<a class=\"law\" title=\"Financial exploitation by an agent; penalty\" href=\"\/18.2-178.2\/\">18.2-178.2<\/a>; or <a id=\"paragraph-308763\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-1608\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> The <span class=\"dictionary\">power of attorney<\/span> terminates. <a id=\"paragraph-308764\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-1608\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Unless the <span class=\"dictionary\">power of attorney<\/span> otherwise provides, an <span class=\"dictionary\">agent<\/span>&#8217;s authority is exercisable until the authority terminates under subsection B, notwithstanding a lapse of time since the execution of the <span class=\"dictionary\">power of attorney<\/span>. <a id=\"paragraph-308765\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-1608\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Termination of an <span class=\"dictionary\">agent<\/span>&#8217;s authority or of a <span class=\"dictionary\">power of attorney<\/span> is not effective as to the <span class=\"dictionary\">agent<\/span> or another <span class=\"dictionary\">person<\/span> that, without actual knowledge of the termination, acts in <span class=\"dictionary\">good faith<\/span> under the <span class=\"dictionary\">power of attorney<\/span>. An act so performed, unless otherwise invalid or unenforceable, binds the <span class=\"dictionary\">principal<\/span> and the <span class=\"dictionary\">principal<\/span>&#8217;s successors in interest. <a id=\"paragraph-308766\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-1608\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> <span class=\"dictionary\">Incapacity<\/span> of the <span class=\"dictionary\">principal<\/span> of a <span class=\"dictionary\">power of attorney<\/span> that is not durable does not revoke or terminate the <span class=\"dictionary\">power of attorney<\/span> as to an <span class=\"dictionary\">agent<\/span> or other <span class=\"dictionary\">person<\/span> that, without actual knowledge of the <span class=\"dictionary\">incapacity<\/span>, acts in <span class=\"dictionary\">good faith<\/span> under the <span class=\"dictionary\">power of attorney<\/span>. An act so performed, unless otherwise invalid or unenforceable, binds the <span class=\"dictionary\">principal<\/span> and the <span class=\"dictionary\">principal<\/span>&#8217;s successors in interest. <a id=\"paragraph-308767\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-1608\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The execution of a <span class=\"dictionary\">power of attorney<\/span> does not revoke a <span class=\"dictionary\">power of attorney<\/span> previously executed by the <span class=\"dictionary\">principal<\/span> unless the subsequent <span class=\"dictionary\">power of attorney<\/span> provides that the previous <span class=\"dictionary\">power of attorney<\/span> is revoked or that all other powers of attorney are revoked. <a id=\"paragraph-308768\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-1608\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nTERMINATION OF POWER OF ATTORNEY OR AGENT&#8217;S AUTHORITY (\u00a7 64.2-1608)\n\nA. A power of attorney terminates when:\n\n   1. The principal dies;\n\n   2. The principal becomes a vulnerable adult, if the power of attorney is not\n   durable;\n\n   3. The principal revokes the power of attorney;\n\n   4. The power of attorney provides that it terminates;\n\n   5. The purpose of the power of attorney is accomplished; or\n\n   6. The principal revokes the agent&#8217;s authority or the agent dies,\n   becomes a vulnerable adult, or resigns, and the power of attorney does not\n   provide for another agent to act under the power of attorney.\n\nB. An agent&#8217;s authority terminates when:\n\n   1. The principal revokes the authority;\n\n   2. The agent dies, becomes a vulnerable adult, or resigns;\n\n   3. Unless the power of attorney otherwise provides, an action is filed (i) for\n   the divorce or annulment of the agent&#8217;s marriage to the principal or\n   their legal separation, (ii) by either the agent or principal for separate\n   maintenance from the other, or (iii) by either the agent or principal for\n   custody or visitation of a child in common with the other;\n\n   4. The agent is convicted of financial exploitation of the principal under\n   &#xA7; 18.2-178.2; or\n\n   5. The power of attorney terminates.\n\nC. Unless the power of attorney otherwise provides, an agent&#8217;s authority\nis exercisable until the authority terminates under subsection B,\nnotwithstanding a lapse of time since the execution of the power of attorney.\n\nD. Termination of an agent&#8217;s authority or of a power of attorney is not\neffective as to the agent or another person that, without actual knowledge of\nthe termination, acts in good faith under the power of attorney.
