The Department shall establish and maintain the System. The Board shall promulgate regulations to implement the provisions of this section.B\n\nThe following information shall, notwithstanding any state law regarding privacy or confidentiality of records, be included in the System and made available to the public via a website maintained by the Department and in print format:1\n\nFrom the Department: (i) the total number of complaints alleging child abuse, neglect, or a combination thereof received; (ii) the total number of complaints deemed valid pursuant to &#xA7; 63.2-1508; (iii) the total number of complaints investigated by the Department pursuant to subsection I of &#xA7;&#xA7; 63.2-1503 and 63.2-1505; (iv) the total number of cases determined to be founded cases of abuse or neglect; and (v) the total number of cases resulting in a finding that the complaint was founded resulting in administrative appeal. Information reported pursuant to clause (v) shall be reported by total number of appeals to the local department, total number of appeals to the Department, and total number of appeals by outcome of the appeal. For each category of information required by this subdivision, the Department shall also report the total number of cases by type of abuse; by gender, age, and race of the alleged victim; and by the nature of the relationship between the alleged victim and alleged abuser.2\n\nFrom the Department of State Police, annually, in a format approved by the Department of Social Services, arrest and disposition statistics for violations of &#xA7;&#xA7; 18.2-48, 18.2-61, 18.2-63, 18.2-64.1, 18.2-67.1, 18.2-67.2, 18.2-67.3, 18.2-67.4, 18.2-355, 18.2-361, 18.2-366, 18.2-370 through 18.2-370.2, 18.2-371, 18.2-371.1, 18.2-374.1, 18.2-374.1:1, 18.2-374.3, 18.2-387, and 40.1-103 for inclusion in the Child Protection Accountability System.3\n\nFrom every circuit court in the Commonwealth for which data is available through the statewide Case Management System: (i) the total number of (a) misdemeanor convictions appealed from the district court to the circuit court, (b) felony charges certified from the district court to the circuit court, and (c) charges brought by direct indictment in the circuit court that involve a violation of any Code section set forth in subdivision 2; (ii) the total number of cases appealed, certified, or transferred to the court or brought by direct indictment in the circuit court involving a violation of any Code section set forth in subdivision 2 that result in a trial, including the number of bench trials and the number of jury trials; and (iii) the total number of trials involving a violation of any Code section set forth in subdivision 2 resulting in (a) a plea agreement, (b) transfer to another court, (c) a finding of not guilty, (d) conviction on a lesser included offense, or (e) conviction on all charges, by type of trial.4\n\nFrom the Virginia Criminal Sentencing Commission, information on sentences imposed for offenses listed in subdivision 2, including (i) the name of the sentencing judge, (ii) the offense or offenses for which a sentence was imposed, (iii) the age of the victim and offender, (iv) the relationship between the victim and the offender, (v) the locality in which the offense occurred, (vi) the sentence imposed and the actual time served, (vii) whether the sentence was an upward or downward departure from the sentencing guidelines or within the sentencing guidelines, and (viii) the reasons given for the departure, if any, from the sentencing guidelines.5\n\nFrom the Office of the Executive Secretary of the Supreme Court of Virginia, information by locality on cases from the Juvenile and Domestic Relations District Courts&#8217; Case Management System involving (i) children alleged to be abused or neglected, including (a) the number of petitions filed, (b) the number of cases in which an emergency removal order was issued, (c) the number of cases in which a preliminary removal order was issued prior to an adjudicatory hearing, (d) the number of cases in which a preliminary removal order or a preliminary child protective order or both were issued at a preliminary hearing, and (e) the number of cases in which a preliminary child protective order or a child protective order was issued other than at a preliminary hearing; and (ii) family abuse cases, including (a) the number of family abuse emergency protective orders issued by magistrates and juvenile and domestic relations district courts pursuant to &#xA7; 16.1-253.4, (b) the number of family abuse protective petitions filed, and (c) the number of family abuse protective orders issued pursuant to &#xA7; 16.1-279.1.\n\t\t\t\tInformation required to be reported pursuant to subdivisions 1 through 5 shall be reported annually in a format approved by the Department of Social Services and aggregated by locality.C\n\nData collected pursuant to subsection B shall be made available to the public on a website established and maintained by the Department and shall also be made readily available to the public in print format. penalties; abandoned infant\" href=\"\/18.2-371.1\/\">18.2-371.1<\/a>, <a class=\"law\" title=\"Production, publication, sale, financing, etc., of child pornography; presumption as to age\" href=\"\/18.2-374.1\/\">18.2-374.1<\/a>, <a class=\"law\" title=\"Possession, reproduction, distribution, solicitation, and facilitation of child pornography; penalty\" href=\"\/18.2-374.1_1\/\">18.2-374.1:1<\/a>, <a class=\"law\" title=\"Use of communications systems to facilitate certain offenses involving children; penalties\" href=\"\/18.2-374.3\/\">18.2-374.3<\/a>, <a class=\"law\" title=\"Indecent exposure\" href=\"\/18.2-387\/\">18.2-387<\/a>, and <a class=\"law\" title=\"Cruelty and injuries to children; penalty; abandoned infant\" href=\"\/40.1-103\/\">40.1-103<\/a> for inclusion in the <span class=\"dictionary\">Child<\/span> Protection Accountability System. <a id=\"paragraph-218489\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1530\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> From every <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> in the Commonwealth for which data is available through the statewide Case Management System: (i) the total number of (a) <span class=\"dictionary\">misdemeanor<\/span> <span class=\"dictionary\">convictions<\/span> appealed from the district <span class=\"dictionary\">court<\/span> to the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span>, (b) <span class=\"dictionary\">felony<\/span> charges certified from the district <span class=\"dictionary\">court<\/span> to the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span>, and (c) charges brought by direct <span class=\"dictionary\">indictment<\/span> in the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> that involve a violation of any Code section set forth in subdivision 2; (ii) the total number of cases appealed, certified, or transferred to the <span class=\"dictionary\">court<\/span> or brought by direct <span class=\"dictionary\">indictment<\/span> in the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> involving a violation of any Code section set forth in subdivision 2 that result in a <span class=\"dictionary\">trial<\/span>, including the number of <span class=\"dictionary\">bench trials<\/span> and the number of <span class=\"dictionary\">jury trials<\/span>; and (iii) the total number of trials involving a violation of any Code section set forth in subdivision 2 resulting in (a) a <span class=\"dictionary\">plea<\/span> agreement, (b) transfer to another <span class=\"dictionary\">court<\/span>, (c) a <span class=\"dictionary\">finding<\/span> of not guilty, (d) <span class=\"dictionary\">conviction<\/span> on a <span class=\"dictionary\">lesser included offense<\/span>, or (e) <span class=\"dictionary\">conviction<\/span> on all charges, by type of <span class=\"dictionary\">trial<\/span>. <a id=\"paragraph-218490\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1530\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> From the Virginia Criminal Sentencing Commission, information on sentences imposed for <span class=\"dictionary\">offenses<\/span> listed in subdivision 2, including (i) the name of the sentencing <span class=\"dictionary\">judge<\/span>, (ii) the offense or <span class=\"dictionary\">offenses<\/span> for which a sentence was imposed, (iii) the age of the victim and offender, (iv) the relationship between the victim and the offender, (v) the locality in which the offense occurred, (vi) the sentence imposed and the actual time served, (vii) whether the sentence was an upward or downward departure from the <span class=\"dictionary\">sentencing guidelines<\/span> or within the <span class=\"dictionary\">sentencing guidelines<\/span>, and (viii) the reasons given for the departure, if any, from the <span class=\"dictionary\">sentencing guidelines<\/span>. <a id=\"paragraph-218491\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1530\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> From the Office of the Executive Secretary of the Supreme <span class=\"dictionary\">Court<\/span> of Virginia, information by locality on cases from the Juvenile and Domestic Relations District <span class=\"dictionary\">Courts<\/span>&#8217; Case Management System involving (i) children alleged to be abused or neglected, including (a) the number of <span class=\"dictionary\">petitions<\/span> filed, (b) the number of cases in which an emergency removal <span class=\"dictionary\">order<\/span> was issued, (c) the number of cases in which a preliminary removal <span class=\"dictionary\">order<\/span> was issued prior to an adjudicatory hearing, (d) the number of cases in which a preliminary removal <span class=\"dictionary\">order<\/span> or a preliminary <span class=\"dictionary\">child<\/span> protective <span class=\"dictionary\">order<\/span> or both were issued at a <span class=\"dictionary\">preliminary hearing<\/span>, and (e) the number of cases in which a preliminary <span class=\"dictionary\">child<\/span> protective <span class=\"dictionary\">order<\/span> or a <span class=\"dictionary\">child<\/span> protective <span class=\"dictionary\">order<\/span> was issued other than at a <span class=\"dictionary\">preliminary hearing<\/span>; and (ii) family abuse cases, including (a) the number of family abuse emergency protective <span class=\"dictionary\">orders<\/span> issued by <span class=\"dictionary\">magistrates<\/span> and juvenile and domestic relations district <span class=\"dictionary\">courts<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Emergency protective orders authorized in certain cases; penalty\" href=\"\/16.1-253.4\/\">16.1-253.4<\/a>, (b) the number of family abuse protective <span class=\"dictionary\">petitions<\/span> filed, and (c) the number of family abuse protective <span class=\"dictionary\">orders<\/span> issued pursuant to &#xA7; <a class=\"law\" title=\"Protective order in cases of family abuse\" href=\"\/16.1-279.1\/\">16.1-279.1<\/a>.\n\t\t\t\tInformation required to be reported pursuant to subdivisions 1 through 5 shall be reported annually in a format approved by the Department of <span class=\"dictionary\">Social Services<\/span> and aggregated by locality. <a id=\"paragraph-218492\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1530\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Data collected pursuant to subsection B shall be made available to the public on a website established and maintained by the Department and shall also be made readily available to the public in print format. Information included in the System shall be presented in such a manner that no individual identifying information shall be included. <a id=\"paragraph-218493\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1530\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nVIRGINIA CHILD PROTECTION ACCOUNTABILITY SYSTEM (\u00a7 63.2-1530)\n\nA. The Virginia Child Protection Accountability System (the System) is created\nto collect and make available to the public information on the response to\nreported cases of child abuse and neglect in the Commonwealth. The Department\nshall establish and maintain the System. The Board shall promulgate regulations\nto implement the provisions of this section.\n\nB. The following information shall, notwithstanding any state law regarding\nprivacy or confidentiality of records, be included in the System and made\navailable to the public via a website maintained by the Department and in print\nformat:\n\n   1. From the Department: (i) the total number of complaints alleging child\n   abuse, neglect, or a combination thereof received; (ii) the total number of\n   complaints deemed valid pursuant to &#xA7; 63.2-1508; (iii) the total number\n   of complaints investigated by the Department pursuant to subsection I of\n   &#xA7;&#xA7; 63.2-1503 and 63.2-1505; (iv) the total number of cases\n   determined to be founded cases of abuse or neglect; and (v) the total number\n   of cases resulting in a finding that the complaint was founded resulting in\n   administrative appeal. Information reported pursuant to clause (v) shall be\n   reported by total number of appeals to the local department, total number of\n   appeals to the Department, and total number of appeals by outcome of the\n   appeal. For each category of information required by this subdivision, the\n   Department shall also report the total number of cases by type of abuse; by\n   gender, age, and race of the alleged victim; and by the nature of the\n   relationship between the alleged victim and alleged abuser.\n\n   2. From the Department of State Police, annually, in a format approved by the\n   Department of Social Services, arrest and disposition statistics for\n   violations of &#xA7;&#xA7; 18.2-48, 18.2-61, 18.2-63, 18.2-64.1, 18.2-67.1,\n   18.2-67.2, 18.2-67.3, 18.2-67.4, 18.2-355, 18.2-361, 18.2-366, 18.2-370\n   through 18.2-370.2, 18.2-371, 18.2-371.1, 18.2-374.1, 18.2-374.1:1,\n   18.2-374.3, 18.2-387, and 40.1-103 for inclusion in the Child Protection\n   Accountability System.\n\n   3. From every circuit court in the Commonwealth for which data is available\n   through the statewide Case Management System: (i) the total number of (a)\n   misdemeanor convictions appealed from the district court to the circuit court,\n   (b) felony charges certified from the district court to the circuit court, and\n   (c) charges brought by direct indictment in the circuit court that involve a\n   violation of any Code section set forth in subdivision 2; (ii) the total\n   number of cases appealed, certified, or transferred to the court or brought by\n   direct indictment in the circuit court involving a violation of any Code\n   section set forth in subdivision 2 that result in a trial, including the\n   number of bench trials and the number of jury trials; and (iii) the total\n   number of trials involving a violation of any Code section set forth in\n   subdivision 2 resulting in (a) a plea agreement, (b) transfer to another\n   court, (c) a finding of not guilty, (d) conviction on a lesser included\n   offense, or (e) conviction on all charges, by type of trial.\n\n   4. From the Virginia Criminal Sentencing Commission, information on sentences\n   imposed for offenses listed in subdivision 2, including (i) the name of the\n   sentencing judge, (ii) the offense or offenses for which a sentence was\n   imposed, (iii) the age of the victim and offender, (iv) the relationship\n   between the victim and the offender, (v) the locality in which the offense\n   occurred, (vi) the sentence imposed and the actual time served, (vii) whether\n   the sentence was an upward or downward departure from the sentencing\n   guidelines or within the sentencing guidelines, and (viii) the reasons given\n   for the departure, if any, from the sentencing guidelines.\n\n   5. From the Office of the Executive Secretary of the Supreme Court of\n   Virginia, information by locality on cases from the Juvenile and Domestic\n   Relations District Courts&#8217; Case Management System involving (i) children\n   alleged to be abused or neglected, including (a) the number of petitions\n   filed, (b) the number of cases in which an emergency removal order was issued,\n   (c) the number of cases in which a preliminary removal order was issued prior\n   to an adjudicatory hearing, (d) the number of cases in which a preliminary\n   removal order or a preliminary child protective order or both were issued at a\n   preliminary hearing, and (e) the number of cases in which a preliminary child\n   protective order or a child protective order was issued other than at a\n   preliminary hearing; and (ii) family abuse cases, including (a) the number of\n   family abuse emergency protective orders issued by magistrates and juvenile\n   and domestic relations district courts pursuant to &#xA7; 16.1-253.4, (b) the\n   number of family abuse protective petitions filed, and (c) the number of\n   family abuse protective orders issued pursuant to &#xA7; 16.1-279.1.\n   \t\t\t\tInformation required to be reported pursuant to subdivisions 1 through 5\n   shall be reported annually in a format approved by the Department of Social\n   Services and aggregated by locality.\n\nC.
