Any information so provided shall be used by the Authority solely for the purpose of verifying employment and wage claims of those businesses that have received incentive awards. <a id=\"paragraph-208764\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/60.2-114\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Each employing unit shall report to the Virginia New Hire Reporting Center the employment of any newly hired employee in compliance with &#xA7; <a class=\"law\" title=\"Virginia New Hire Reporting Center; State Directory of New Hires; reporting by employers\" href=\"\/63.2-1946\/\">63.2-1946<\/a>. <a id=\"paragraph-208765\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/60.2-114\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Any member or employee of the Commission and any member, employee, or agent of any agency or political subdivision of the Commonwealth who violates any provision of this section shall be guilty of a Class 2 <span class=\"dictionary\">misdemeanor<\/span>. <a id=\"paragraph-208766\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/60.2-114\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nRECORDS AND REPORTS (\u00a7 60.2-114)\n\nA. Each employing unit shall keep true and accurate work records, containing\nsuch information as the Commission may prescribe. Such records shall be open to\ninspection and be subject to being copied by the Commission or its authorized\nrepresentatives at any reasonable time and as often as may be necessary. The\nCommission may require from any employing unit any sworn or unsworn reports,\nwith respect to persons employed by it, which the Commission deems necessary for\nthe effective administration of this title. Information thus obtained shall not\nbe published or be open to public inspection, other than to public employees in\nthe performance of their public duties, in any manner revealing the employing\nunit&#8217;s identity, except as the Commissioner or his delegates deem\nappropriate, nor shall such information be used in any judicial or\nadministrative proceeding other than one arising out of the provisions of this\ntitle; however, the Commission shall make its records about a claimant available\nto the Workers&#8217; Compensation Commission if it requests such records.\nHowever, any claimant at a hearing before an appeal tribunal or the Commission\nshall be supplied with information from such records to the extent necessary for\nthe proper presentation of his claim. Notwithstanding other provisions of this\nsection, the Commissioner, or his delegate, may, in his discretion, reveal\ninformation when such communication is not inconsistent with the proper\nadministration of this title.\n\nB. Notwithstanding the provisions of subsection A, the Commission shall, on a\nreimbursable basis, furnish wage and unemployment compensation information\ncontained in its records to the Secretary of Health and Human Services and the\nDivision of Child Support Enforcement of the Department of Social Services for\ntheir use as necessary for the purposes of the National Directory of New Hires\nestablished under &#xA7; 453(i) of the Social Security Act.\n\nC. Notwithstanding the provisions of subsection A, the Commission shall, upon\nwritten request, furnish:\n\n   1. Any agency or political subdivision of the Commonwealth, or its designated\n   agent, such information as it may require for the purpose of collecting fines,\n   penalties, and costs owed to the Commonwealth or its political subdivisions.\n   Such information shall not be published or used in any administrative or\n   judicial proceeding, except in matters arising out of the collection of fines,\n   penalties, and costs owed to the Commonwealth or its political subdivisions;\n\n   2. The Virginia Economic Development Partnership Authority such information as\n   it may require to facilitate the administration and enforcement by the\n   Authority of performance agreements with businesses that have received\n   incentive awards. Any information provided to the Authority under this\n   subdivision shall be confidential pursuant to 20 C.F.R. Part 603 and shall\n   only be disclosed to members of the Authority who are public officials or\n   employees of the Authority for the performance of their official duties. No\n   public official or employee shall redisclose any confidential information\n   obtained pursuant to this subdivision to nonlegislative citizen members of the\n   Authority or to the public. Any information so provided shall be used by the\n   Authority solely for the purpose of verifying employment and wage claims of\n   those businesses that have received incentive awards;\n\n   3. (Expires July 1, 2027) An arresting official such information as he may\n   require to comply with the provisions of &#xA7; 19.2-83.1. Such information\n   shall not be published or used in any administrative or judicial proceeding;\n   and\n\n   4. The Virginia Port Authority such information as it may require to\n   facilitate the administration and enforcement by the Authority of performance\n   agreements with businesses that have received incentive awards. Any\n   information provided to the Authority under this subdivision shall be\n   confidential pursuant to 20 C.F.R. Part 603 and shall only be disclosed to\n   members of the Authority who are public officials or employees of the\n   Authority for the performance of their official duties. No public official or\n   employee shall redisclose any confidential information obtained pursuant to\n   this subdivision to nonlegislative citizen members of the Authority or to the\n   public.
