Nevertheless, if the contributions raised from the public, whether all of such are or are not received by any charitable organization during any calendar year, shall be in excess of $5,000, it shall, within 30 days after the date it has received total contributions in excess of $5,000, register with and report to the Commissioner as required by this chapter.4\n\nOrganizations that solicit only within the membership of the organization by the members thereof.5\n\nOrganizations that have no office within the Commonwealth, that solicit in the Commonwealth from outside of the Commonwealth solely by means of email, telephone or telegraph, direct mail, or advertising in national media, and that have a chapter, branch, or affiliate within the Commonwealth that has registered with the Commissioner.6\n\nOrganizations that have been granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code and that are organized wholly as Area Health Education Centers in accordance with &#xA7; 32.1-122.7.7\n\nHealth care institutions defined herein as any facilities that have been granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code, and that are (i) licensed by the Department of Health or the Department of Behavioral Health and Developmental Services; (ii) designated by the Health Care Financing Administration (HCFA) as federally qualified health centers; (iii) certified by the HCFA as rural health clinics; or (iv) wholly organized for the delivery of health care services without charge; and any supporting organization that exists solely to support any such health care institutions. For the purposes of clause (iv), &#8220;delivery of health care services without charge&#8221; includes the delivery of dental, medical or other health services where a reasonable minimum fee is charged to cover administrative costs.8\n\nCivic organizations as defined herein.9\n\nAgencies providing or offering to provide debt management plans for consumers that are licensed pursuant to Chapter 20 (&#xA7; 6.2-2000 et seq.) of Title 6.2.10\n\nAgencies designated by the Virginia Department for Aging and Rehabilitative Services pursuant to subdivision A 6 of &#xA7; 51.5-135 as area agencies on aging.11\n\nLabor unions, labor associations and labor organizations that have been granted tax-exempt status under &#xA7; 501(c)(5) of the Internal Revenue Code.12\n\nTrade associations that have been granted tax-exempt status under &#xA7; 501(c)(6) of the Internal Revenue Code.13\n\nOrganizations that have been granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code and that are organized wholly as regional emergency medical services councils in accordance with &#xA7; 32.1-111.4:2.14\n\nNonprofit organizations that have been granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code and that solicit contributions only through (i) grant proposals submitted to for-profit corporations, (ii) grant proposals submitted to other nonprofit organizations that have been granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code, or (iii) grant proposals submitted to organizations determined to be private foundations under &#xA7; 509(a) of the Internal Revenue Code.B\n\nA charitable organization shall be subject to the provisions of &#xA7;&#xA7; 57-57 and 57-59, but shall otherwise be exempt from the provisions of this chapter for any year in which it confines its solicitations in the Commonwealth to five or fewer contiguous cities and counties, and in which it has registered under the charitable solicitations ordinance, if any, of each such city and county. No organization shall be exempt under this subsection if, during its next preceding fiscal year, more than 10 percent of its gross receipts were paid to any person or combination of persons, located outside the boundaries of such cities and counties, other than for the purchase of real property, or tangible personal property or personal services to be used within such localities. An organization that is otherwise qualified for exemption under this subsection that solicits by means of a local publication, or radio or television station, shall not be disqualified solely because the circulation or range of such medium extends beyond the boundaries of such cities or counties.C\n\nNo charitable or civic organization shall be exempt under this section unless it submits to the Commissioner, who in his discretion may extend such filing deadline prospectively or retrospectively for good cause shown, on forms to be prescribed by him, the name, address and purpose of the organization and a statement setting forth the reason for the claim for exemption. Parent organizations may file consolidated applications for exemptions for any chapters, branches, or affiliates that they believe to be exempt from the registration provisions of this chapter. If the organization is exempted, the Commissioner shall issue a letter of exemption, which may be exhibited to the public. A registration fee of $10 shall be required of every organization requesting an exemption after June 30, 1984. prohibition against support of terrorists\" href=\"\/57-49\/\">57-49<\/a>, but shall otherwise be subject to the provisions of this chapter: <a id=\"paragraph-212262\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Educational institutions that are accredited by the <span class=\"dictionary\">Board<\/span> of Education, by a regional accrediting association or by an organization affiliated with the National Commission on Accrediting, the Association Montessori Internationale, the American Montessori Society, the Virginia Independent Schools Association, or the Virginia Association of Independent Schools, any foundation having an established identity with any of the aforementioned educational institutions, and any other educational institution confining its <span class=\"dictionary\">solicitation<\/span> of <span class=\"dictionary\">contributions<\/span> to its student body, alumni, faculty and trustees, and their families. <a id=\"paragraph-212263\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> <span class=\"dictionary\">Persons<\/span> requesting <span class=\"dictionary\">contributions<\/span> for the relief of any individual specified by name at the time of the <span class=\"dictionary\">solicitation<\/span> when all of the <span class=\"dictionary\">contributions<\/span> collected without any deductions whatsoever are turned over to the named beneficiary for his use. <a id=\"paragraph-212264\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> <span class=\"dictionary\">Charitable organizations<\/span> that do not intend to <span class=\"dictionary\">solicit<\/span> and receive, during a calendar year, and have not actually raised or received, during any of the three next preceding calendar years, <span class=\"dictionary\">contributions<\/span> from the public in excess of $5,000, if all of their functions, including fund-raising activities, are carried on by <span class=\"dictionary\">persons<\/span> who are unpaid for their services and if no part of their <span class=\"dictionary\">assets<\/span> or income inures to the benefit of or is paid to any officer or member. Nevertheless, if the <span class=\"dictionary\">contributions<\/span> raised from the public, whether all of such are or are not received by any <span class=\"dictionary\">charitable organization<\/span> during any calendar year, shall be in excess of $5,000, it shall, within 30 days after the date it has received total <span class=\"dictionary\">contributions<\/span> in excess of $5,000, register with and report to the <span class=\"dictionary\">Commissioner<\/span> as required by this chapter. <a id=\"paragraph-212265\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Organizations that <span class=\"dictionary\">solicit<\/span> only within the <span class=\"dictionary\">membership<\/span> of the organization by the members thereof. <a id=\"paragraph-212266\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Organizations that have no office within the Commonwealth, that <span class=\"dictionary\">solicit<\/span> in the Commonwealth from outside of the Commonwealth solely by means of email, telephone or telegraph, direct mail, or advertising in national media, and that have a chapter, branch, or affiliate within the Commonwealth that has registered with the <span class=\"dictionary\">Commissioner<\/span>. <a id=\"paragraph-212267\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Organizations that have been granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code and that are organized wholly as Area Health Education Centers in accordance with &#xA7; <a class=\"law\" title=\"Virginia Health Workforce Development Authority; purpose\" href=\"\/32.1-122.7\/\">32.1-122.7<\/a>. <a id=\"paragraph-212268\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Health care institutions defined herein as any facilities that have been granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code, and that are (i) licensed by the <span class=\"dictionary\">Department<\/span> of Health or the <span class=\"dictionary\">Department<\/span> of Behavioral Health and Developmental Services; (ii) designated by the Health Care Financing Administration (HCFA) as federally qualified health centers; (iii) certified by the HCFA as rural health clinics; or (iv) wholly organized for the <span class=\"dictionary\">delivery of health care services without charge<\/span>; and any supporting organization that exists solely to support any such health care institutions. For the purposes of clause (iv), &#8220;<span class=\"dictionary\">delivery of health care services without charge<\/span>&#8221; includes the delivery of dental, medical or other health services where a reasonable minimum fee is charged to cover administrative costs. <a id=\"paragraph-212269\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> <span class=\"dictionary\">Civic organizations<\/span> as defined herein. <a id=\"paragraph-212270\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Agencies providing or offering to provide debt management plans for consumers that are licensed pursuant to Chapter 20 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/6.2-2000\/\">6.2-2000<\/a> et seq.) of Title 6.2. <a id=\"paragraph-212271\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Agencies designated by the Virginia <span class=\"dictionary\">Department<\/span> for Aging and Rehabilitative Services pursuant to subdivision A 6 of &#xA7; <a class=\"law\" title=\"Powers and duties of Department with respect to aging persons; area agencies on aging\" href=\"\/51.5-135\/\">51.5-135<\/a> as area agencies on aging. <a id=\"paragraph-212272\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Labor unions, labor associations and labor organizations that have been granted tax-exempt status under &#xA7; 501(c)(5) of the Internal Revenue Code. <a id=\"paragraph-212273\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> Trade associations that have been granted tax-exempt status under &#xA7; 501(c)(6) of the Internal Revenue Code. <a id=\"paragraph-212274\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> Organizations that have been granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code and that are organized wholly as regional emergency medical services councils in accordance with &#xA7; <a class=\"law\" title=\"Regional emergency medical services councils\" href=\"\/32.1-111.4_2\/\">32.1-111.4:2<\/a>. <a id=\"paragraph-212275\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> Nonprofit organizations that have been granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code and that <span class=\"dictionary\">solicit<\/span> <span class=\"dictionary\">contributions<\/span> only through (i) grant proposals submitted to for-profit corporations, (ii) grant proposals submitted to other nonprofit organizations that have been granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code, or (iii) grant proposals submitted to organizations determined to be private foundations under &#xA7; 509(a) of the Internal Revenue Code. <a id=\"paragraph-212276\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#A14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> A <span class=\"dictionary\">charitable organization<\/span> shall be subject to the provisions of &#xA7;&#xA7; <a class=\"law\" title=\"Prohibited acts\" href=\"\/57-57\/\">57-57<\/a> and <a class=\"law\" title=\"Enforcement of chapter; seizure of property connected with terrorism; penalties\" href=\"\/57-59\/\">57-59<\/a>, but shall otherwise be exempt from the provisions of this chapter for any year in which it confines its <span class=\"dictionary\">solicitations<\/span> in the Commonwealth to five or fewer contiguous cities and counties, and in which it has registered under the charitable <span class=\"dictionary\">solicitations<\/span> <span class=\"dictionary\">ordinance<\/span>, if any, of each such city and county. No organization shall be exempt under this subsection if, during its next preceding fiscal year, more than 10 percent of its gross receipts were paid to any <span class=\"dictionary\">person<\/span> or combination of <span class=\"dictionary\">persons<\/span>, located outside the boundaries of such cities and counties, other than for the purchase of real property, or tangible personal property or personal services to be used within such localities. An organization that is otherwise qualified for exemption under this subsection that <span class=\"dictionary\">solicits<\/span> by means of a local publication, or radio or television station, shall not be disqualified solely because the circulation or range of such medium extends beyond the boundaries of such cities or counties. <a id=\"paragraph-212277\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> No charitable or <span class=\"dictionary\">civic organization<\/span> shall be exempt under this section unless it submits to the <span class=\"dictionary\">Commissioner<\/span>, who in his discretion may extend such filing deadline prospectively or retrospectively for good cause shown, on forms to be prescribed by him, the name, address and purpose of the organization and a statement setting forth the reason for the claim for exemption. <span class=\"dictionary\">Parent organizations<\/span> may file consolidated applications for exemptions for any chapters, branches, or affiliates that they believe to be exempt from the registration provisions of this chapter. If the organization is exempted, the <span class=\"dictionary\">Commissioner<\/span> shall <span class=\"dictionary\">issue<\/span> a letter of exemption, which may be exhibited to the public. A registration fee of $10 shall be required of every organization requesting an exemption after June 30, 1984. The letter of exemption shall remain in effect as long as the organization continues to <span class=\"dictionary\">solicit<\/span> in accordance with its claim for exemption. <a id=\"paragraph-212278\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Nothing in this chapter shall be construed as being applicable to the American Red Cross or any of its local chapters. <a id=\"paragraph-212279\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/57-60\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nEXEMPTIONS (\u00a7 57-60)\n\nA. Nevertheless, if the contributions raised from the public, whether all\n   of such are or are not received by any charitable organization during any\n   calendar year, shall be in excess of $5,000, it shall, within 30 days after\n   the date it has received total contributions in excess of $5,000, register\n   with and report to the Commissioner as required by this chapter.\n\n   4. Organizations that solicit only within the membership of the organization\n   by the members thereof.\n\n   5. Agencies designated by the Virginia Department for Aging and\n   Rehabilitative Services pursuant to subdivision A 6 of &#xA7; 51.5-135 as area\n   agencies on aging.\n\n   11. Labor unions, labor associations and labor organizations that have been\n   granted tax-exempt status under &#xA7; 501(c)(5) of the Internal Revenue Code.\n\n   12. Trade associations that have been granted tax-exempt status under &#xA7;\n   501(c)(6) of the Internal Revenue Code.\n\n   13. Organizations that have been granted tax-exempt status under &#xA7;\n   501(c)(3) of the Internal Revenue Code and that are organized wholly as\n   regional emergency medical services councils in accordance with &#xA7;\n   32.1-111.4:2.\n\n   14. Nonprofit organizations that have been granted tax-exempt status under\n   &#xA7; 501(c)(3) of the Internal Revenue Code and that solicit contributions\n   only through (i) grant proposals submitted to for-profit corporations, (ii)\n   grant proposals submitted to other nonprofit organizations that have been\n   granted tax-exempt status under &#xA7; 501(c)(3) of the Internal Revenue Code,\n   or (iii) grant proposals submitted to organizations determined to be private\n   foundations under &#xA7; 509(a) of the Internal Revenue Code.\n\nB.
