If the applicant fails to respond within 10 days of the date of such notice, the local director shall deny the application for public assistance. If the applicant responds within 10 days of such notice, upon receipt of such response, the local director shall conduct such further investigation as may be necessary to verify the applicant&#8217;s response and resolve the discrepancy or other issue arising from comparing the information provided by the applicant with information obtained as a result of the investigation required by subsection A. If the local director determines that the information obtained as a result of the investigation required by subsection A is accurate, and that as a result the applicant is ineligible for public assistance, the local director shall so notify the applicant and public assistance shall be denied. In any case in which the local director believes that the applicant has obtained or attempted to obtain public assistance by means of willful false statements or representations, impersonation, or other fraudulent devices, the local director shall initiate a fraud investigation pursuant to &#xA7; 63.2-526.D\n\nThe Department shall establish a means to obtain and provide the data necessary for the local departments to conduct the search required by subsection B in an automated electronic format. In doing so, the Department may use a third-party contractor. The <span class=\"dictionary\">local department<\/span> shall immediately take action upon obtaining information indicating a change in a recipient&#8217;s circumstances that could warrant reconsideration, cancellation, or changes in the amount of <span class=\"dictionary\">public assistance<\/span> paid to the recipient in accordance with the provisions of &#xA7; <a class=\"law\" title=\"Reconsideration or changes in amount of public assistance; cancellation\" href=\"\/63.2-514\/\">63.2-514<\/a>. <a id=\"paragraph-281007\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-503\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The Department shall report to the General Assembly no later than December 1 of each year the following: <a id=\"paragraph-281008\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-503\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Which specific types or sources of information <span class=\"dictionary\">local directors<\/span> used, either directly or through a third-<span class=\"dictionary\">party<\/span> contractor, during the past year for the purpose of verifying applicants&#8217; identity, income, <span class=\"dictionary\">assets<\/span>, and other information pursuant to subsection B; and <a id=\"paragraph-281009\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-503\/#E1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Any types or sources of information that the Department plans to make available to <span class=\"dictionary\">local directors<\/span> to use in the future to verify applicants&#8217; identity, income, <span class=\"dictionary\">assets<\/span>, and other information and the approximate date on which the <span class=\"dictionary\">local directors<\/span> plan to begin using those types or sources of information. <a id=\"paragraph-281010\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-503\/#E2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The Department shall include in its report required pursuant to subsection E the number of applications for <span class=\"dictionary\">public assistance<\/span> received in accordance with this section, the number of cases in which eligibility for <span class=\"dictionary\">public assistance<\/span> was approved or denied, and the number of cases referred for investigation and the reasons in each case. <a id=\"paragraph-281011\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-503\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> The <span class=\"dictionary\">Board<\/span> may by regulation authorize the <span class=\"dictionary\">local directors<\/span> to provide immediate and temporary assistance to persons pending action of the <span class=\"dictionary\">local departments<\/span>. <a id=\"paragraph-281012\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-503\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> In the event that any provision of this section conflicts with federal <span class=\"dictionary\">law<\/span> or regulations, provisions of federal <span class=\"dictionary\">law<\/span> shall prevail. <a id=\"paragraph-281013\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/63.2-503\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPROCEDURE UPON RECEIPT OF APPLICATION (\u00a7 63.2-503)\n\nA. Upon receipt of the application for public assistance, the local director or\nCommissioner shall make or cause to be made promptly an investigation to\ndetermine the completeness and correctness of the statements contained in the\napplication and to ascertain the facts supporting the application and such other\ninformation as the local department or the Commissioner may require to determine\nwhether an applicant is eligible for public assistance.\n\nB. In conducting the investigation required by subsection A, and only when\nconsistent with federal law and regulations, the local director shall verify\neach applicant&#8217;s identity, income, assets, and any other information\nnecessary for the purpose of determining eligibility for public assistance,\neliminating the duplication of assistance, and deterring fraud.\n\nC. In cases in which information obtained as a result of the investigation\nrequired by subsection A is inconsistent with information provided by the\napplicant at the time of application or otherwise suggests that the applicant\nmay not be eligible for public assistance, the local director shall notify the\napplicant in writing and provide opportunity for the applicant to explain the\ndiscrepancy. If the applicant fails to respond within 10 days of the date of\nsuch notice, the local director shall deny the application for public\nassistance. If the applicant responds within 10 days of such notice, upon\nreceipt of such response, the local director shall conduct such further\ninvestigation as may be necessary to verify the applicant&#8217;s response and\nresolve the discrepancy or other issue arising from comparing the information\nprovided by the applicant with information obtained as a result of the\ninvestigation required by subsection A. If the local director determines that\nthe information obtained as a result of the investigation required by subsection\nA is accurate, and that as a result the applicant is ineligible for public\nassistance, the local director shall so notify the applicant and public\nassistance shall be denied. In any case in which the local director believes\nthat the applicant has obtained or attempted to obtain public assistance by\nmeans of willful false statements or representations, impersonation, or other\nfraudulent devices, the local director shall initiate a fraud investigation\npursuant to &#xA7; 63.2-526.\n\nD. The Department shall establish a means to obtain and provide the data\nnecessary for the local departments to conduct the search required by subsection\nB in an automated electronic format. In doing so, the Department may use a\nthird-party contractor. The local department shall immediately take action upon\nobtaining information indicating a change in a recipient&#8217;s circumstances\nthat could warrant reconsideration, cancellation, or changes in the amount of\npublic assistance paid to the recipient in accordance with the provisions of\n&#xA7; 63.2-514.\n\nE. The Department shall report to the General Assembly no later than December 1\nof each year the following:\n\n   1. Which specific types or sources of information local directors used, either\n   directly or through a third-party contractor, during the past year for the\n   purpose of verifying applicants&#8217; identity, income, assets, and other\n   information pursuant to subsection B; and\n\n   2. The Department shall include in its report required pursuant to subsection E\nthe number of applications for public assistance received in accordance with\nthis section, the number of cases in which eligibility for public assistance was\napproved or denied, and the number of cases referred for investigation and the\nreasons in each case.\n\nG. The Board may by regulation authorize the local directors to provide\nimmediate and temporary assistance to persons pending action of the local\ndepartments.\n\nH.
