;s utility bill;\n\n   4. Provide that an eligible customer shall enter into an on-bill tariff\n   agreement to participate in the on-bill tariff program;\n\n   5. Provide that the cooperative may apply the energy savings charge to the\n   meter or bill of subsequent customers at the premises and that the\n   then-current eligible customer is required to notify the subsequent customer\n   of the on-bill tariff agreement and the energy savings charge;\n\n   6. Deem amounts due under the tariff to be amounts owed for regulated electric\n   service and for which an eligible customer is subject to disconnection of\n   service pursuant to the cooperative&#8217;s existing policies for\n   disconnection;\n\n   7. Provide that any loan or financing interest rate or cost of capital, or\n   their equivalent, that is provided to the eligible customer pursuant to an\n   on-bill tariff agreement shall be less than prevailing market rates;\n\n   8. Provide that payments for energy-saving charges made by eligible and\n   subsequent customers shall be retained by the cooperative and amounts credited\n   against the appropriate category of program costs; and\n\n   9. Result in deemed savings that are reasonably projected, based on the\n   customer&#8217;s energy utilization and rates at the beginning of the term, to\n   result in lower energy bills for the customer, and that allocate a portion of\n   the gross cost savings resulting from the energy efficiency measures to the\n   eligible customer and the remaining portion to the cooperative to recover the\n   program costs.\n\nF.
