I, c. 327; 2022, cc. 739, 782; 2023, cc. 440, 441.","full_text":"As used in this chapter, unless the context requires a different meaning:\n\t\t&#8220;Authority&#8221; means the Virginia Resources Authority created by this chapter.\n\t\t&#8220;Board of Directors&#8221; means the Board of Directors of the Authority.\n\t\t&#8220;Bonds&#8221; means any bonds, notes, debentures, interim certificates, bond, grant or revenue anticipation notes, lease and sale-leaseback transactions, or any other obligations of the Authority for the payment of money.\n\t\t&#8220;Capital Reserve Fund&#8221; means the reserve fund created and established by the Authority in accordance with \u00a7 62.1-215.\n\t\t&#8220;Cost,&#8221; as applied to any project financed under the provisions of this chapter, means the total of all costs incurred by the local government as reasonable and necessary for carrying out all works and undertakings necessary or incident to the accomplishment of any project. It includes, without limitation, all necessary developmental, planning and feasibility studies, surveys, plans and specifications, architectural, engineering, financial, legal or other special services, the cost of acquisition of land and any buildings and improvements thereon, including the discharge of any obligations of the sellers of such land, buildings or improvements, real estate appraisals, site preparation and development, including demolition or removal of existing structures, construction and reconstruction, labor, materials, machinery and equipment, the reasonable costs of financing incurred by the local government in the course of the development of the project, including the cost of any credit enhancements, carrying charges incurred before placing the project in service, interest on local obligations issued to finance the project to a date subsequent to the estimated date the project is to be placed in service, necessary expenses incurred in connection with placing the project in service, the funding of accounts and reserves which the Authority may require, and the cost of other items which the Authority determines to be reasonable and necessary. It also includes the amount of any contribution, grant, or aid which a local government may make or give to any adjoining state, the District of Columbia or any department, agency, or instrumentality thereof to pay the costs incident and necessary to the accomplishment of any project, including, without limitation, the items set forth above. &#8220;Cost&#8221; also includes interest and principal payments pursuant to any installment purchase agreement.\n\t\t&#8220;Credit enhancements&#8221; means surety bonds, insurance policies, letters of credit, guarantees, and other forms of collateral or security.\n\t\t&#8220;Defective drywall&#8221; means the same as that term is defined in \u00a7 36-156.1.\n\t\t&#8220;Federal facility&#8221; means any building or infrastructure used or to be used by the federal government, including any building or infrastructure located on lands owned by the federal government.\n\t\t&#8220;Federal government&#8221; means the United States of America, or any department, agency, or instrumentality, corporate or otherwise, of the United States of America.\n\t\t&#8220;Former federal facility&#8221; means any federal facility formerly used by the federal government or in transition from use by the federal government to a facility all or part of which is to serve any local government.\n\t\t&#8220;Local government&#8221; means any county, city, town, municipal corporation, authority, district, commission, or political subdivision created by the General Assembly or pursuant to the Constitution and laws of the Commonwealth or any combination of any two or more of the foregoing.\n\t\t&#8220;Local obligations&#8221; means any bonds, notes, debentures, interim certificates, bond, grant or revenue anticipation notes, leases, credit enhancements, or any other obligations of a local government for the payment of money.\n\t\t&#8220;Minimum capital reserve fund requirement&#8221; means, as of any particular date of computation, the amount of money designated as the minimum capital reserve fund requirement which may be established in the resolution of the Authority authorizing the issuance of, or the trust indenture securing, any outstanding issue of bonds or credit enhancement.\n\t\t&#8220;Project&#8221; means (i) any water supply or wastewater treatment facility, including a facility for receiving and stabilizing septage or a soil drainage management facility, and any solid waste treatment, disposal, or management facility, recycling facility, federal facility or former federal facility, or resource recovery facility located or to be located in the Commonwealth, the District of Columbia, or any adjoining state, all or part of which facility serves or is to serve any local government, and (ii) any federal facility located or to be located in the Commonwealth, provided that both the Board of Directors of the Authority and the governing body of the local government receiving the benefit of the loan, grant, or credit enhancement from the Authority make a determination or finding to be embodied in a resolution or ordinance that the undertaking and financing of such facility is necessary for the location or retention of such facility and the related use by the federal government in the Commonwealth. The term includes, without limitation, water supply and intake facilities; water treatment and filtration facilities; water storage facilities; water distribution facilities; sewage and wastewater (including surface and ground water) collection, treatment, and disposal facilities; drainage facilities and projects; solid waste treatment, disposal, or management facilities; recycling facilities; resource recovery facilities; related office, administrative, storage, maintenance, and laboratory facilities; and interests in land related thereto. The term also includes energy conservation measures and facility technology infrastructure as defined in \u00a7 45.2-1702 and other energy objectives as defined in \u00a7 45.2-1706.1. The term also means any heavy rail transportation facilities operated by a transportation district created under the Transportation District Act of 1964 (\u00a7 33.2-1900 et seq.) that operates heavy rail freight service, including rolling stock, barge loading facilities, and any related marine or rail equipment. The term also means, without limitation, the design and construction of roads, the construction of local government buildings, including administrative and operations systems and other local government equipment and infrastructure, public parking garages and other public transportation facilities, and facilities for public transportation by commuter rail. In addition, the term means any project as defined in \u00a7 5.1-30.1 or 10.1-603.28 and any professional sports facility, including a major league baseball stadium as defined in \u00a7 15.2-5800, provided that the specific professional sports facility projects have been designated by the General Assembly as eligible for assistance from the Authority. The term also means any equipment, facilities, and technology infrastructure designed to provide broadband service. The term also means facilities supporting, related to, or otherwise used for public safety, including but not limited to law-enforcement training facilities and emergency response, fire, rescue, and police stations. The term also means the remediation, redevelopment, and rehabilitation of property contaminated by the release of hazardous substances, hazardous wastes, solid wastes, or petroleum, where such remediation has not clearly been mandated by the United States Environmental Protection Agency, the Department of Environmental Quality, or a court pursuant to the Comprehensive Environmental Response, Compensation and Liability Act (42 U.S.C. \u00a7 9601 et seq.), the Resource Conservation and Recovery Act (42 U.S.C. \u00a7 6901 et seq.), the Virginia Waste Management Act (\u00a7 10.1-1400 et seq.), the State Water Control Law (\u00a7 62.1-44.2 et seq.), or other applicable statutory or common law or where jurisdiction of those statutes has been waived. The term also means any program or project for land conservation, parks, park facilities, land for recreational purposes, or land preservation, including but not limited to any program or project involving the acquisition of rights or interests in land for the conservation or preservation of such land. The term also means any dredging program or dredging project undertaken to benefit the economic and community development goals of a local government but does not include any dredging program or dredging project undertaken for or by the Virginia Port Authority. The term also means any oyster restoration project, including planting and replanting with seed oysters, oyster shells, or other material that will catch, support, and grow oysters. The term also means any program or project to perform site acquisition or site development work for the benefit of economic and community development projects for any local government. The term also means any undertaking by a local government to build or facilitate the production or preservation of housing or a recovered gas energy facility and any local government renewable energy project, including solar, wind, biomass, waste-to-energy, and geothermal projects. The term also means any undertaking by a local government to facilitate the remediation of residential properties contaminated by the presence of defective drywall. means the reserve fund created and established by the <span class=\"dictionary\">Authority<\/span> in accordance with \u00a7&nbsp;<a class=\"law\" title=\"Establishment of capital reserve funds\" href=\"\/62.1-215\/\">62.1-215<\/a>.\n\t\t&#8220;<span class=\"dictionary\">Cost<\/span>,&#8221; as applied to any <span class=\"dictionary\">project<\/span> financed under the provisions of this chapter, means the total of all <span class=\"dictionary\">costs<\/span> incurred by the <span class=\"dictionary\">local government<\/span> as reasonable and necessary for carrying out all works and undertakings necessary or incident to the accomplishment of any <span class=\"dictionary\">project<\/span>. It includes, without limitation, all necessary developmental, planning and feasibility studies, surveys, plans and specifications, architectural, engineering, financial, legal or other special services, the <span class=\"dictionary\">cost<\/span> of acquisition of land and any buildings and improvements thereon, including the discharge of any obligations of the sellers of such land, buildings or improvements, real estate appraisals, site preparation and development, including demolition or removal of existing structures, construction and reconstruction, labor, <span class=\"dictionary\">materials<\/span>, machinery and equipment, the reasonable <span class=\"dictionary\">costs<\/span> of financing incurred by the <span class=\"dictionary\">local government<\/span> in the course of the development of the <span class=\"dictionary\">project<\/span>, including the <span class=\"dictionary\">cost<\/span> of any <span class=\"dictionary\">credit enhancements<\/span>, carrying charges incurred before placing the <span class=\"dictionary\">project<\/span> in service, interest on <span class=\"dictionary\">local obligations<\/span> issued to finance the <span class=\"dictionary\">project<\/span> to a date subsequent to the estimated date the <span class=\"dictionary\">project<\/span> is to be placed in service, necessary expenses incurred in connection with placing the <span class=\"dictionary\">project<\/span> in service, the funding of accounts and reserves which the <span class=\"dictionary\">Authority<\/span> may require, and the <span class=\"dictionary\">cost<\/span> of other items which the <span class=\"dictionary\">Authority<\/span> determines to be reasonable and necessary. It also includes the amount of any contribution, grant, or aid which a <span class=\"dictionary\">local government<\/span> may make or give to any adjoining state, the District of Columbia or any department, agency, or instrumentality thereof to pay the <span class=\"dictionary\">costs<\/span> incident and necessary to the accomplishment of any <span class=\"dictionary\">project<\/span>, including, without limitation, the items set forth above. &#8220;<span class=\"dictionary\">Cost<\/span>&#8221; also includes interest and principal payments pursuant to any installment purchase agreement.\n\t\t&#8220;<span class=\"dictionary\">Credit enhancements<\/span>&#8221; means <span class=\"dictionary\">surety<\/span> <span class=\"dictionary\"><span class=\"dictionary\">bonds<\/span><\/span>, insurance policies, letters of credit, guarantees, and other forms of <span class=\"dictionary\">collateral<\/span> or security.\n\t\t&#8220;<span class=\"dictionary\">Defective drywall<\/span>&#8221; means the same as that term is defined in \u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/36-156.1\/\">36-156.1<\/a>.\n\t\t&#8220;Federal facility&#8221; means any building or infrastructure used or to be used by the <span class=\"dictionary\">federal government<\/span>, including any building or infrastructure located on lands owned by the <span class=\"dictionary\">federal government<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Federal government<\/span>&#8221; means the United States of America, or any department, agency, or instrumentality, corporate or otherwise, of the United States of America.\n\t\t&#8220;<span class=\"dictionary\">Former federal facility<\/span>&#8221; means any federal facility formerly used by the <span class=\"dictionary\">federal government<\/span> or in transition from use by the <span class=\"dictionary\">federal government<\/span> to a facility all or part of which is to serve any <span class=\"dictionary\">local government<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Local government<\/span>&#8221; means any county, city, town, municipal corporation, <span class=\"dictionary\">authority<\/span>, district, commission, or political subdivision created by the General Assembly or pursuant to the Constitution and <span class=\"dictionary\">laws<\/span> of the Commonwealth or any combination of any two or more of the foregoing.\n\t\t&#8220;<span class=\"dictionary\">Local obligations<\/span>&#8221; means any <span class=\"dictionary\"><span class=\"dictionary\">bonds<\/span><\/span>, notes, debentures, interim certificates, <span class=\"dictionary\">bond<\/span>, grant or revenue anticipation notes, leases, <span class=\"dictionary\">credit enhancements<\/span>, or any other obligations of a <span class=\"dictionary\">local government<\/span> for the payment of money.\n\t\t&#8220;Minimum <span class=\"dictionary\">capital reserve fund<\/span> requirement&#8221; means, as of any particular date of computation, the amount of money designated as the minimum <span class=\"dictionary\">capital reserve fund<\/span> requirement which may be established in the resolution of the <span class=\"dictionary\">Authority<\/span> authorizing the issuance of, or the trust indenture securing, any outstanding <span class=\"dictionary\">issue<\/span> of <span class=\"dictionary\"><span class=\"dictionary\">bonds<\/span><\/span> or credit enhancement.\n\t\t&#8220;<span class=\"dictionary\">Project<\/span>&#8221; means (i) any water supply or wastewater treatment facility, including a facility for receiving and stabilizing septage or a soil drainage management facility, and any solid waste treatment, disposal, or management facility, recycling facility, federal facility or <span class=\"dictionary\">former federal facility<\/span>, or resource recovery facility located or to be located in the Commonwealth, the District of Columbia, or any adjoining state, all or part of which facility serves or is to serve any <span class=\"dictionary\">local government<\/span>, and (ii) any federal facility located or to be located in the Commonwealth, provided that both the <span class=\"dictionary\">Board of Directors<\/span> of the <span class=\"dictionary\">Authority<\/span> and the governing body of the <span class=\"dictionary\">local government<\/span> receiving the benefit of the loan, grant, or credit enhancement from the <span class=\"dictionary\">Authority<\/span> make a determination or <span class=\"dictionary\">finding<\/span> to be embodied in a resolution or <span class=\"dictionary\">ordinance<\/span> that the undertaking and financing of such facility is necessary for the location or retention of such facility and the related use by the <span class=\"dictionary\">federal government<\/span> in the Commonwealth. The term includes, without limitation, water supply and intake facilities; water treatment and filtration facilities; water storage facilities; water distribution facilities; sewage and wastewater (including surface and ground water) collection, treatment, and disposal facilities; drainage facilities and <span class=\"dictionary\">projects<\/span>; solid waste treatment, disposal, or management facilities; recycling facilities; resource recovery facilities; related office, administrative, storage, maintenance, and laboratory facilities; and interests in land related thereto. The term also includes energy conservation measures and facility technology infrastructure as defined in \u00a7&nbsp;<a class=\"law\" title=\" Definitions\" href=\"\/45.2-1702\/\">45.2-1702<\/a> and other energy objectives as defined in \u00a7&nbsp;<a class=\"law\" title=\" Commonwealth Clean Energy Policy\" href=\"\/45.2-1706.1\/\">45.2-1706.1<\/a>. The term also means any heavy rail transportation facilities operated by a transportation district created under the Transportation District Act of 1964 (\u00a7&nbsp;<a class=\"law\" title=\"Declaration of policy\" href=\"\/33.2-1900\/\">33.2-1900<\/a> et seq.) that operates heavy rail freight service, including rolling stock, barge loading facilities, and any related marine or rail equipment. The term also means, without limitation, the design and construction of roads, the construction of <span class=\"dictionary\">local government<\/span> buildings, including administrative and operations systems and other <span class=\"dictionary\">local government<\/span> equipment and infrastructure, public parking garages and other public transportation facilities, and facilities for public transportation by commuter rail. In addition, the term means any <span class=\"dictionary\">project<\/span> as defined in \u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/5.1-30.1\/\">5.1-30.1<\/a> or <a class=\"law\" title=\"Definitions\" href=\"\/10.1-603.28\/\">10.1-603.28<\/a> and any professional sports facility, including a major league baseball stadium as defined in \u00a7&nbsp;<a class=\"law\" title=\"Definitions; professional baseball games; consent for construction\" href=\"\/15.2-5800\/\">15.2-5800<\/a>, provided that the specific professional sports facility <span class=\"dictionary\">projects<\/span> have been designated by the General Assembly as eligible for assistance from the <span class=\"dictionary\">Authority<\/span>. The term also means any equipment, facilities, and technology infrastructure designed to provide broadband service. The term also means facilities supporting, related to, or otherwise used for public safety, including but not limited to law-enforcement training facilities and emergency response, fire, rescue, and police stations. The term also means the remediation, redevelopment, and rehabilitation of property contaminated by the release of hazardous substances, hazardous wastes, solid wastes, or petroleum, where such remediation has not clearly been mandated by the United States Environmental Protection Agency, the Department of Environmental Quality, or a <span class=\"dictionary\">court<\/span> pursuant to the Comprehensive Environmental Response, Compensation and Liability Act (42 U.S.C. \u00a7&nbsp;9601 et seq.), the Resource Conservation and Recovery Act (42 U.S.C. \u00a7&nbsp;6901 et seq.), the Virginia Waste Management Act (\u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/10.1-1400\/\">10.1-1400<\/a> et seq.), the State Water Control Law (\u00a7&nbsp;<a class=\"law\" title=\"Short title; purpose\" href=\"\/62.1-44.2\/\">62.1-44.2<\/a> et seq.), or other applicable statutory or <span class=\"dictionary\">common law<\/span> or where <span class=\"dictionary\">jurisdiction<\/span> of those <span class=\"dictionary\">statutes<\/span> has been waived. The term also means any program or <span class=\"dictionary\">project<\/span> for land conservation, parks, park facilities, land for recreational purposes, or land preservation, including but not limited to any program or <span class=\"dictionary\">project<\/span> involving the acquisition of rights or interests in land for the conservation or preservation of such land. The term also means any dredging program or dredging <span class=\"dictionary\">project<\/span> undertaken to benefit the economic and community development goals of a <span class=\"dictionary\">local government<\/span> but does not include any dredging program or dredging <span class=\"dictionary\">project<\/span> undertaken for or by the Virginia Port <span class=\"dictionary\">Authority<\/span>. The term also means any oyster restoration <span class=\"dictionary\">project<\/span>, including planting and replanting with seed oysters, oyster shells, or other <span class=\"dictionary\">material<\/span> that will catch, support, and grow oysters. The term also means any program or <span class=\"dictionary\">project<\/span> to perform site acquisition or site development work for the benefit of economic and community development <span class=\"dictionary\">projects<\/span> for any <span class=\"dictionary\">local government<\/span>. The term also means any undertaking by a <span class=\"dictionary\">local government<\/span> to build or facilitate the production or preservation of housing or a <span class=\"dictionary\">recovered gas energy facility<\/span> and any <span class=\"dictionary\">local government<\/span> renewable energy <span class=\"dictionary\">project<\/span>, including solar, wind, biomass, waste-to-energy, and geothermal <span class=\"dictionary\">projects<\/span>. The term also means any undertaking by a <span class=\"dictionary\">local government<\/span> to facilitate the remediation of residential properties contaminated by the presence of <span class=\"dictionary\">defective drywall<\/span>. The term also means any undertaking by a <span class=\"dictionary\">local government<\/span> to provide grants, loans, financial assistance, or any other incentives pursuant to \u00a7&nbsp;<a class=\"law\" title=\"Local funding for repair or production of low and moderate income rental property or repair of residential property; other housing experiments\" href=\"\/15.2-958\/\">15.2-958<\/a>.\n\t\t&#8220;<span class=\"dictionary\">Recovered gas energy facility<\/span>&#8221; means a facility, located at or adjacent to (i) a solid waste management facility permitted by the Department of Environmental Quality or (ii) a sewerage system or sewage treatment work described in \u00a7&nbsp;<a class=\"law\" title=\"Sewerage systems, etc., under supervision of Board and Department of Environmental Quality; Board to regulate design specification and plans\" href=\"\/62.1-44.18\/\">62.1-44.18<\/a> that is constructed and operated for the purpose of treating sewage and wastewater for discharge to state waters, which facility or work is constructed and operated for the purpose of (a) reclaiming or collecting methane or other combustible gas from the biodegradation or decomposition of solid waste, as defined in \u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/10.1-1400\/\">10.1-1400<\/a>, that has been deposited in the solid waste management facility or sewerage system or sewage treatment work and (b) either using such gas to generate electric energy or upgrading the gas to pipeline quality and transmitting it off premises for sale or delivery to commercial or industrial purchasers or to a public utility or locality.<\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS (\u00a7 62.1-199)\n\nAs used in this chapter, unless the context requires a different meaning:\n\t\t&#8220;Authority&#8221; means the Virginia Resources Authority created by this\nchapter.\n\t\t&#8220;Board of Directors&#8221; means the Board of Directors of the\nAuthority.\n\t\t&#8220;Bonds&#8221; means any bonds, notes, debentures, interim certificates,\nbond, grant or revenue anticipation notes, lease and sale-leaseback\ntransactions, or any other obligations of the Authority for the payment of\nmoney.\n\t\t&#8220;Capital Reserve Fund&#8221; means the reserve fund created and\nestablished by the Authority in accordance with \u00a7 62.1-215.\n\t\t&#8220;Cost,&#8221; as applied to any project financed under the provisions of\nthis chapter, means the total of all costs incurred by the local government as\nreasonable and necessary for carrying out all works and undertakings necessary\nor incident to the accomplishment of any project. It includes, without\nlimitation, all necessary developmental, planning and feasibility studies,\nsurveys, plans and specifications, architectural, engineering, financial, legal\nor other special services, the cost of acquisition of land and any buildings and\nimprovements thereon, including the discharge of any obligations of the sellers\nof such land, buildings or improvements, real estate appraisals, site\npreparation and development, including demolition or removal of existing\nstructures, construction and reconstruction, labor, materials, machinery and\nequipment, the reasonable costs of financing incurred by the local government in\nthe course of the development of the project, including the cost of any credit\nenhancements, carrying charges incurred before placing the project in service,\ninterest on local obligations issued to finance the project to a date subsequent\nto the estimated date the project is to be placed in service, necessary expenses\nincurred in connection with placing the project in service, the funding of\naccounts and reserves which the Authority may require, and the cost of other\nitems which the Authority determines to be reasonable and necessary. It also\nincludes the amount of any contribution, grant, or aid which a local government\nmay make or give to any adjoining state, the District of Columbia or any\ndepartment, agency, or instrumentality thereof to pay the costs incident and\nnecessary to the accomplishment of any project, including, without limitation,\nthe items set forth above. &#8220;Cost&#8221; also includes interest and\nprincipal payments pursuant to any installment purchase agreement.\n\t\t&#8220;Credit enhancements&#8221; means surety bonds, insurance policies,\nletters of credit, guarantees, and other forms of collateral or security.\n\t\t&#8220;Defective drywall&#8221; means the same as that term is defined in \u00a7\n36-156.1.\n\t\t&#8220;Federal facility&#8221; means any building or infrastructure used or to\nbe used by the federal government, including any building or infrastructure\nlocated on lands owned by the federal government.\n\t\t&#8220;Federal government&#8221; means the United States of America, or any\ndepartment, agency, or instrumentality, corporate or otherwise, of the United\nStates of America.\n\t\t&#8220;Former federal facility&#8221; means any federal facility formerly used\nby the federal government or in transition from use by the federal government to\na facility all or part of which is to serve any local government.\n\t\t&#8220;Local government&#8221; means any county, city, town, municipal\ncorporation, authority, district, commission, or political subdivision created\nby the General Assembly or pursuant to the Constitution and laws of the\nCommonwealth or any combination of any two or more of the foregoing.\n\t\t&#8220;Local obligations&#8221; means any bonds, notes, debentures, interim\ncertificates, bond, grant or revenue anticipation notes, leases, credit\nenhancements, or any other obligations of a local government for the payment of\nmoney.\n\t\t&#8220;Minimum capital reserve fund requirement&#8221; means, as of any\nparticular date of computation, the amount of money designated as the minimum\ncapital reserve fund requirement which may be established in the resolution of\nthe Authority authorizing the issuance of, or the trust indenture securing, any\noutstanding issue of bonds or credit enhancement.\n\t\t&#8220;Project&#8221; means (i) any water supply or wastewater treatment\nfacility, including a facility for receiving and stabilizing septage or a soil\ndrainage management facility, and any solid waste treatment, disposal, or\nmanagement facility, recycling facility, federal facility or former federal\nfacility, or resource recovery facility located or to be located in the\nCommonwealth, the District of Columbia, or any adjoining state, all or part of\nwhich facility serves or is to serve any local government, and (ii) any federal\nfacility located or to be located in the Commonwealth, provided that both the\nBoard of Directors of the Authority and the governing body of the local\ngovernment receiving the benefit of the loan, grant, or credit enhancement from\nthe Authority make a determination or finding to be embodied in a resolution or\nordinance that the undertaking and financing of such facility is necessary for\nthe location or retention of such facility and the related use by the federal\ngovernment in the Commonwealth. The term includes, without limitation, water\nsupply and intake facilities; water treatment and filtration facilities; water\nstorage facilities; water distribution facilities; sewage and wastewater\n(including surface and ground water) collection, treatment, and disposal\nfacilities; drainage facilities and projects; solid waste treatment, disposal,\nor management facilities; recycling facilities; resource recovery facilities;\nrelated office, administrative, storage, maintenance, and laboratory facilities;\nand interests in land related thereto. The term also includes energy\nconservation measures and facility technology infrastructure as defined in \u00a7\n45.2-1702 and other energy objectives as defined in \u00a7 45.2-1706.1. The term\nalso means any heavy rail transportation facilities operated by a transportation\ndistrict created under the Transportation District Act of 1964 (\u00a7 33.2-1900 et\nseq.) that operates heavy rail freight service, including rolling stock, barge\nloading facilities, and any related marine or rail equipment. The term also\nmeans, without limitation, the design and construction of roads, the\nconstruction of local government buildings, including administrative and\noperations systems and other local government equipment and infrastructure,\npublic parking garages and other public transportation facilities, and\nfacilities for public transportation by commuter rail. In addition, the term\nmeans any project as defined in \u00a7 5.1-30.1 or 10.1-603.28 and any professional\nsports facility, including a major league baseball stadium as defined in \u00a7\n15.2-5800, provided that the specific professional sports facility projects have\nbeen designated by the General Assembly as eligible for assistance from the\nAuthority. The term also means any equipment, facilities, and technology\ninfrastructure designed to provide broadband service. The term also means\nfacilities supporting, related to, or otherwise used for public safety,\nincluding but not limited to law-enforcement training facilities and emergency\nresponse, fire, rescue, and police stations. The term also means the\nremediation, redevelopment, and rehabilitation of property contaminated by the\nrelease of hazardous substances, hazardous wastes, solid wastes, or petroleum,\nwhere such remediation has not clearly been mandated by the United States\nEnvironmental Protection Agency, the Department of Environmental Quality, or a\ncourt pursuant to the Comprehensive Environmental Response, Compensation and\nLiability Act (42 U.S.C. \u00a7 9601 et seq.), the Resource Conservation and\nRecovery Act (42 U.S.C. \u00a7 6901 et seq.), the Virginia Waste Management Act (\u00a7\n10.1-1400 et seq.), the State Water Control Law (\u00a7 62.1-44.2 et seq.), or other\napplicable statutory or common law or where jurisdiction of those statutes has\nbeen waived. The term also means any program or project for land conservation,\nparks, park facilities, land for recreational purposes, or land preservation,\nincluding but not limited to any program or project involving the acquisition of\nrights or interests in land for the conservation or preservation of such land.\nThe term also means any dredging program or dredging project undertaken to\nbenefit the economic and community development goals of a local government but\ndoes not include any dredging program or dredging project undertaken for or by\nthe Virginia Port Authority. The term also means any oyster restoration project,\nincluding planting and replanting with seed oysters, oyster shells, or other\nmaterial that will catch, support, and grow oysters. The term also means any\nprogram or project to perform site acquisition or site development work for the\nbenefit of economic and community development projects for any local government.\nThe term also means any undertaking by a local government to build or facilitate\nthe production or preservation of housing or a recovered gas energy facility and\nany local government renewable energy project, including solar, wind, biomass,\nwaste-to-energy, and geothermal projects. The term also means any undertaking by\na local government to facilitate the remediation of residential properties\ncontaminated by the presence of defective drywall.
