In establishing such targets, the Commission shall seek to optimize energy efficiency and the health and safety benefits of utility energy efficiency programs.B\n\nIn advance of the effective date of such annual energy efficiency targets, the first of which shall be for 2025, the Commission shall, after notice and opportunity for hearing, initiate proceedings to establish such targets and the appropriate retail sales against which the energy efficiency targets will be measured. All savings from low-income <span class=\"dictionary\">energy efficiency programs<\/span> shall be applied to the energy efficiency savings set forth in subsection B of &#xA7; <a class=\"law\" title=\"Energy efficiency policy and programs; financial assistance for low-income customers\" href=\"\/56-596.2\/\">56-596.2<\/a>. <a id=\"paragraph-253269\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-596.2_2\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> In providing such low-income <span class=\"dictionary\">energy efficiency programs<\/span>, Phase II Utilities shall make best efforts to coordinate such <span class=\"dictionary\">energy efficiency programs<\/span> with any health and safety upgrades provided through <span class=\"dictionary\">energy efficiency programs<\/span> authorized by subdivision C 2 of &#xA7; <a class=\"law\" title=\" Clean Energy and Community Flood Preparedness\" href=\"\/10.1-1330\/\">10.1-1330<\/a>, when reasonably feasible to do so and at the utility&#8217;s sole discretion. <a id=\"paragraph-253270\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-596.2_2\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> For the purposes of this act, &#8220;<span class=\"dictionary\">Phase II Utility<\/span>&#8221; has the same meaning as provided in subdivision A 1 of &#xA7; <a class=\"law\" title=\"Generation, distribution, and transmission rates after capped rates terminate or expire\" href=\"\/56-585.1\/\">56-585.1<\/a>. <a id=\"paragraph-253271\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/56-596.2_2\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\n(EXPIRES JANUARY 1, 2031) ENERGY EFFICIENCY SAVINGS TARGETS FOR CERTAIN\nCUSTOMERS (\u00a7 56-596.2:2)\n\nA. The Commission shall establish for Phase II Utilities annual energy\nefficiency savings targets for customers who are low-income, elderly, disabled,\nor veterans of military service to be achieved through utility energy efficiency\nprograms (low-income energy efficiency savings programs) designed to benefit\nsuch customers, provided that each year&#8217;s target shall be measured by the\ntotal combined kilowatt-hour savings achieved by electric utility energy\nefficiency and demand response programs and measures installed for such\ncustomers in that program year, as well as savings still being achieved by\nmeasures and programs implemented for such customers in prior years, and that\nsuch annual targets shall be at least one percent of the average annual energy\nretail sales by that utility to those customers, to the extent that the\npotential exists and is reasonably achievable as determined by the Commission.\nIn establishing such targets, the Commission shall seek to optimize energy\nefficiency and the health and safety benefits of utility energy efficiency\nprograms.\n\nB. In advance of the effective date of such annual energy efficiency targets,\nthe first of which shall be for 2025, the Commission shall, after notice and\nopportunity for hearing, initiate proceedings to establish such targets and the\nappropriate retail sales against which the energy efficiency targets will be\nmeasured. In setting such targets, the Commission shall consider the impact and\nsavings of energy efficiency programs authorized by subdivision C 2 of &#xA7;\n10.1-1330. The Commission shall also consider federal loan guarantees, grant\nfunds, and rebates made available pursuant to the federal Inflation Reduction\nAct (P.L. 117-169) or other similar federal legislation that facilitates energy\nefficiency projects.\n\nC. For the time period 2028 through 2030, the Commission shall review and, at\nits discretion, revise such minimum annual targets to ensure continued\nconsistency with the provisions of this section. All savings from low-income\nenergy efficiency programs shall be applied to the energy efficiency savings set\nforth in subsection B of &#xA7; 56-596.2.\n\nD.
