<a class=\"law\" title=\"Short title\" href=\"\/18.2-152.1\/\">18.2-152.1<\/a> et seq.) of Chapter 5 of Title 18.2. <a id=\"paragraph-264083\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-129\/#E2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> A <span class=\"dictionary\">custodian<\/span> may disclose <span class=\"dictionary\">information<\/span> in an <span class=\"dictionary\">account<\/span> to a <span class=\"dictionary\">fiduciary<\/span> of the <span class=\"dictionary\">user<\/span> when the <span class=\"dictionary\">information<\/span> is required to terminate an <span class=\"dictionary\">account<\/span> used to access <span class=\"dictionary\">digital assets<\/span> licensed to the <span class=\"dictionary\">user<\/span>. <a id=\"paragraph-264084\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-129\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> A <span class=\"dictionary\">fiduciary<\/span> of a <span class=\"dictionary\">user<\/span> may request a <span class=\"dictionary\">custodian<\/span> to terminate the <span class=\"dictionary\">user<\/span>&#8217;s <span class=\"dictionary\">account<\/span>. A request for termination shall be in writing, in either physical or <span class=\"dictionary\">electronic<\/span> form, and accompanied by: <a id=\"paragraph-264085\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-129\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> If the <span class=\"dictionary\">user<\/span> is deceased, a certified copy of the death certificate of the <span class=\"dictionary\">user<\/span>; <a id=\"paragraph-264086\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-129\/#G1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> A certified copy of the letter of appointment of the representative or a small-estate <span class=\"dictionary\">affidavit<\/span> or <span class=\"dictionary\">court order<\/span>, <span class=\"dictionary\">court order<\/span>, <span class=\"dictionary\">power of attorney<\/span>, or trust giving the <span class=\"dictionary\">fiduciary<\/span> authority over the <span class=\"dictionary\">account<\/span>; and <a id=\"paragraph-264087\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-129\/#G2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> If requested by the <span class=\"dictionary\">custodian<\/span>:\n\t\t\t\ta. A number, username, address, or other unique subscriber or <span class=\"dictionary\">account<\/span> identifier assigned by the <span class=\"dictionary\">custodian<\/span> to identify the <span class=\"dictionary\">user<\/span>&#8217;s <span class=\"dictionary\">account<\/span>;\n\t\t\t\tb. <span class=\"dictionary\">Evidence<\/span> linking the <span class=\"dictionary\">account<\/span> to the <span class=\"dictionary\">user<\/span>; or\n\t\t\t\tc. A <span class=\"dictionary\">finding<\/span> by the court that the <span class=\"dictionary\">user<\/span> had a specific <span class=\"dictionary\">account<\/span> with the <span class=\"dictionary\">custodian<\/span>, identifiable by the <span class=\"dictionary\">information<\/span> specified in subdivision a. <a id=\"paragraph-264088\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-129\/#G3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nFIDUCIARY DUTY AND AUTHORITY (\u00a7 64.2-129)\n\nA. The legal duties imposed on a fiduciary charged with managing tangible\nproperty apply to the management of digital assets, including:\n\n   1. The duty of care;\n\n   2. The duty of loyalty; and\n\n   3. The duty of confidentiality.\n\nB. A fiduciary&#8217;s or designated recipient&#8217;s authority with respect to\na digital asset of a user:\n\n   1. Except as otherwise provided in &#xA7; 64.2-118, is subject to the\n   applicable terms-of-service agreement;\n\n   2. Is subject to other applicable law, including copyright law;\n\n   3. In the case of a fiduciary, is limited by the scope of the\n   fiduciary&#8217;s duties; and\n\n   4. May not be used to impersonate the user.\n\nC. A fiduciary with authority over the property of a decedent, protected person,\nprincipal, or settlor has the right to access any digital asset in which the\ndecedent, protected person, principal, or settlor had a right or interest and\nthat is not held by a custodian or subject to a terms-of-service agreement.\n\nD. A fiduciary acting within the scope of the fiduciary&#8217;s duties is an\nauthorized user of the property of the decedent, protected person, principal, or\nsettlor for the purpose of applicable computer-fraud and unauthorized\ncomputer-access laws, including Article 7.1 (&#xA7; 18.2-152.1 et seq.) of\nChapter 5 of Title 18.2.\n\nE. A fiduciary with authority over the tangible personal property of a decedent,\nprotected person, principal, or settlor:\n\n   1. Has the right to access the property and any digital asset stored in it;\n   and\n\n   2. Is an authorized user for the purposes of computer-fraud and unauthorized\n   computer-access laws, including Article 7.1 (&#xA7; 18.2-152.1 et seq.) of\n   Chapter 5 of Title 18.2.\n\nF. A custodian may disclose information in an account to a fiduciary of the user\nwhen the information is required to terminate an account used to access digital\nassets licensed to the user.\n\nG. A fiduciary of a user may request a custodian to terminate the user&#8217;s\naccount. A request for termination shall be in writing, in either physical or\nelectronic form, and accompanied by:\n\n   1. If the user is deceased, a certified copy of the death certificate of the\n   user;\n\n   2. A certified copy of the letter of appointment of the representative or a\n   small-estate affidavit or court order, court order, power of attorney, or\n   trust giving the fiduciary authority over the account; and\n\n   3. If requested by the custodian:\n   \t\t\t\ta. A number, username, address, or other unique subscriber or account\n   identifier assigned by the custodian to identify the user&#8217;s account;\n   \t\t\t\tb. Evidence linking the account to the user; or\n   \t\t\t\tc.
