After such initial annual report has been filed, the second and subsequent annual reports for each succeeding 12-month period shall be due within four months from the last day of the 12-month period covered by the previous annual report. The annual report shall be on a form prepared by the Office of the Executive Secretary of the Supreme Court and shall be accompanied by a filing fee of $5. To the extent practicable, the annual report shall be formatted in a manner to encourage standardized and detailed responses from guardians. The local department shall retain the fee in the jurisdiction where the fee is collected for use in the provision of services to adults in need of protection. Within 60 days of receipt of the annual report, the local department shall file a copy of the annual report with the clerk of the circuit court that appointed the guardian, to be placed with the court papers pertaining to the guardianship case. Twice each year the local department shall file with the clerk of the circuit court a list of all guardians who are more than 90 days delinquent in filing an annual report as required by this section. If the guardian is also a conservator, a settlement of accounts shall also be filed with the commissioner of accounts as provided in &#xA7; 64.2-1305.B\n\nThe annual report to the local department of social services shall include:1\n\nA description of the current mental, physical, and social condition of the incapacitated person, including any change in diagnosis or assessment of any such condition of such incapacitated person by any medical provider since the last report;2\n\nA description of the incapacitated person&#8217;s living arrangements during the reported period, including a specific assessment of the adequacy of such living arrangement;3\n\nThe medical, educational, vocational, social, recreational, and any other professional services and activities provided to the incapacitated person and the guardian&#8217;s opinion as to the adequacy of the incapacitated person&#8217;s care. The information required by this subdivision shall include (i) the specific names of the medical providers that have treated the incapacitated person and a description of the frequency or number of times the incapacitated person was seen by such providers; (ii) the date and location of and reason for any hospitalization of such incapacitated person; and (iii) a description of the educational, vocational, social, and recreational activities in which such incapacitated person participated;4\n\nA statement of whether the guardian agrees with the current treatment or habilitation plan;5\n\nA statement of whether the incapacitated person has been an alleged victim in a report of abuse, neglect, or exploitation made pursuant to Article 2 (&#xA7; 63.2-1603 et seq.) of Chapter 16 of Title 63.2, to the extent known, and whether there are any other indications of abuse, neglect, or exploitation of such incapacitated person;6\n\nA recommendation as to the need for continued guardianship and any recommended changes in the scope of the guardianship;7\n\nThe name of any persons whose access to communicate, visit, or interact with the incapacitated person has been restricted and the reasons for such restriction;8\n\nA self-assessment by the guardian as to whether he feels he is able to continue to carry out the powers and duties imposed upon him by &#xA7; 64.2-2019 and as specified in the court&#8217;s order of appointment pursuant to &#xA7; 64.2-2009;9\n\nA statement as to whether the guardian and any skilled professional retained by such guardian to perform guardianship duties on behalf of the guardian have completed the training required by subsection E1 of &#xA7; 64.2-2019;10\n\nUnless the incapacitated person resides with the guardian, a statement of the frequency and nature of any (i) in-person visits from the guardian with the incapacitated person over the course of the previous year and (ii) visits over the course of the previous year from a designee who is directly supervised or contracted by the guardian, including the name of the designee performing such visit. If any visit described in this section is made virtually, the guardian shall include such information in the annual report;11\n\nIf no visit is made within a 120-day period, the guardian shall describe any challenges or limitations in completing such visit;12\n\nA general description of the activities taken on by the guardian for the benefit of the incapacitated person during the past year;13\n\nAny other information deemed necessary by the Office of the Executive Secretary of the Supreme Court of Virginia or the Department for Aging and Rehabilitative Services to understand the condition, treatment, and well-being of the incapacitated person;14\n\nAny other information useful in the opinion of the guardian; and15\n\nThe compensation requested and the reasonable and necessary expenses incurred by the guardian.\n\t\t\t\tThe guardian shall certify by signing under oath that the information contained in the annual report is true and correct to the best of his knowledge. If a guardian makes a false entry or statement in the annual report, he shall be subject to a civil penalty of not more than $600. The <span class=\"dictionary\">annual report<\/span> shall be on a form prepared by the Office of the Executive Secretary of the Supreme <span class=\"dictionary\">Court<\/span> and shall be accompanied by a filing fee of $5. To the extent practicable, the <span class=\"dictionary\">annual report<\/span> shall be formatted in a manner to encourage standardized and detailed responses from <span class=\"dictionary\">guardians<\/span>. The local department shall retain the fee in the <span class=\"dictionary\">jurisdiction<\/span> where the fee is collected for use in the provision of services to adults in need of protection. Within 60 days of receipt of the <span class=\"dictionary\">annual report<\/span>, the local department shall file a copy of the <span class=\"dictionary\">annual report<\/span> with the clerk of the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> that appointed the <span class=\"dictionary\">guardian<\/span>, to be placed with the <span class=\"dictionary\">court<\/span> papers pertaining to the guardianship case. Twice each year the local department shall file with the clerk of the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> a list of all <span class=\"dictionary\">guardians<\/span> who are more than 90 days delinquent in filing an <span class=\"dictionary\">annual report<\/span> as required by this section. If the <span class=\"dictionary\">guardian<\/span> is also a <span class=\"dictionary\">conservator<\/span>, a <span class=\"dictionary\">settlement<\/span> of accounts shall also be filed with the commissioner of accounts as provided in &#xA7; <a class=\"law\" title=\"Conservators, guardians of minors&#039; estates, committees, trustees under \u00a7 64.2-2016, and receivers\" href=\"\/64.2-1305\/\">64.2-1305<\/a>. <a id=\"paragraph-214557\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The <span class=\"dictionary\">annual report<\/span> to the local department of social services shall include: <a id=\"paragraph-214558\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> A description of the current mental, physical, and social condition of the <span class=\"dictionary\">incapacitated person<\/span>, including any change in diagnosis or assessment of any such condition of such <span class=\"dictionary\">incapacitated person<\/span> by any medical provider since the last report; <a id=\"paragraph-214559\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> A description of the <span class=\"dictionary\">incapacitated person<\/span>&#8217;s living arrangements during the reported period, including a specific assessment of the adequacy of such living arrangement; <a id=\"paragraph-214560\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The medical, educational, vocational, social, recreational, and any other professional services and activities provided to the <span class=\"dictionary\">incapacitated person<\/span> and the <span class=\"dictionary\">guardian<\/span>&#8217;s <span class=\"dictionary\">opinion<\/span> as to the adequacy of the <span class=\"dictionary\">incapacitated person<\/span>&#8217;s care. The information required by this subdivision shall include (i) the specific names of the medical providers that have treated the <span class=\"dictionary\">incapacitated person<\/span> and a description of the frequency or number of times the <span class=\"dictionary\">incapacitated person<\/span> was seen by such providers; (ii) the date and location of and reason for any hospitalization of such <span class=\"dictionary\">incapacitated person<\/span>; and (iii) a description of the educational, vocational, social, and recreational activities in which such <span class=\"dictionary\">incapacitated person<\/span> participated; <a id=\"paragraph-214561\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> A statement of whether the <span class=\"dictionary\">guardian<\/span> agrees with the current treatment or habilitation plan; <a id=\"paragraph-214562\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> A statement of whether the <span class=\"dictionary\">incapacitated person<\/span> has been an alleged victim in a report of abuse, neglect, or exploitation made pursuant to Article 2 (&#xA7; <a class=\"law\" title=\"Protection of adults; definitions\" href=\"\/63.2-1603\/\">63.2-1603<\/a> et seq.) of Chapter 16 of Title 63.2, to the extent known, and whether there are any other indications of abuse, neglect, or exploitation of such <span class=\"dictionary\">incapacitated person<\/span>; <a id=\"paragraph-214563\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> A recommendation as to the need for continued guardianship and any recommended changes in the scope of the guardianship; <a id=\"paragraph-214564\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> The name of any persons whose access to communicate, visit, or interact with the <span class=\"dictionary\">incapacitated person<\/span> has been restricted and the reasons for such restriction; <a id=\"paragraph-214565\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> A self-assessment by the <span class=\"dictionary\">guardian<\/span> as to whether he feels he is able to continue to carry out the powers and duties imposed upon him by &#xA7; <a class=\"law\" title=\"Duties and powers of guardian\" href=\"\/64.2-2019\/\">64.2-2019<\/a> and as specified in the <span class=\"dictionary\">court<\/span>&#8217;s <span class=\"dictionary\">order<\/span> of appointment pursuant to &#xA7; <a class=\"law\" title=\"Court order of appointment; limited guardianships and conservatorships\" href=\"\/64.2-2009\/\">64.2-2009<\/a>; <a id=\"paragraph-214566\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> A statement as to whether the <span class=\"dictionary\">guardian<\/span> and any skilled professional retained by such <span class=\"dictionary\">guardian<\/span> to perform guardianship duties on behalf of the <span class=\"dictionary\">guardian<\/span> have completed the training required by subsection E1 of &#xA7; <a class=\"law\" title=\"Duties and powers of guardian\" href=\"\/64.2-2019\/\">64.2-2019<\/a>; <a id=\"paragraph-214567\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Unless the <span class=\"dictionary\">incapacitated person<\/span> resides with the <span class=\"dictionary\">guardian<\/span>, a statement of the frequency and nature of any (i) in-person visits from the <span class=\"dictionary\">guardian<\/span> with the <span class=\"dictionary\">incapacitated person<\/span> over the course of the previous year and (ii) visits over the course of the previous year from a designee who is directly supervised or contracted by the <span class=\"dictionary\">guardian<\/span>, including the name of the designee performing such visit. If any visit described in this section is made virtually, the <span class=\"dictionary\">guardian<\/span> shall include such information in the <span class=\"dictionary\">annual report<\/span>; <a id=\"paragraph-214568\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> If no visit is made within a 120-day period, the <span class=\"dictionary\">guardian<\/span> shall describe any challenges or limitations in completing such visit; <a id=\"paragraph-214569\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> A general description of the activities taken on by the <span class=\"dictionary\">guardian<\/span> for the benefit of the <span class=\"dictionary\">incapacitated person<\/span> during the past year; <a id=\"paragraph-214570\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> Any other information deemed necessary by the Office of the Executive Secretary of the Supreme <span class=\"dictionary\">Court<\/span> of Virginia or the Department for Aging and Rehabilitative Services to understand the condition, treatment, and well-being of the <span class=\"dictionary\">incapacitated person<\/span>; <a id=\"paragraph-214571\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> Any other information useful in the <span class=\"dictionary\">opinion<\/span> of the <span class=\"dictionary\">guardian<\/span>; and <a id=\"paragraph-214572\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B15\" class=\"indent-1\"><p><span class=\"prefix-number\">15.<\/span> The compensation requested and the reasonable and necessary expenses incurred by the <span class=\"dictionary\">guardian<\/span>.\n\t\t\t\tThe <span class=\"dictionary\">guardian<\/span> shall certify by signing under <span class=\"dictionary\">oath<\/span> that the information contained in the <span class=\"dictionary\">annual report<\/span> is true and correct to the best of his knowledge. If a <span class=\"dictionary\">guardian<\/span> makes a false entry or statement in the <span class=\"dictionary\">annual report<\/span>, he shall be subject to a civil <span class=\"dictionary\">penalty<\/span> of not more than $600. Such <span class=\"dictionary\">penalty<\/span> shall be collected by the attorney for the Commonwealth or the county or city attorney, and the proceeds shall be deposited into the general fund. <a id=\"paragraph-214573\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#B15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> If the local department of social services files notice that the <span class=\"dictionary\">annual report<\/span> has not been timely filed in accordance with subsection A with the clerk of the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span>, the <span class=\"dictionary\">court<\/span> may <span class=\"dictionary\">issue<\/span> a <span class=\"dictionary\">summons<\/span> or rule to show cause why the <span class=\"dictionary\">guardian<\/span> has failed to file such <span class=\"dictionary\">annual report<\/span>. <a id=\"paragraph-214574\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-2020\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nANNUAL REPORTS BY GUARDIANS (\u00a7 64.2-2020)\n\nA. Within six months from the date of qualification, a guardian appointed\npursuant to &#xA7; 64.2-2009 shall file an initial annual report reflecting the\nfirst four months of guardianship since qualification with the local department\nof social services for the jurisdiction where the incapacitated person then\nresides. After such initial annual report has been filed, the second and\nsubsequent annual reports for each succeeding 12-month period shall be due\nwithin four months from the last day of the 12-month period covered by the\nprevious annual report. If the\nguardian is also a conservator, a settlement of accounts shall also be filed\nwith the commissioner of accounts as provided in &#xA7; 64.2-1305.\n\nB. The annual report to the local department of social services shall include:\n\n   1. A description of the incapacitated person&#8217;s living arrangements\n   during the reported period, including a specific assessment of the adequacy of\n   such living arrangement;\n\n   3. The medical, educational, vocational, social, recreational, and any other\n   professional services and activities provided to the incapacitated person and\n   the guardian&#8217;s opinion as to the adequacy of the incapacitated\n   person&#8217;s care. The information required by this subdivision shall\n   include (i) the specific names of the medical providers that have treated the\n   incapacitated person and a description of the frequency or number of times the\n   incapacitated person was seen by such providers; (ii) the date and location of\n   and reason for any hospitalization of such incapacitated person; and (iii) a\n   description of the educational, vocational, social, and recreational\n   activities in which such incapacitated person participated;\n\n   4. A statement of whether the guardian agrees with the current treatment or\n   habilitation plan;\n\n   5. A statement of whether the incapacitated person has been an alleged victim\n   in a report of abuse, neglect, or exploitation made pursuant to Article 2\n   (&#xA7; 63.2-1603 et seq.) of Chapter 16 of Title 63.2, to the extent known,\n   and whether there are any other indications of abuse, neglect, or exploitation\n   of such incapacitated person;\n\n   6. A recommendation as to the need for continued guardianship and any\n   recommended changes in the scope of the guardianship;\n\n   7. The name of any persons whose access to communicate, visit, or interact\n   with the incapacitated person has been restricted and the reasons for such\n   restriction;\n\n   8. A self-assessment by the guardian as to whether he feels he is able to\n   continue to carry out the powers and duties imposed upon him by &#xA7;\n   64.2-2019 and as specified in the court&#8217;s order of appointment pursuant\n   to &#xA7; 64.2-2009;\n\n   9. A statement as to whether the guardian and any skilled professional\n   retained by such guardian to perform guardianship duties on behalf of the\n   guardian have completed the training required by subsection E1 of &#xA7;\n   64.2-2019;\n\n   10. Unless the incapacitated person resides with the guardian, a statement of\n   the frequency and nature of any (i) in-person visits from the guardian with\n   the incapacitated person over the course of the previous year and (ii) visits\n   over the course of the previous year from a designee who is directly\n   supervised or contracted by the guardian, including the name of the designee\n   performing such visit. If any visit described in this section is made\n   virtually, the guardian shall include such information in the annual report;\n\n   11. If no visit is made within a 120-day period, the guardian shall describe\n   any challenges or limitations in completing such visit;\n\n   12. A general description of the activities taken on by the guardian for the\n   benefit of the incapacitated person during the past year;\n\n   13. Any other information deemed necessary by the Office of the Executive\n   Secretary of the Supreme Court of Virginia or the Department for Aging and\n   Rehabilitative Services to understand the condition, treatment, and well-being\n   of the incapacitated person;\n\n   14. Any other information useful in the opinion of the guardian; and\n\n   15. The compensation requested and the reasonable and necessary expenses\n   incurred by the guardian.\n   \t\t\t\tThe guardian shall certify by signing under oath that the information\n   contained in the annual report is true and correct to the best of his\n   knowledge. If a guardian makes a false entry or statement in the annual\n   report, he shall be subject to a civil penalty of not more than $600. Such\n   penalty shall be collected by the attorney for the Commonwealth or the county\n   or city attorney, and the proceeds shall be deposited into the general fund.\n\nC.
