A.<\/span> Every direct-to-consumer<\/span> genetic testing company<\/span> that enters into a contract<\/span> with a service provider<\/span> shall prohibit the service provider<\/span> from retaining, using, or disclosing the biological sample<\/span>, extracted genetic material<\/span>, genetic data<\/span>, or any information regarding the identity of the consumer<\/span>, including whether the consumer<\/span> has solicited or received genetic testing, as applicable, for any purpose other than for the specific purpose of performing the services specified in the contract<\/span> with the service provider<\/span> for the business. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

B.<\/span> Every contract<\/span> between a direct-to-consumer<\/span> genetic testing company<\/span> and a service provider<\/span> shall include: <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> A provision prohibiting the service provider<\/span> from retaining, using, or disclosing the biological sample<\/span>, extracted genetic material<\/span>, genetic data<\/span>, or any information regarding the identity of the consumer<\/span>, including whether the consumer<\/span> has solicited or received genetic testing, as applicable, for a commercial purpose other than providing the services specified in the contract<\/span> with the service provider<\/span> with the business; and <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t
