I, cc. 55, 56.","full_text":"A\n\nAs used in this section:\n\t\t\t&#8220;Business&#8221; means a person doing business in Virginia, including a self-employed individual.\n\t\t\t&#8220;COVID-19 Emergency Temporary Standard&#8221; means the Emergency Temporary Standard, Infectious Disease Prevention: SARS-CoV-2 Virus That Causes COVID-19, promulgated by the Department of Labor and Industry and in effect at 16VAC25-220, or any permanent regulation intended to succeed such regulation.\n\t\t\t&#8220;COVID-19 safety protocol&#8221; means safety protocols that comply with the COVID-19 Emergency Temporary Standard and that meet the following criteria:1\n\nReasonably prevent the spread of COVID-19;2\n\nComply with all applicable federal, state, and local laws;3\n\nAre consistent with best practices for infection prevention and workplace hygiene;4\n\nPromote remote work to the fullest extent possible, including increasing the number of telework-eligible employees; and5\n\nImplement enhanced cleaning, screening, testing, and contact tracing procedures and any additional infection-control measures that are reasonable in light of the work performed at the worksite and the rate of infection in the surrounding community.\n\t\t\t\t&#8220;Other than business use&#8221; means, with respect to a purchased item or service, that (i) the business uses the purchased item or service more than 50 percent of the time for nonbusiness purposes or (ii) the business transfers a purchased item to a person other than the business or transfers the use of a purchased service to a person other than the business.\n\t\t\t\t&#8220;Personal protective equipment&#8221; means only the following:1\n\nDisinfecting products approved for use against SARS-CoV-2 and COVID-19;2\n\nCoveralls, full body suits, gowns, and vests;3\n\nEngineering controls such as substitution, isolation, ventilation, and equipment modification to reduce exposure to SARS-CoV-2 and COVID-19 disease-related workplace hazards and job tasks; engineering controls also include UVC sanitation equipment, indoor air quality equipment such as ionization, HEPA filtration, and physical barriers;4\n\nFace coverings, face shields, and filtering facepiece respirators;5\n\nGloves;6\n\nHand sanitizer;7\n\nHand-washing facilities;8\n\nHVAC, testing, and physical modifications to comply with the American National Standards Institute (ANSI)\/American Society of Heating, Refrigerating and Air-Conditioning Engineers (ASHRAE) Standards 62.1 and 62.2 (ASHRAE 2019a, 2019b);9\n\nMedical and nonmedical masks;10\n\nPhysical barriers and electronic sensors or systems designed to maintain or monitor physical distancing of employees from other employees, other persons, and the general public, including acrylic sneeze guards, permanent or temporary walls, electronic employee monitors, and proximity sensors in employee badges;11\n\nRespiratory protection equipment;12\n\nSafety glasses;13\n\nSigns related to COVID-19;14\n\nTemperature-checking devices and monitors; and15\n\nTesting and related equipment related to COVID-19.\n\t\t\t\t&#8220;Qualifying business&#8221; means a business that has in place a COVID-19 safety protocol.B\n\nThe tax imposed by this chapter, or pursuant to any authority granted thereunder, shall not apply to personal protective equipment purchased by a qualifying business or to training related to COVID-19 purchased by a qualifying business. To use the exemption, a qualifying business shall, pursuant to the provisions of &#xA7; 58.1-623, verify to the seller that the sale is tax exempt. No exemption shall be allowed under this section for a purchase by a qualifying business for other than business use.C\n\n1. If the Department receives information that a business has made a tax-exempt purchase under this section and used the purchase for other than business use, the Department shall notify the business. The business shall remit the tax due on the purchase to the Department, plus a penalty of 10 percent of the tax due, plus interest at the rate prescribed by \u00a7 58.1-15 accruing from the date of purchase.2\n\nIf the Department receives information that a business is not following its COVID-19 safety protocol, the Department shall notify the business that its qualification for the exemption provided by this section is revoked. <a id=\"paragraph-291695\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Comply with all applicable federal, state, and local <span class=\"dictionary\">laws<\/span>; <a id=\"paragraph-291696\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Are consistent with best practices for infection prevention and workplace hygiene; <a id=\"paragraph-291697\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Promote remote work to the fullest extent possible, including increasing the number of telework-eligible employees; and <a id=\"paragraph-291698\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Implement enhanced cleaning, screening, testing, and contact tracing procedures and any additional infection-control measures that are reasonable in light of the work performed at the worksite and the rate of infection in the surrounding community.\n\t\t\t\t&#8220;Other than <span class=\"dictionary\">business<\/span> <span class=\"dictionary\">use<\/span>&#8221; means, with respect to a purchased item or service, that (i) the <span class=\"dictionary\">business<\/span> <span class=\"dictionary\">uses<\/span> the purchased item or service more than 50 percent of the time for nonbusiness purposes or (ii) the <span class=\"dictionary\">business<\/span> transfers a purchased item to a <span class=\"dictionary\">person<\/span> other than the <span class=\"dictionary\">business<\/span> or transfers the <span class=\"dictionary\">use<\/span> of a purchased service to a <span class=\"dictionary\">person<\/span> other than the <span class=\"dictionary\">business<\/span>.\n\t\t\t\t&#8220;<span class=\"dictionary\">Personal protective equipment<\/span>&#8221; <a id=\"paragraph-291700\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Coveralls, full body suits, gowns, and vests; <a id=\"paragraph-291701\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Engineering controls such as substitution, isolation, ventilation, and equipment modification to reduce exposure to SARS-CoV-2 and COVID-19 disease-related workplace hazards and job tasks; engineering controls also include UVC sanitation equipment, indoor air quality equipment such as ionization, HEPA filtration, and physical barriers; <a id=\"paragraph-291702\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Face coverings, face shields, and filtering facepiece respirators; <a id=\"paragraph-291703\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Gloves; <a id=\"paragraph-291710\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> Safety glasses; <a id=\"paragraph-291711\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> Signs related to COVID-19; <a id=\"paragraph-291712\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> Temperature-checking devices and monitors; and <a id=\"paragraph-291713\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A15\" class=\"indent-1\"><p><span class=\"prefix-number\">15.<\/span> Testing and related equipment related to COVID-19.\n\t\t\t\t&#8220;<span class=\"dictionary\">Qualifying business<\/span>&#8221; means a business that has in place a COVID-19 safety protocol. <a id=\"paragraph-291714\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#A15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The tax imposed by this chapter, or pursuant to any authority granted thereunder, shall not apply to <span class=\"dictionary\">personal protective equipment<\/span> purchased by a <span class=\"dictionary\">qualifying business<\/span> or to training related to COVID-19 purchased by a <span class=\"dictionary\">qualifying business<\/span>. To <span class=\"dictionary\">use<\/span> the exemption, a <span class=\"dictionary\">qualifying business<\/span> shall, pursuant to the provisions of &#xA7; <a class=\"law\" title=\"Sales or leases presumed subject to tax; exemption certificates\" href=\"\/58.1-623\/\">58.1-623<\/a>, verify to the seller that the <span class=\"dictionary\">sale<\/span> is tax exempt. No exemption shall be allowed under this section for a purchase by a <span class=\"dictionary\">qualifying business<\/span> for other than business <span class=\"dictionary\">use<\/span>. <a id=\"paragraph-291715\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> 1. If the <span class=\"dictionary\">Department<\/span> receives information that a business has made a tax-exempt purchase under this section and used the purchase for other than business <span class=\"dictionary\">use<\/span>, the <span class=\"dictionary\">Department<\/span> shall notify the business. The business shall remit the tax due on the purchase to the <span class=\"dictionary\">Department<\/span>, plus a <span class=\"dictionary\">penalty<\/span> of 10 percent of the tax due, plus interest at the rate prescribed by \u00a7&nbsp;<a class=\"law\" title=\"Rate of interest\" href=\"\/58.1-15\/\">58.1-15<\/a> accruing from the date of purchase. <a id=\"paragraph-291716\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> If the <span class=\"dictionary\">Department<\/span> receives information that a business is not following its COVID-19 safety protocol, the <span class=\"dictionary\">Department<\/span> shall notify the business that its qualification for the exemption provided by this section is revoked. Effective as of the date that the <span class=\"dictionary\">Department<\/span> sends the notification, such business shall not claim any exemption under this section. <a id=\"paragraph-291717\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The <span class=\"dictionary\">Department<\/span> shall <span class=\"dictionary\">issue<\/span> guidelines clarifying what equipment and training are tax exempt under this section. <a id=\"paragraph-291718\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/58.1-609.14\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\n(FOR CONTINGENT EXPIRATION DATE, SEE EDITOR&#8217;S NOTES) PERSONAL PROTECTIVE\nEQUIPMENT EXEMPTION (\u00a7 58.1-609.14)\n\nA. As used in this section:\n\t\t\t&#8220;Business&#8221; means a person doing business in Virginia, including a\nself-employed individual.\n\t\t\t&#8220;COVID-19 Emergency Temporary Standard&#8221; means the Emergency\nTemporary Standard, Infectious Disease Prevention: SARS-CoV-2 Virus That Causes\nCOVID-19, promulgated by the Department of Labor and Industry and in effect at\n16VAC25-220, or any permanent regulation intended to succeed such regulation.\n\t\t\t&#8220;COVID-19 safety protocol&#8221; means safety protocols that comply\nwith the COVID-19 Emergency Temporary Standard and that meet the following\ncriteria:\n\n   1. Reasonably prevent the spread of COVID-19;\n\n   2. Comply with all applicable federal, state, and local laws;\n\n   3. Are consistent with best practices for infection prevention and workplace\n   hygiene;\n\n   4. Promote remote work to the fullest extent possible, including increasing\n   the number of telework-eligible employees; and\n\n   5. Implement enhanced cleaning, screening, testing, and contact tracing\n   procedures and any additional infection-control measures that are reasonable\n   in light of the work performed at the worksite and the rate of infection in\n   the surrounding community.\n   \t\t\t\t&#8220;Other than business use&#8221; means, with respect to a purchased\n   item or service, that (i) the business uses the purchased item or service more\n   than 50 percent of the time for nonbusiness purposes or (ii) the business\n   transfers a purchased item to a person other than the business or transfers\n   the use of a purchased service to a person other than the business.\n   \t\t\t\t&#8220;Personal protective equipment&#8221; means only the following:\n\n   1. Disinfecting products approved for use against SARS-CoV-2 and COVID-19;\n\n   2. Coveralls, full body suits, gowns, and vests;\n\n   3. Engineering controls such as substitution, isolation, ventilation, and\n   equipment modification to reduce exposure to SARS-CoV-2 and COVID-19\n   disease-related workplace hazards and job tasks; engineering controls also\n   include UVC sanitation equipment, indoor air quality equipment such as\n   ionization, HEPA filtration, and physical barriers;\n\n   4. Face coverings, face shields, and filtering facepiece respirators;\n\n   5. Gloves;\n\n   6. Hand sanitizer;\n\n   7. Hand-washing facilities;\n\n   8. HVAC, testing, and physical modifications to comply with the American\n   National Standards Institute (ANSI)\/American Society of Heating, Refrigerating\n   and Air-Conditioning Engineers (ASHRAE) Standards 62.1 and 62.2 (ASHRAE 2019a,\n   2019b);\n\n   9. Medical and nonmedical masks;\n\n   10. Physical barriers and electronic sensors or systems designed to maintain\n   or monitor physical distancing of employees from other employees, other\n   persons, and the general public, including acrylic sneeze guards, permanent or\n   temporary walls, electronic employee monitors, and proximity sensors in\n   employee badges;\n\n   11. Respiratory protection equipment;\n\n   12. Safety glasses;\n\n   13. Signs related to COVID-19;\n\n   14. Temperature-checking devices and monitors; and\n\n   15. Testing and related equipment related to COVID-19.\n   \t\t\t\t&#8220;Qualifying business&#8221; means a business that has in place a\n   COVID-19 safety protocol.\n\nB. The tax imposed by this chapter, or pursuant to any authority granted\nthereunder, shall not apply to personal protective equipment purchased by a\nqualifying business or to training related to COVID-19 purchased by a qualifying\nbusiness.
