The Commissioner shall prescribe the procedure to document eligibility for this exemption.B\n\nWith regard to a person exempted from the application procedures described in subsections A and B of \u00a7 6.2-2603 pursuant to subsection A, the Commissioner shall:1\n\nAutomatically issue a license upon payment of the fee required by subsection C of &#xA7; 6.2-2603 and the providing of the bond required by &#xA7; 6.2-2604;2\n\nAutomatically renew a license upon payment of the fees required by subsection E of &#xA7; 6.2-2607; and3\n\nDeem the person to have met all the requirements set forth in subsections A and B of &#xA7; 6.2-2603.C\n\nA person issued a license pursuant to subdivision B 1:1\n\nIs exempt from subsections A and B of &#xA7; 6.2-2603; and2\n\nShall comply with the record requirements in &#xA7; 6.2-2608 except to the extent that the requirements are inconsistent with federal law.D\n\nA person issued a license pursuant to subdivision B 1 shall, within seven days after receiving notification of the expiration, revocation, or termination of (i) an agreement with the U.S. Secretary of Education under 20 U.S.C. &#xA7; 1078(b) or (ii) any contract awarded by the U.S. Secretary of Education under 20 U.S.C. &#xA7; 1087f, provide the Commissioner with written notice of such expiration, revocation, or termination. Notwithstanding any other provision of this chapter, such person&#8217;s license shall automatically expire 30 days after the expiration, revocation, or termination of such person&#8217;s contract. A <span class=\"dictionary\">person<\/span> seeking to act as a <span class=\"dictionary\"><span class=\"dictionary\">qualified education loan<\/span> servicer<\/span> following the expiration of its license may apply for a new license by filing an application that meets the requirements of &#xA7;&#xA7; <a class=\"law\" title=\"Application for license; form; content; fee\" href=\"\/6.2-2603\/\">6.2-2603<\/a> and <a class=\"law\" title=\"Bond required\" href=\"\/6.2-2604\/\">6.2-2604<\/a> and subsection B of &#xA7; <a class=\"law\" title=\"Investigation of applications\" href=\"\/6.2-2605\/\">6.2-2605<\/a>. <a id=\"paragraph-229079\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-2602\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> With respect to <span class=\"dictionary\">qualified education loan<\/span> servicing not conducted pursuant to (i) an agreement with the U.S. Secretary of Education under 20 U.S.C. &#xA7; 1078(b) or (ii) a <span class=\"dictionary\">contract<\/span> awarded by the U.S. Secretary of Education under 20 U.S.C. &#xA7; 1087f, nothing in this section prevents the <span class=\"dictionary\">Commission<\/span> from issuing an <span class=\"dictionary\">order<\/span> to temporarily or permanently prohibit or bar any <span class=\"dictionary\">person<\/span> from acting as a <span class=\"dictionary\"><span class=\"dictionary\">qualified education loan<\/span> servicer<\/span> or violating applicable <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-229080\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-2602\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> In the case of <span class=\"dictionary\">qualified education loan<\/span> servicing conducted pursuant to (i) an agreement with the U.S. Secretary of Education under 20 U.S.C. &#xA7; 1078(b) or (ii) a <span class=\"dictionary\">contract<\/span> awarded by the U.S. Secretary of Education under 20 U.S.C. &#xA7; 1087f, nothing in this section shall prevent the <span class=\"dictionary\">Commission<\/span> from issuing a cease and desist <span class=\"dictionary\">order<\/span> or <span class=\"dictionary\">injunction<\/span> against any <span class=\"dictionary\"><span class=\"dictionary\">qualified education loan<\/span> servicer<\/span> to cease activities in violation of this act. <a id=\"paragraph-229081\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/6.2-2602\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nLICENSURE OF QUALIFIED EDUCATION LOAN SERVICERS; AUTOMATIC ISSUANCE OF LICENSE\nFOR FEDERAL STUDENT LOAN SERVICING CONTRACTORS (\u00a7 6.2-2602)\n\nA. A person seeking to act as a qualified education loan servicer is exempt from\nthe application procedures described in subsections A and B of &#xA7; 6.2-2603\nupon determination by the Commissioner that the person (i) has an agreement with\nthe U.S. Secretary of Education under 20 U.S.C. &#xA7; 1078(b), solely to the\nextent of the person&#8217;s actions as a guarantor that engages in averting\ndefaults, or (ii) is a party to a contract awarded by the U.S. Secretary of\nEducation under 20 U.S.C. &#xA7; 1087f. The Commissioner shall prescribe the\nprocedure to document eligibility for this exemption.\n\nB. With regard to a person exempted from the application procedures described in\nsubsections A and B of \u00a7 6.2-2603 pursuant to subsection A, the Commissioner\nshall:\n\n   1. Automatically issue a license upon payment of the fee required by\n   subsection C of &#xA7; 6.2-2603 and the providing of the bond required by\n   &#xA7; 6.2-2604;\n\n   2. Automatically renew a license upon payment of the fees required by\n   subsection E of &#xA7; 6.2-2607; and\n\n   3. Deem the person to have met all the requirements set forth in subsections A\n   and B of &#xA7; 6.2-2603.\n\nC. A person issued a license pursuant to subdivision B 1:\n\n   1. Is exempt from subsections A and B of &#xA7; 6.2-2603; and\n\n   2. Shall comply with the record requirements in &#xA7; 6.2-2608 except to the\n   extent that the requirements are inconsistent with federal law.\n\nD. A person issued a license pursuant to subdivision B 1 shall, within seven\ndays after receiving notification of the expiration, revocation, or termination\nof (i) an agreement with the U.S. Secretary of Education under 20 U.S.C. &#xA7;\n1078(b) or (ii) any contract awarded by the U.S. Secretary of Education under 20\nU.S.C. &#xA7; 1087f, provide the Commissioner with written notice of such\nexpiration, revocation, or termination. Notwithstanding any other provision of\nthis chapter, such person&#8217;s license shall automatically expire 30 days\nafter the expiration, revocation, or termination of such person&#8217;s\ncontract. A person seeking to act as a qualified education loan servicer\nfollowing the expiration of its license may apply for a new license by filing an\napplication that meets the requirements of &#xA7;&#xA7; 6.2-2603 and 6.2-2604\nand subsection B of &#xA7; 6.2-2605.\n\nE. With respect to qualified education loan servicing not conducted pursuant to\n(i) an agreement with the U.S. Secretary of Education under 20 U.S.C. &#xA7;\n1078(b) or (ii) a contract awarded by the U.S. Secretary of Education under 20\nU.S.C. &#xA7; 1087f, nothing in this section prevents the Commission from\nissuing an order to temporarily or permanently prohibit or bar any person from\nacting as a qualified education loan servicer or violating applicable law.\n\nF.
