<a id=\"paragraph-210434\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-601\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> If the <span class=\"dictionary\">designated successor<\/span> does not know of a conservator, guardian, custodian, or custodial <span class=\"dictionary\">trustee<\/span>, paying it to an adult relative or other <span class=\"dictionary\">person<\/span> having legal or physical care or <span class=\"dictionary\">custody<\/span> of such successor to be expended on such successor&#8217;s behalf; or <a id=\"paragraph-210435\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-601\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Managing it as a separate fund on such successor&#8217;s behalf, subject to such successor&#8217;s continuing right to withdraw the asset. <a id=\"paragraph-210436\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-601\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Any successor may be represented and bound under virtual representation provisions of &#xA7;&#xA7; <a class=\"law\" title=\"Representation; basic effect\" href=\"\/64.2-714\/\">64.2-714<\/a>, <a class=\"law\" title=\"Representation by fiduciaries and parents or other ancestors\" href=\"\/64.2-716\/\">64.2-716<\/a>, and <a class=\"law\" title=\"Representation by person having substantially identical interest\" href=\"\/64.2-717\/\">64.2-717<\/a> with respect to <span class=\"dictionary\">affidavits<\/span> required and designations of <span class=\"dictionary\">persons<\/span> to receive payment or delivery of a <span class=\"dictionary\">small asset<\/span> under this article. <a id=\"paragraph-210437\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-601\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> A transfer agent of any security, upon the surrender of the certificates, if any, evidencing the security, shall change the registered ownership on the books of a corporation from the decedent to the <span class=\"dictionary\">designated successor<\/span> upon the presentation of an <span class=\"dictionary\">affidavit<\/span> as provided in subsection A. <a id=\"paragraph-210438\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-601\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Upon the presentation of an <span class=\"dictionary\">affidavit<\/span> as provided in subsection A, the <span class=\"dictionary\">designated successor<\/span> may endorse or negotiate any <span class=\"dictionary\">small asset<\/span> that is a check, draft, or other negotiable instrument that is payable to the decedent or the decedent&#8217;s estate. Notwithstanding the provisions of &#xA7;&#xA7; <a class=\"law\" title=\"Unauthorized signature\" href=\"\/8.3A-403\/\">8.3A-403<\/a>, <a class=\"law\" title=\"Presentment warranties\" href=\"\/8.3A-417\/\">8.3A-417<\/a>, and <a class=\"law\" title=\"Conversion of instrument\" href=\"\/8.3A-420\/\">8.3A-420<\/a>, a financial institution accepting such check, draft, or other negotiable instrument presented for deposit in such manner is discharged from all claims for the amount accepted. <a id=\"paragraph-210439\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-601\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPAYMENT OR DELIVERY OF SMALL ASSET BY AFFIDAVIT (\u00a7 64.2-601)\n\nA. Any person having possession of a small asset shall pay or deliver the small\nasset to the designated successor of the decedent upon being presented an\naffidavit made by all of the known successors stating:\n\n   1. That the value of the decedent&#8217;s entire personal probate estate as of\n   the date of the decedent&#8217;s death, wherever located, does not exceed\n   $75,000;\n\n   2. That at least 60 days have elapsed since the decedent&#8217;s death;\n\n   3. That no application for the appointment of a personal representative is\n   pending or has been granted in any jurisdiction;\n\n   4. That the decedent&#8217;s will, if any, was duly probated;\n\n   5. That the claiming successor is entitled to payment or delivery of the small\n   asset, and the basis upon which such entitlement is claimed;\n\n   6. The names and addresses of all successors, to the extent known;\n\n   7. The name of each successor designated to receive payment or delivery of the\n   small asset on behalf of all successors; and\n\n   8. That the designated successor shall have a fiduciary duty to safeguard and\n   promptly pay or deliver the small asset as required by the laws of the\n   Commonwealth.\n\nB. The designated successor may discharge his fiduciary duty to promptly pay or\ndeliver the small asset to a successor who is, or is reasonably believed to be,\nincapacitated or under a legal disability, by paying or delivering the asset\ndirectly to the incapacitated or disabled successor or applying it for such\nsuccessor&#8217;s benefit, or by:\n\n   1. Paying it to such successor&#8217;s conservator or, if no conservator\n   exists, guardian;\n\n   2. Paying it to such successor&#8217;s custodian under the Virginia Uniform\n   Transfers to Minors Act (&#xA7; 64.2-1900 et seq.) or custodial trustee under\n   the Uniform Custodial Trust Act (&#xA7; 64.2-900 et seq.), and, for that\n   purpose, creating a custodianship or custodial trust;\n\n   3. If the designated successor does not know of a conservator, guardian,\n   custodian, or custodial trustee, paying it to an adult relative or other\n   person having legal or physical care or custody of such successor to be\n   expended on such successor&#8217;s behalf; or\n\n   4. Managing it as a separate fund on such successor&#8217;s behalf, subject to\n   such successor&#8217;s continuing right to withdraw the asset.\n\nC. Any successor may be represented and bound under virtual representation\nprovisions of &#xA7;&#xA7; 64.2-714, 64.2-716, and 64.2-717 with respect to\naffidavits required and designations of persons to receive payment or delivery\nof a small asset under this article.\n\nD.
