A.<\/span> A permit holder<\/span> may use any data source for determining the result of a tier 1 bet. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

B.<\/span> A sports governing body<\/span> may notify the Department<\/span> that it desires permit holders<\/span> to use official league data<\/span> to settle tier 2 bets. A notification under this subsection shall be made according to forms and procedures prescribed by the Director<\/span>. The Director<\/span> shall notify each permit holder<\/span> of the sports governing body<\/span>’s notification within five days after the Department<\/span>’s receipt of the notification. If a sports governing body<\/span> does not notify the Department<\/span> of its desire to supply official league data<\/span>, a permit holder<\/span> may use any data source for determining the result of a tier 2 bet on a professional sports<\/span> event of the league governed by the sports governing body<\/span>. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> A permit holder<\/span> demonstrates to the Department<\/span> that the sports governing body<\/span> has not provided or offered to provide a feed of official league data<\/span> to such permit holder<\/span> on commercially reasonable terms, according to criteria identified in subsection D. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

D.<\/span> The Director<\/span> shall consider the following information in determining whether a sports governing body<\/span> has provided or offered to provide a feed of official league data<\/span> on commercially reasonable terms: <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> The availability of a sports governing body<\/span>’s official league data<\/span> for tier 2 bets from more than one authorized source; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t
