I, cc. 7, 351, 352; 2022, cc. 589, 590.","full_text":"As used in this chapter, unless the context requires a different meaning:\n\t\t&#8220;Adjusted gross receipts&#8221; means the gross receipts from casino gaming less winnings paid to winners.\n\t\t&#8220;Board&#8221; means the Virginia Lottery Board established in the Virginia Lottery Law (\u00a7 58.1-4000 et seq.).\n\t\t&#8220;Casino gaming&#8221; or &#8220;game&#8221; means baccarat, blackjack, twenty-one, poker, craps, dice, slot machines, roulette wheels, Klondike tables, Mah Jongg, electronic table games, hybrid table games, punchboards, faro layouts, numbers tickets, push cards, jar tickets, or pull tabs, or any variation of the aforementioned games, and any other activity that is authorized by the Board as a wagering game or device under this chapter. &#8220;Casino gaming&#8221; or &#8220;game&#8221; includes on-premises mobile casino gaming.\n\t\t&#8220;Casino gaming establishment&#8221; means the premises, including the entire property located at the address of the licensed casino, upon which lawful casino gaming is authorized and licensed as provided in this chapter. &#8220;Casino gaming establishment&#8221; does not include a riverboat or similar vessel.\n\t\t&#8220;Casino gaming operator&#8221; means any person issued a license by the Board to operate a casino gaming establishment.\n\t\t&#8220;Cheat&#8221; means to alter the selection criteria that determine the result of a game or the amount or frequency of payment in a game for the purpose of obtaining an advantage for one or more participants in a game over other participants in a game.\n\t\t&#8220;Counter check&#8221; means an interest-free negotiable instrument for a specified amount executed by a player and held by the casino that serves as evidence of the casino gaming patron&#8217;s obligation to pay the casino and that can be exchanged by the casino gaming patron for the specified amount in chips, tokens, credits, electronic credits, electronic cash, or electronic cards.\n\t\t&#8220;Department&#8221; means the independent agency responsible for the administration of the Virginia Lottery created in the Virginia Lottery Law (\u00a7 58.1-4000 et seq.).\n\t\t&#8220;Director&#8221; means the Director of the Virginia Lottery.\n\t\t&#8220;Eligible host city&#8221; means any city described in \u00a7 58.1-4107 in which a casino gaming establishment is authorized to be located.\n\t\t&#8220;Entity&#8221; means a person that is not a natural person.\n\t\t&#8220;Gaming operation&#8221; means the conduct of authorized casino gaming within a casino gaming establishment.\n\t\t&#8220;Gross receipts&#8221; means the total amount of money exchanged for the purchase of chips, tokens, electronic credits, electronic cash, or electronic cards by casino gaming patrons. &#8220;Gross receipts&#8221; shall not include the cash value of promotions or credits provided to and exchanged by casino gaming patrons for chips, tokens, electronic credits, electronic cash, or electronic cards. &#8220;Gross receipts&#8221; shall also not include uncollectable counter checks.\n\t\t&#8220;Immediate family&#8221; means (i) a spouse and (ii) any other person residing in the same household as an officer or employee and who is a dependent of the officer or employee or of whom the officer or employee is a dependent.\n\t\t&#8220;Individual&#8221; means a natural person.\n\t\t&#8220;Licensee&#8221; or &#8220;license holder&#8221; means any person holding an operator&#8217;s license under \u00a7 58.1-4111.\n\t\t&#8220;On-premises mobile casino gaming&#8221; means casino gaming offered by a casino gaming operator at a casino gaming establishment using a computer network of both federal and nonfederal interoperable packet-switched data networks through which the casino gaming operator may offer casino gaming to individuals who have established an on-premises mobile casino gaming account with the casino gaming operator and who are physically present on the premises of the casino gaming establishment, as authorized by regulations promulgated by the Board.\n\t\t&#8220;Permit holder&#8221; means any person holding a supplier or service permit pursuant to this chapter.\n\t\t&#8220;Person&#8221; means an individual, partnership, joint venture, association, limited liability company, stock corporation, or nonstock corporation and includes any person that directly or indirectly controls or is under common control with another person.\n\t\t&#8220;Preferred casino gaming operator&#8221; means the proposed casino gaming establishment and operator thereof submitted by an eligible host city to the Board as an applicant for licensure.\n\t\t&#8220;Prepaid access instrument&#8221; means a system device that allows a casino gaming patron access to funds that have been paid in advance and can be retrieved or transferred at some point in the future through such a device. In order to transfer funds for gaming purposes, a prepaid access instrument shall be redeemed for tokens, chips, credits, electronic credits, electronic cash, electronic cards, or used in conjunction with an approved cashless wagering system or interactive gaming account.\n\t\t&#8220;Principal&#8221; means any individual who solely or together with his immediate family members (i) owns or controls, directly or indirectly, five percent or more of the pecuniary interest in any entity that is a licensee or (ii) has the power to vote or cause the vote of five percent or more of the voting securities or other ownership interests of such entity, and any person who manages a gaming operation on behalf of a licensee.\n\t\t&#8220;Professional sports&#8221; means the same as such term is defined in \u00a7 58.1-4030.\n\t\t&#8220;Security&#8221; has the same meaning as provided in \u00a7 13.1-501. If the Board finds that any obligation, stock, or other equity interest creates control of or voice in the management operations of an entity in the manner of a security, then such interest shall be considered a security.\n\t\t&#8220;Sports betting&#8221; means the same as such term is defined in \u00a7 58.1-4030.\n\t\t&#8220;Sports betting facility&#8221; means an area, kiosk, or device located inside a casino gaming establishment licensed pursuant to this chapter that is designated for sports betting.\n\t\t&#8220;Supplier&#8221; means any person that sells or leases, or contracts to sell or lease, any casino gaming equipment, devices, or supplies, or provides any management services, to a licensee.\n\t\t&#8220;Voluntary exclusion program&#8221; means a program established by the Board pursuant to \u00a7 58.1-4103 that allows individuals to voluntarily exclude themselves from engaging in the activities described in subdivision B 1 of \u00a7 58.1-4103 by placing their names on a voluntary exclusion list and following the procedures set forth by the Board.\n\t\t&#8220;Youth sports&#8221; means the <span class=\"dictionary\">Director<\/span> of the Virginia Lottery.\n\t\t&#8220;<span class=\"dictionary\">Eligible host city<\/span>&#8221; means any city described in \u00a7&nbsp;<a class=\"law\" title=\"Eligible host city; certification of preferred casino gaming operator\" href=\"\/58.1-4107\/\">58.1-4107<\/a> in which a <span class=\"dictionary\">casino gaming establishment<\/span> is authorized to be located.\n\t\t&#8220;<span class=\"dictionary\">Entity<\/span>&#8221; means a <span class=\"dictionary\">person<\/span> that is not a natural <span class=\"dictionary\">person<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Gaming operation<\/span>&#8221; means the conduct of authorized casino gaming within a <span class=\"dictionary\">casino gaming establishment<\/span>.\n\t\t&#8220;Gross receipts&#8221; means the total amount of money exchanged for the purchase of chips, tokens, electronic credits, electronic cash, or electronic cards by casino gaming patrons. &#8220;Gross receipts&#8221; shall not include the cash value of promotions or credits provided to and exchanged by casino gaming patrons for chips, tokens, electronic credits, electronic cash, or electronic cards. &#8220;Gross receipts&#8221; shall also not include uncollectable <span class=\"dictionary\">counter checks<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Immediate family<\/span>&#8221; means (i) a spouse and (ii) any other <span class=\"dictionary\">person<\/span> residing in the same household as an officer or employee and who is a dependent of the officer or employee or of whom the officer or employee is a dependent.\n\t\t&#8220;<span class=\"dictionary\">Individual<\/span>&#8221; means a natural <span class=\"dictionary\">person<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Licensee<\/span>&#8221; or &#8220;<span class=\"dictionary\">license holder<\/span>&#8221; means any <span class=\"dictionary\">person<\/span> holding an operator&#8217;s license under \u00a7&nbsp;<a class=\"law\" title=\"Duration and form of operator&#039;s license; bond\" href=\"\/58.1-4111\/\">58.1-4111<\/a>.\n\t\t&#8220;<span class=\"dictionary\">On-premises mobile casino gaming<\/span>&#8221; means casino gaming offered by a <span class=\"dictionary\">casino gaming operator<\/span> at a <span class=\"dictionary\">casino gaming establishment<\/span> using a computer network of both federal and nonfederal interoperable packet-switched data networks through which the <span class=\"dictionary\">casino gaming operator<\/span> may offer casino gaming to <span class=\"dictionary\">individuals<\/span> who have established an <span class=\"dictionary\">on-premises mobile casino gaming<\/span> account with the <span class=\"dictionary\">casino gaming operator<\/span> and who are physically present on the premises of the <span class=\"dictionary\">casino gaming establishment<\/span>, as authorized by regulations promulgated by the <span class=\"dictionary\">Board<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Permit holder<\/span>&#8221; means any <span class=\"dictionary\">person<\/span> holding a <span class=\"dictionary\">supplier<\/span> or service permit pursuant to this chapter.\n\t\t&#8220;<span class=\"dictionary\">Person<\/span>&#8221; means an <span class=\"dictionary\">individual<\/span>, partnership, joint venture, association, limited liability company, stock corporation, or nonstock corporation and includes any <span class=\"dictionary\">person<\/span> that directly or indirectly controls or is under common control with another <span class=\"dictionary\">person<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Preferred <span class=\"dictionary\">casino gaming operator<\/span><\/span>&#8221; means the proposed <span class=\"dictionary\">casino gaming establishment<\/span> and operator thereof submitted by an <span class=\"dictionary\">eligible host city<\/span> to the <span class=\"dictionary\">Board<\/span> as an applicant for licensure.\n\t\t&#8220;<span class=\"dictionary\">Prepaid access instrument<\/span>&#8221; means a system device that allows a casino gaming patron access to funds that have been paid in advance and can be retrieved or transferred at some point in the future through such a device. In <span class=\"dictionary\">order<\/span> to transfer funds for gaming purposes, a <span class=\"dictionary\">prepaid access instrument<\/span> shall be redeemed for tokens, chips, credits, electronic credits, electronic cash, electronic cards, or used in conjunction with an approved cashless wagering system or interactive gaming account.\n\t\t&#8220;<span class=\"dictionary\">Principal<\/span>&#8221; means any <span class=\"dictionary\">individual<\/span> who solely or together with his <span class=\"dictionary\">immediate family<\/span> members (i) owns or controls, directly or indirectly, five percent or more of the pecuniary interest in any <span class=\"dictionary\">entity<\/span> that is a <span class=\"dictionary\">licensee<\/span> or (ii) has the power to vote or cause the vote of five percent or more of the voting securities or other ownership interests of such <span class=\"dictionary\">entity<\/span>, and any <span class=\"dictionary\">person<\/span> who manages a <span class=\"dictionary\">gaming operation<\/span> on behalf of a <span class=\"dictionary\">licensee<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Professional sports<\/span>&#8221; means the same as such term is defined in \u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/58.1-4030\/\">58.1-4030<\/a>.\n\t\t&#8220;<span class=\"dictionary\">Security<\/span>&#8221; has the same meaning as provided in \u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/13.1-501\/\">13.1-501<\/a>. If the <span class=\"dictionary\">Board<\/span> finds that any obligation, stock, or other <span class=\"dictionary\">equity<\/span> interest creates control of or voice in the management operations of an <span class=\"dictionary\">entity<\/span> in the manner of a <span class=\"dictionary\">security<\/span>, then such interest shall be considered a <span class=\"dictionary\">security<\/span>.\n\t\t&#8220;Sports betting&#8221; means the same as such term is defined in \u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/58.1-4030\/\">58.1-4030<\/a>.\n\t\t&#8220;<span class=\"dictionary\">Sports betting facility<\/span>&#8221; means an area, kiosk, or device located inside a <span class=\"dictionary\">casino gaming establishment<\/span> licensed pursuant to this chapter that is designated for sports betting.\n\t\t&#8220;<span class=\"dictionary\">Supplier<\/span>&#8221; means any <span class=\"dictionary\">person<\/span> that sells or leases, or <span class=\"dictionary\">contracts<\/span> to sell or lease, any casino gaming equipment, devices, or supplies, or provides any management services, to a <span class=\"dictionary\">licensee<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Voluntary exclusion program<\/span>&#8221; means a program established by the <span class=\"dictionary\">Board<\/span> pursuant to \u00a7&nbsp;<a class=\"law\" title=\"Voluntary exclusion program\" href=\"\/58.1-4103\/\">58.1-4103<\/a> that allows <span class=\"dictionary\">individuals<\/span> to voluntarily exclude themselves from engaging in the activities described in subdivision B 1 of \u00a7&nbsp;<a class=\"law\" title=\"Voluntary exclusion program\" href=\"\/58.1-4103\/\">58.1-4103<\/a> by placing their names on a voluntary exclusion list and following the procedures set forth by the <span class=\"dictionary\">Board<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Youth sports<\/span>&#8221; means the same as such term is defined in \u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/58.1-4030\/\">58.1-4030<\/a>.<\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS (\u00a7 58.1-4100)\n\nAs used in this chapter, unless the context requires a different meaning:\n\t\t&#8220;Adjusted gross receipts&#8221; means the gross receipts from casino\ngaming less winnings paid to winners.\n\t\t&#8220;Board&#8221; means the Virginia Lottery Board established in the\nVirginia Lottery Law (\u00a7 58.1-4000 et seq.).\n\t\t&#8220;Casino gaming&#8221; or &#8220;game&#8221; means baccarat, blackjack,\ntwenty-one, poker, craps, dice, slot machines, roulette wheels, Klondike tables,\nMah Jongg, electronic table games, hybrid table games, punchboards, faro\nlayouts, numbers tickets, push cards, jar tickets, or pull tabs, or any\nvariation of the aforementioned games, and any other activity that is authorized\nby the Board as a wagering game or device under this chapter. &#8220;Casino\ngaming&#8221; or &#8220;game&#8221; includes on-premises mobile casino gaming.\n\t\t&#8220;Casino gaming establishment&#8221; means the premises, including the\nentire property located at the address of the licensed casino, upon which lawful\ncasino gaming is authorized and licensed as provided in this chapter.\n&#8220;Casino gaming establishment&#8221; does not include a riverboat or\nsimilar vessel.\n\t\t&#8220;Casino gaming operator&#8221; means any person issued a license by the\nBoard to operate a casino gaming establishment.\n\t\t&#8220;Cheat&#8221; means to alter the selection criteria that determine the\nresult of a game or the amount or frequency of payment in a game for the purpose\nof obtaining an advantage for one or more participants in a game over other\nparticipants in a game.\n\t\t&#8220;Counter check&#8221; means an interest-free negotiable instrument for a\nspecified amount executed by a player and held by the casino that serves as\nevidence of the casino gaming patron&#8217;s obligation to pay the casino and\nthat can be exchanged by the casino gaming patron for the specified amount in\nchips, tokens, credits, electronic credits, electronic cash, or electronic\ncards.\n\t\t&#8220;Department&#8221; means the independent agency responsible for the\nadministration of the Virginia Lottery created in the Virginia Lottery Law (\u00a7\n58.1-4000 et seq.).\n\t\t&#8220;Director&#8221; means the Director of the Virginia Lottery.\n\t\t&#8220;Eligible host city&#8221; means any city described in \u00a7 58.1-4107 in\nwhich a casino gaming establishment is authorized to be located.\n\t\t&#8220;Entity&#8221; means a person that is not a natural person.\n\t\t&#8220;Gaming operation&#8221;
