The notice shall be sent by certified mail to the principal place of business of such person or other address authorized under &#xA7; 12.1-19.1 and shall state the grounds for the contemplated action. Within 14 days of mailing the notice, the person or persons named therein may file with the clerk of the Commission a written request for a hearing. The Commission may enforce compliance with any such order issued under this section by imposition and collection of such fines and penalties as may be prescribed by law.B\n\nThe Commission may, pursuant to the procedures set forth in subsection A, order a licensee to cease and desist from allowing an authorized delegate to engage in money transmission on the licensee&#8217;s behalf upon any of the following grounds:1\n\nThe authorized delegate violated this chapter or a regulation adopted or an order issued under this chapter or violated any other law or regulation applicable to the conduct of the licensee&#8217;s business;2\n\nThe authorized delegate did not cooperate with an examination or investigation by the Commission;3\n\nThe authorized delegate engaged in fraud, misrepresentation, deceit, or gross negligence;4\n\nThe authorized delegate has been convicted of a violation of a state or federal money laundering statute;5\n\nThe competence, experience, character, or general fitness of the authorized delegate indicates that it is not in the public interest to permit the authorized delegate to engage in money transmission; or6\n\nThe authorized delegate is engaging in an unsafe or unsound practice. In determining whether the authorized delegate is engaging in an unsafe or unsound practice, the Commission may consider the volume and condition of the licensee&#8217;s money transmission business, the magnitude of any loss, the gravity of any violation of this chapter, the previous conduct of the person involved, and any other factors that the Commission deems relevant.C\n\nWhen, in the opinion of the Commission, immediate action is required to protect the public interest, a cease and desist order may be issued immediately without a prior hearing. In determining whether the <span class=\"dictionary\">authorized delegate<\/span> is engaging in an unsafe or unsound practice, the <span class=\"dictionary\">Commission<\/span> may consider the volume and condition of the <span class=\"dictionary\">licensee<\/span>&#8217;s <span class=\"dictionary\">money transmission<\/span> business, the magnitude of any loss, the gravity of any violation of this chapter, the previous conduct of the <span class=\"dictionary\">person<\/span> involved, and any other factors that the <span class=\"dictionary\">Commission<\/span> deems relevant. <a id=\"paragraph-199621\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1956\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> When, in the <span class=\"dictionary\">opinion<\/span> of the <span class=\"dictionary\">Commission<\/span>, immediate action is required to protect the public interest, a cease and desist <span class=\"dictionary\">order<\/span> may be issued immediately without a prior <span class=\"dictionary\">hearing<\/span>. In such cases, the <span class=\"dictionary\">Commission<\/span> shall make a <span class=\"dictionary\">hearing<\/span> available to the <span class=\"dictionary\">person<\/span> on an expedited basis. <a id=\"paragraph-199622\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1956\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> If required to conserve the <span class=\"dictionary\">assets<\/span> of a <span class=\"dictionary\">licensee<\/span> or protect the public interest, the <span class=\"dictionary\">Commission<\/span> may <span class=\"dictionary\">order<\/span> a <span class=\"dictionary\">licensee<\/span> and its <span class=\"dictionary\">authorized delegates<\/span> to cease and desist from selling or issuing <span class=\"dictionary\">payment instruments<\/span> or <span class=\"dictionary\">stored value<\/span> or receiving additional money for transmission. <a id=\"paragraph-199623\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1956\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The <span class=\"dictionary\">Commission<\/span> shall have <span class=\"dictionary\">jurisdiction<\/span> to enter and enforce a cease and desist <span class=\"dictionary\">order<\/span> against any <span class=\"dictionary\">person<\/span>, regardless of whether such <span class=\"dictionary\">person<\/span> is present <span class=\"dictionary\">in the Commonwealth<\/span>, who directly or indirectly (i) sells or <span class=\"dictionary\">issues<\/span> <span class=\"dictionary\">payment instruments<\/span> or <span class=\"dictionary\">stored value<\/span> to any <span class=\"dictionary\">person<\/span> located <span class=\"dictionary\">in the Commonwealth<\/span> or (ii) receives money from such <span class=\"dictionary\">persons<\/span>. <a id=\"paragraph-199624\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-1956\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\n(EFFECTIVE JULY 1, 2026) CEASE AND DESIST ORDERS (\u00a7 6.2-1956)\n\nA. If the Commission determines that (i) any person has violated any provision\nof this chapter or any regulation adopted hereunder or (ii) a licensee is\nengaging in one or more unsafe or unsound practices, the Commission may, upon 21\ndays&#8217; notice in writing, order such person to cease and desist from such\npractices and to comply with the provisions of this chapter. The notice shall be\nsent by certified mail to the principal place of business of such person or\nother address authorized under &#xA7; 12.1-19.1 and shall state the grounds for\nthe contemplated action. Within 14 days of mailing the notice, the person or\npersons named therein may file with the clerk of the Commission a written\nrequest for a hearing. The Commission may enforce compliance with any such order\nissued under this section by imposition and collection of such fines and\npenalties as may be prescribed by law.\n\nB. The Commission may, pursuant to the procedures set forth in subsection A,\norder a licensee to cease and desist from allowing an authorized delegate to\nengage in money transmission on the licensee&#8217;s behalf upon any of the\nfollowing grounds:\n\n   1. The authorized delegate violated this chapter or a regulation adopted or an\n   order issued under this chapter or violated any other law or regulation\n   applicable to the conduct of the licensee&#8217;s business;\n\n   2. The authorized delegate did not cooperate with an examination or\n   investigation by the Commission;\n\n   3. The authorized delegate engaged in fraud, misrepresentation, deceit, or\n   gross negligence;\n\n   4. The authorized delegate has been convicted of a violation of a state or\n   federal money laundering statute;\n\n   5. The competence, experience, character, or general fitness of the authorized\n   delegate indicates that it is not in the public interest to permit the\n   authorized delegate to engage in money transmission; or\n\n   6. The authorized delegate is engaging in an unsafe or unsound practice. In\n   determining whether the authorized delegate is engaging in an unsafe or\n   unsound practice, the Commission may consider the volume and condition of the\n   licensee&#8217;s money transmission business, the magnitude of any loss, the\n   gravity of any violation of this chapter, the previous conduct of the person\n   involved, and any other factors that the Commission deems relevant.\n\nC. When, in the opinion of the Commission, immediate action is required to\nprotect the public interest, a cease and desist order may be issued immediately\nwithout a prior hearing. In such cases, the Commission shall make a hearing\navailable to the person on an expedited basis.\n\nD. If required to conserve the assets of a licensee or protect the public\ninterest, the Commission may order a licensee and its authorized delegates to\ncease and desist from selling or issuing payment instruments or stored value or\nreceiving additional money for transmission.\n\nE.
