Except as otherwise provided in this subsection, an individual acting as an independent contractor may not engage in residential mortgage loan origination activities as a loan processor or underwriter unless such individual has first obtained and maintains annually a mortgage loan originator license;2\n\nAny individual who only performs administrative or clerical tasks on behalf of a mortgage loan originator;3\n\nAny individual who only performs real estate brokerage activities and is licensed or registered in accordance with applicable law, unless the individual is compensated directly or indirectly by the lender, a mortgage broker, or other mortgage loan originator or by any agent of such lender, mortgage broker, or other mortgage loan originator;4\n\nAny individual solely involved in extensions of credit relating to timeshare plans, as that term is defined in 11 U.S.C. &#xA7; 101 (53D);5\n\nA registered mortgage loan originator;6\n\nAny individual who offers or negotiates terms of a residential mortgage loan with or on behalf of an immediate family member of the individual;7\n\nAny individual who acts as a loan originator in providing financing for the sale of that individual&#8217;s own residence;8\n\nA licensed attorney, provided that the attorney&#8217;s mortgage loan origination activities are: (i) considered by the Supreme Court of Virginia to be part of the authorized practice of law within the Commonwealth, (ii) carried out within an attorney-client relationship, and (iii) accomplished by the attorney in compliance with all applicable laws, rules, ethics, and standards;9\n\nAny employee of federal, state, or local government, or a housing finance agency, who acts as a mortgage loan originator only pursuant to his official duties of employment. For the purposes of this subdivision, &#8220;<span class=\"dictionary\">local government<\/span>&#8221; means any county, city, or town or other local or regional political subdivision; and <a id=\"paragraph-248940\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1701\/#B9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Any <span class=\"dictionary\">employee<\/span> of a bona fide nonprofit organization, as determined by the <span class=\"dictionary\">Commission<\/span> in accordance with &#xA7; <a class=\"law\" title=\"Bona fide nonprofit organizations\" href=\"\/6.2-1701.1\/\">6.2-1701.1<\/a>, who <span class=\"dictionary\">acts<\/span> as a <span class=\"dictionary\">mortgage loan originator<\/span> only (i) pursuant to his official duties of employment and (ii) with respect to <span class=\"dictionary\">residential mortgage loans<\/span> with terms that are favorable to a borrower. <a id=\"paragraph-248941\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1701\/#B10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nLICENSE REQUIREMENT (\u00a7 6.2-1701)\n\nA. Except as otherwise provided in &#xA7; 6.2-1701.3, no individual shall engage\nin the business of a mortgage loan originator unless such individual has first\nobtained and maintains annually a license under this chapter.\n\nB. The following shall be exempt from licensing and other provisions of this\nchapter:\n\n   1. Any individual engaged solely as a loan processor or underwriter. Except as\n   otherwise provided in this subsection, an individual acting as an independent\n   contractor may not engage in residential mortgage loan origination activities\n   as a loan processor or underwriter unless such individual has first obtained\n   and maintains annually a mortgage loan originator license;\n\n   2. Any individual who only performs administrative or clerical tasks on behalf\n   of a mortgage loan originator;\n\n   3. Any individual who only performs real estate brokerage activities and is\n   licensed or registered in accordance with applicable law, unless the\n   individual is compensated directly or indirectly by the lender, a mortgage\n   broker, or other mortgage loan originator or by any agent of such lender,\n   mortgage broker, or other mortgage loan originator;\n\n   4. Any individual solely involved in extensions of credit relating to\n   timeshare plans, as that term is defined in 11 U.S.C. &#xA7; 101 (53D);\n\n   5. A registered mortgage loan originator;\n\n   6. Any individual who offers or negotiates terms of a residential mortgage\n   loan with or on behalf of an immediate family member of the individual;\n\n   7. Any individual who acts as a loan originator in providing financing for the\n   sale of that individual&#8217;s own residence;\n\n   8. A licensed attorney, provided that the attorney&#8217;s mortgage loan\n   origination activities are: (i) considered by the Supreme Court of Virginia to\n   be part of the authorized practice of law within the Commonwealth, (ii)\n   carried out within an attorney-client relationship, and (iii) accomplished by\n   the attorney in compliance with all applicable laws, rules, ethics, and\n   standards;\n\n   9. Any employee of federal, state, or local government, or a housing finance\n   agency, who acts as a mortgage loan originator only pursuant to his official\n   duties of employment. For the purposes of this subdivision, &#8220;local\n   government&#8221; means any county, city, or town or other local or regional\n   political subdivision; and\n\n   10.
