Licenses shall not be transferable or assignable, by operation of law or otherwise. No licensee shall use any name other than the name set forth on the license issued by the Commission.B\n\nNo licensee shall open an additional office without prior approval of the Commission. Applications for such approval shall be made in writing on a form provided by the Commissioner and shall be accompanied by payment of a $150 nonrefundable application fee. The expiration, surrender, <span class=\"dictionary\">revocation<\/span>, or suspension of a license shall not affect any preexisting legal right or obligation of such lender or broker. <a id=\"paragraph-291105\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Notwithstanding any other provision of this chapter, a <span class=\"dictionary\">mortgage lender<\/span> or <span class=\"dictionary\">mortgage broker<\/span> license shall expire at the end of each calendar year unless it is renewed by a <span class=\"dictionary\">licensee<\/span> prior to the expiration date. A <span class=\"dictionary\">licensee<\/span> may renew its license by (i) requesting renewal through the <span class=\"dictionary\">Registry<\/span> and (ii) complying with any requirements associated with such renewal request that are imposed by the <span class=\"dictionary\">Registry<\/span>. If a <span class=\"dictionary\">mortgage lender<\/span> or <span class=\"dictionary\">mortgage broker<\/span> license has expired, the <span class=\"dictionary\">Commission<\/span> may by regulation permit the former <span class=\"dictionary\">licensee<\/span> to seek license reinstatement after the license expiration date by renewing its license in accordance with this subsection and paying a reinstatement fee as prescribed by the <span class=\"dictionary\">Commission<\/span>. <a id=\"paragraph-291106\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> <span class=\"dictionary\">Licensees<\/span> may allow employees or exclusive agents to work from a <span class=\"dictionary\">remote location<\/span> if: <a id=\"paragraph-291107\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The <span class=\"dictionary\">licensee<\/span> has written policies and procedures for the supervision of employees or exclusive agents working from a <span class=\"dictionary\">remote location<\/span>. Such written policies and procedures shall include all the requirements of this subsection; <a id=\"paragraph-291108\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Access to the <span class=\"dictionary\">licensee<\/span>&#8217;s platforms and customer information is in accordance with the <span class=\"dictionary\">licensee<\/span>&#8217;s comprehensive written information security plan; <a id=\"paragraph-291109\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The <span class=\"dictionary\">licensee<\/span> employs appropriate risk-based monitoring and oversight processes, and any employee or exclusive agent who will work from a <span class=\"dictionary\">remote location<\/span> agrees to comply with the <span class=\"dictionary\">licensee<\/span>&#8217;s established practices; <a id=\"paragraph-291110\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> No in-<span class=\"dictionary\">person<\/span> customer interaction occurs at an employee&#8217;s or exclusive agent&#8217;s residence, unless such residence is an approved <span class=\"dictionary\">office<\/span>; <a id=\"paragraph-291111\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Physical records are not maintained at a <span class=\"dictionary\">remote location<\/span>; <a id=\"paragraph-291112\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Customer interactions and conversations about consumers comply with federal and state information security requirements, including applicable provisions under the Gramm-Leach-Bliley Act and the Safeguards Rule established by the Federal Trade <span class=\"dictionary\">Commission<\/span>, set forth at 16 C.F.R. Part 314, as such requirements may be amended from time to time; <a id=\"paragraph-291113\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Employees or exclusive agents working at a <span class=\"dictionary\">remote location<\/span> access the <span class=\"dictionary\">licensee<\/span>&#8217;s secure systems directly from an out-of-<span class=\"dictionary\">office<\/span> device, including a laptop, phone, desktop computer, or tablet, via a virtual private network (VPN) or comparable system that ensures secure connectivity and requires a password or other forms of authentication to access; <a id=\"paragraph-291114\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> The <span class=\"dictionary\">licensee<\/span> ensures that appropriate security updates, patches, or other alterations to the security of all devices used at <span class=\"dictionary\">remote locations<\/span> are installed and maintained; <a id=\"paragraph-291115\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> The <span class=\"dictionary\">licensee<\/span> has the ability to remotely lock or erase company-related contents of any device or otherwise remotely limit access to a <span class=\"dictionary\">licensee<\/span>&#8217;s secure systems; and <a id=\"paragraph-291116\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> The <span class=\"dictionary\">Nationwide Mortgage Licensing System and Registry<\/span> record of a <span class=\"dictionary\">mortgage loan<\/span> originator working from a <span class=\"dictionary\">remote location<\/span> designates the <span class=\"dictionary\">principal<\/span> place of business as the <span class=\"dictionary\">mortgage loan<\/span> originator&#8217;s registered location, unless such <span class=\"dictionary\">mortgage loan<\/span> originator elects an <span class=\"dictionary\">office<\/span> as a registered location. <a id=\"paragraph-291117\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1607\/#F10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nLICENSES; PLACES OF BUSINESS; CHANGES (\u00a7 6.2-1607)\n\nA. Each license shall state the address of each office at which the business is\nto be conducted and shall state fully the name of the licensee. Each licensee\nshall (i) display proof of licensing upon request and (ii) prominently display\nat any office where the licensee conducts business in person with a borrower or\nprospective borrower the telephone number and website address for the Commission\nwhere borrowers and prospective borrowers may confirm the status of the license.\nLicenses shall not be transferable or assignable, by operation of law or\notherwise. No licensee shall use any name other than the name set forth on the\nlicense issued by the Commission.\n\nB. No licensee shall open an additional office without prior approval of the\nCommission. Applications for such approval shall be made in writing on a form\nprovided by the Commissioner and shall be accompanied by payment of a $150\nnonrefundable application fee. The application shall be approved unless the\nCommission finds that the applicant has not conducted business under this\nchapter efficiently, fairly, in the public interest, and in accordance with law.\nThe application shall be deemed approved if notice to the contrary has not been\nmailed by the Commission to the applicant within 30 days of the date the\napplication is received by the Commission.\n\nC. Every licensee shall within 10 days notify the Commissioner, in writing, of\nthe closing of any approved office and of the name, address and position of each\nnew senior officer, member, partner, or director and provide such other\ninformation with respect to any such change as the Commissioner may reasonably\nrequire.\n\nD. Every license shall remain in force until it expires or has been surrendered,\nrevoked, or suspended. The expiration, surrender, revocation, or suspension of a\nlicense shall not affect any preexisting legal right or obligation of such\nlender or broker.\n\nE. Notwithstanding any other provision of this chapter, a mortgage lender or\nmortgage broker license shall expire at the end of each calendar year unless it\nis renewed by a licensee prior to the expiration date. Physical records are not maintained at a remote location;\n\n   6. Customer interactions and conversations about consumers comply with federal\n   and state information security requirements, including applicable provisions\n   under the Gramm-Leach-Bliley Act and the Safeguards Rule established by the\n   Federal Trade Commission, set forth at 16 C.F.R.
