A volunteer may receive a small stipend for personal expenses.B\n\nAny facility seeking to operate as a life-sharing community shall file with the Commissioner: (i) a statement of intent to operate as a life-sharing community; (ii) a certification that at the time of admission, a contract and written notice was provided to each resident and his legally authorized representative that includes a statement of disclosure that the facility is exempt from licensure as an &#8220;assisted living facility,&#8221; and (iii) documentary evidence that such life-sharing community is a private nonprofit organization in accordance with 501(c)(3) of the Internal Revenue Code of 1954, as amended.C\n\nUpon filing an initial statement of intent to operate as a life-sharing community, and every two years thereafter, the life-sharing community shall certify that the local health department, building inspector, fire marshal, or other local official designated by the locality to enforce the Statewide Fire Prevention Code, and any other local official required by law to inspect the premises, have inspected the physical facilities of the life-sharing community and have determined that the facility is in compliance with all applicable laws and regulations with regard to food service activities, health and sanitation, water supply, building codes, and the Statewide Fire Prevention Code and the Uniform Statewide Building Code.D\n\nUpon filing an initial statement of intent to operate as a life-sharing community, and every two years thereafter, the life-sharing community shall provide the Commissioner documentary evidence that:1\n\nLife-sharing community staff and volunteers have completed a training program that includes instruction in personal care of residents, house management, and therapeutic activities;2\n\nVolunteers and staff have completed first aid and Cardio-Pulmonary Resuscitation training;3\n\nEach resident&#8217;s needs are evaluated using the Uniform Assessment Instrument, and Individual Service Plans are developed for each resident annually;4\n\nThe residents of the life-sharing community are each 21 years of age or older;5\n\nA criminal background check through the Criminal Records Exchange has been completed for each (i) full-time salaried staff member and (ii) volunteer as defined in this section.E\n\nA residential facility operating as a life-sharing facility shall be exempt from the licensing requirements of Article 1 (&#xA7; 63.2-1800 et seq.) of Chapter 18 of Title 63.2 applicable to assisted living facilities.F\n\nThe Commissioner may perform unannounced on-site inspections of a life-sharing community to determine compliance with the provisions of this section and to investigate any complaint that the life-sharing community is not in compliance with the provisions of this section, or to otherwise ensure the health, safety, and welfare of the life-sharing community residents. The Commissioner may revoke the exemption from licensure pursuant to this chapter for any life-sharing community for serious or repeated violation of the requirements of this section and order that the facility cease operations or comply with the licensure requirements of an assisted living facility. If a life-sharing community does not file the statement and documentary evidence required by this section, the Commissioner shall give reasonable notice to such life-sharing community of the nature of its noncompliance and may thereafter take action as he determines appropriate, including a suit to enjoin the operation of the life-sharing community.G\n\nAll life-sharing communities shall provide access to their facilities and residents by staff of community services boards and behavioral health authorities as defined in &#xA7; 37.2-100 for the purpose of (i) assessing or evaluating, (ii) providing case management or other services or assistance, or (iii) monitoring the care of individuals receiving services who are residing in the facility. and (iii) documentary <span class=\"dictionary\">evidence<\/span> that such <span class=\"dictionary\">life-sharing community<\/span> is a private nonprofit organization in accordance with 501(c)(3) of the Internal Revenue Code of 1954, as amended. <a id=\"paragraph-246785\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Upon filing an initial statement of <span class=\"dictionary\">intent<\/span> to operate as a <span class=\"dictionary\">life-sharing community<\/span>, and every two years thereafter, the <span class=\"dictionary\">life-sharing community<\/span> shall certify that the local health <span class=\"dictionary\">department<\/span>, building inspector, fire marshal, or other local official designated by the locality to enforce the Statewide Fire Prevention Code, and any other local official required by <span class=\"dictionary\">law<\/span> to inspect the premises, have inspected the physical facilities of the <span class=\"dictionary\">life-sharing community<\/span> and have determined that the facility is in compliance with all applicable <span class=\"dictionary\">laws<\/span> and regulations with regard to food service activities, health and sanitation, water supply, building codes, and the Statewide Fire Prevention Code and the Uniform Statewide Building Code. <a id=\"paragraph-246786\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Upon filing an initial statement of <span class=\"dictionary\">intent<\/span> to operate as a <span class=\"dictionary\">life-sharing community<\/span>, and every two years thereafter, the <span class=\"dictionary\">life-sharing community<\/span> shall provide the <span class=\"dictionary\">Commissioner<\/span> documentary <span class=\"dictionary\">evidence<\/span> that: <a id=\"paragraph-246787\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> <span class=\"dictionary\">Life-sharing community<\/span> staff and <span class=\"dictionary\">volunteers<\/span> have completed a training program that includes instruction in personal care of <span class=\"dictionary\">residents<\/span>, house management, and therapeutic activities; <a id=\"paragraph-246788\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> <span class=\"dictionary\">Volunteers<\/span> and staff have completed first aid and Cardio-Pulmonary Resuscitation training; <a id=\"paragraph-246789\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Each <span class=\"dictionary\">resident<\/span>&#8217;s needs are evaluated using the Uniform Assessment Instrument, and Individual Service Plans are developed for each <span class=\"dictionary\">resident<\/span> annually; <a id=\"paragraph-246790\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> The <span class=\"dictionary\">residents<\/span> of the <span class=\"dictionary\">life-sharing community<\/span> are each 21 years of age or older; <a id=\"paragraph-246791\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#D4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> A criminal background check through the Criminal Records Exchange has been completed for each (i) full-time salaried staff member and (ii) <span class=\"dictionary\">volunteer<\/span> as defined in this section. <a id=\"paragraph-246792\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#D5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> A residential facility operating as a life-sharing facility shall be exempt from the licensing requirements of Article 1 (&#xA7; <a class=\"law\" title=\"Licensure requirements\" href=\"\/63.2-1800\/\">63.2-1800<\/a> et seq.) of Chapter 18 of Title 63.2 applicable to assisted living facilities. <a id=\"paragraph-246793\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The <span class=\"dictionary\">Commissioner<\/span> may perform unannounced on-site inspections of a <span class=\"dictionary\">life-sharing community<\/span> to determine compliance with the provisions of this section and to investigate any complaint that the <span class=\"dictionary\">life-sharing community<\/span> is not in compliance with the provisions of this section, or to otherwise ensure the health, safety, and welfare of the <span class=\"dictionary\">life-sharing community<\/span> <span class=\"dictionary\">residents<\/span>. The <span class=\"dictionary\">Commissioner<\/span> may revoke the exemption from licensure pursuant to this chapter for any <span class=\"dictionary\">life-sharing community<\/span> for serious or repeated violation of the requirements of this section and <span class=\"dictionary\">order<\/span> that the facility cease operations or comply with the licensure requirements of an <span class=\"dictionary\">assisted living facility<\/span>. If a <span class=\"dictionary\">life-sharing community<\/span> does not file the statement and documentary <span class=\"dictionary\">evidence<\/span> required by this section, the <span class=\"dictionary\">Commissioner<\/span> shall give reasonable notice to such <span class=\"dictionary\">life-sharing community<\/span> of the nature of its noncompliance and may thereafter take action as he determines appropriate, including a suit to enjoin the operation of the <span class=\"dictionary\">life-sharing community<\/span>. <a id=\"paragraph-246794\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> All life-sharing communities shall provide access to their facilities and <span class=\"dictionary\">residents<\/span> by staff of <span class=\"dictionary\">community services<\/span> <span class=\"dictionary\">boards<\/span> and behavioral health authorities as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/37.2-100\/\">37.2-100<\/a> for the purpose of (i) assessing or evaluating, (ii) providing case management or other services or assistance, or (iii) monitoring the care of individuals receiving services who are residing in the facility. Such staff or contractual agents also shall be given reasonable access to other facility <span class=\"dictionary\">residents<\/span> who have previously requested their services. <a id=\"paragraph-246795\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> Any <span class=\"dictionary\">residents<\/span> of any <span class=\"dictionary\">life-sharing community<\/span> shall be accorded the same rights and responsibilities as <span class=\"dictionary\">residents<\/span> in assisted living facilities as provided in subsections A through F of &#xA7; <a class=\"law\" title=\"Rights and responsibilities of residents of assisted living facilities; certification of licensure\" href=\"\/63.2-1808\/\">63.2-1808<\/a>. <a id=\"paragraph-246796\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> A <span class=\"dictionary\">life-sharing community<\/span> shall not admit or retain individuals with any of the conditions or care needs as provided in subsection C of &#xA7; <a class=\"law\" title=\"Admissions and discharge; mandatory minimum liability insurance\" href=\"\/63.2-1805\/\">63.2-1805<\/a>. <a id=\"paragraph-246797\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> Notwithstanding &#xA7; <a class=\"law\" title=\"Admissions and discharge; mandatory minimum liability insurance\" href=\"\/63.2-1805\/\">63.2-1805<\/a>, at the request of the <span class=\"dictionary\">resident<\/span>, hospice care may be provided in a <span class=\"dictionary\">life-sharing community<\/span> under the same requirements for hospice programs provided in Article 7 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/32.1-162.1\/\">32.1-162.1<\/a> et seq.) of Chapter 5 of Title 32.1 if the hospice program determines that such a program is appropriate for the <span class=\"dictionary\">resident<\/span>. <a id=\"paragraph-246798\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-1808.1\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nLIFE-SHARING COMMUNITIES (\u00a7 63.2-1808.1)\n\nA. For the purposes of this section:\n\t\t\t&#8220;Life-sharing community&#8221; means a residential setting, operated by\na nonprofit organization, that (i) offers a safe environment in free standing,\nself-contained homes for residents that have been determined by a licensed\nhealth-care professional as having at least one developmental disability; (ii)\nis an environment located in a community setting where residents participate in\ntherapeutic activities including artistic crafts, stewardship of the land, and\nagricultural activities; (iii) consists of the residents as well as staff and\nvolunteers who live together in residential homes; (iv) operates at a ratio of\nat least one staff member, volunteer, or supervising personnel for every three\nresidents in each self-contained home household; and (v) has at least one\nsupervisory staff member on premises to be responsible for the care, safety, and\nsupervision of the residents at all times.\n\t\t\t&#8220;Resident&#8221; means an individual who has been determined by a\nphysician or an advanced practice registered nurse to have at least one\ndevelopmental disability and who resides at the life-sharing community on a\nfull-time basis.\n\t\t\t&#8220;Volunteer&#8221; means an individual who resides in the life-sharing\ncommunity on a full-time basis and who assists residents with their daily\nactivities and receives no wages. A volunteer may receive a small stipend for\npersonal expenses.\n\nB. Any facility seeking to operate as a life-sharing community shall file with\nthe Commissioner: (i) a statement of intent to operate as a life-sharing\ncommunity; (ii) a certification that at the time of admission, a contract and\nwritten notice was provided to each resident and his legally authorized\nrepresentative that includes a statement of disclosure that the facility is\nexempt from licensure as an &#8220;assisted living facility,&#8221; and (iii)\ndocumentary evidence that such life-sharing community is a private nonprofit\norganization in accordance with 501(c)(3) of the Internal Revenue Code of 1954,\nas amended.\n\nC. Upon filing an initial statement of intent to operate as a life-sharing\ncommunity, and every two years thereafter, the life-sharing community shall\ncertify that the local health department, building inspector, fire marshal, or\nother local official designated by the locality to enforce the Statewide Fire\nPrevention Code, and any other local official required by law to inspect the\npremises, have inspected the physical facilities of the life-sharing community\nand have determined that the facility is in compliance with all applicable laws\nand regulations with regard to food service activities, health and sanitation,\nwater supply, building codes, and the Statewide Fire Prevention Code and the\nUniform Statewide Building Code.\n\nD. Life-sharing community staff and volunteers have completed a training\n   program that includes instruction in personal care of residents, house\n   management, and therapeutic activities;\n\n   2. Volunteers and staff have completed first aid and Cardio-Pulmonary\n   Resuscitation training;\n\n   3. Each resident&#8217;s needs are evaluated using the Uniform Assessment\n   Instrument, and Individual Service Plans are developed for each resident\n   annually;\n\n   4. The residents of the life-sharing community are each 21 years of age or\n   older;\n\n   5. A criminal background check through the Criminal Records Exchange has been\n   completed for each (i) full-time salaried staff member and (ii) volunteer as\n   defined in this section.\n\nE. All life-sharing communities shall provide access to their facilities and\nresidents by staff of community services boards and behavioral health\nauthorities as defined in &#xA7; 37.2-100 for the purpose of (i) assessing or\nevaluating, (ii) providing case management or other services or assistance, or\n(iii) monitoring the care of individuals receiving services who are residing in\nthe facility. Such staff or contractual agents also shall be given reasonable\naccess to other facility residents who have previously requested their services.\n\nH. Any residents of any life-sharing community shall be accorded the same rights\nand responsibilities as residents in assisted living facilities as provided in\nsubsections A through F of &#xA7; 63.2-1808.\n\nI. A life-sharing community shall not admit or retain individuals with any of\nthe conditions or care needs as provided in subsection C of &#xA7; 63.2-1805.\n\nJ.
