<a class=\"law\" title=\"Decanting power under expanded distributive discretion\" href=\"\/64.2-779.8\/\">64.2-779.8<\/a>, the interest in the <span class=\"dictionary\">second trust<\/span> of a <span class=\"dictionary\">beneficiary with a disability<\/span> may:\n\t\t\t\ta. Be a pooled trust as defined by Medicaid <span class=\"dictionary\">law<\/span> for the benefit of the <span class=\"dictionary\">beneficiary with a disability<\/span> under 42 U.S.C. &#xA7; 1396p(d)(4)(C); or\n\t\t\t\tb. Contain payback provisions complying with reimbursement requirements of Medicaid <span class=\"dictionary\">law<\/span> under 42 U.S.C. &#xA7; 1396p(d)(4)(A). <a id=\"paragraph-221609\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-779.10\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Subdivision C 3 of &#xA7; <a class=\"law\" title=\"Decanting power under expanded distributive discretion\" href=\"\/64.2-779.8\/\">64.2-779.8<\/a> does not apply to the interests of the <span class=\"dictionary\">beneficiary with a disability<\/span>. <a id=\"paragraph-221610\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-779.10\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Except as affected by any change to the interests of the <span class=\"dictionary\">beneficiary with a disability<\/span>, the <span class=\"dictionary\">second trust<\/span>, or if there are two or more <span class=\"dictionary\">second trusts<\/span>, the <span class=\"dictionary\">second trusts<\/span> in the aggregate, must grant each other beneficiary of the <span class=\"dictionary\">first trust<\/span> beneficial interests in the <span class=\"dictionary\">second trusts<\/span> that are substantially similar to the beneficiary&#8217;s beneficial interests in the <span class=\"dictionary\">first trust<\/span>. <a id=\"paragraph-221611\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/64.2-779.10\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nTRUST FOR BENEFICIARY WITH DISABILITY (\u00a7 64.2-779.10)\n\nA. As used in this section:\n\t\t\t&#8220;Beneficiary with a disability&#8221; means a beneficiary of a first\ntrust who the special-needs fiduciary believes may qualify for governmental\nbenefits based on disability, whether or not the beneficiary currently receives\nthose benefits or is an individual who has been determined to be an\nincapacitated person.\n\t\t\t&#8220;Governmental benefits&#8221; means financial aid or services from a\nstate, federal, or other public agency.\n\t\t\t&#8220;Special-needs fiduciary&#8221; means, with respect to a trust that has\na beneficiary with a disability:\n\n   1. A trustee or other fiduciary, other than a settlor, that has discretion to\n   distribute part or all of the principal of a first trust to one or more\n   current beneficiaries;\n\n   2. If no trustee or fiduciary has discretion under subdivision 1, a trustee or\n   other fiduciary, other than a settlor, that has discretion to distribute part\n   or all of the income of the first trust to one or more current beneficiaries;\n   or\n\n   3. If no trustee or fiduciary has discretion under subdivisions 1 and 2, a\n   trustee or other fiduciary, other than a settlor, that is required to\n   distribute part or all of the income or principal of the first trust to one or\n   more current beneficiaries.\n   \t\t\t\t&#8220;Special-needs trust&#8221; means a trust the trustee believes would\n   not be considered a resource for purposes of determining whether a beneficiary\n   with a disability is eligible for governmental benefits.\n\nB. A special-needs fiduciary may exercise the decanting power under \u00a7\n64.2-779.8 over the income or principal of a first trust, including a first\ntrust under which the fiduciary has only limited distributive discretion as\ndefined in subsection A of \u00a7 64.2-779.9, as if the fiduciary had authority to\ndistribute income or principal to a beneficiary with a disability subject to\nexpanded distributive discretion if:\n\n   1. A second trust is a special-needs trust that benefits the beneficiary with\n   a disability; and\n\n   2. The special-needs fiduciary determines that exercise of the decanting power\n   will further the purposes of the first trust.\n\nC. In an exercise of the decanting power under this section, the following rules\napply:\n\n   1. Notwithstanding subdivision C 2 of &#xA7; 64.2-779.8, the interest in the\n   second trust of a beneficiary with a disability may:\n   \t\t\t\ta. Be a pooled trust as defined by Medicaid law for the benefit of the\n   beneficiary with a disability under 42 U.S.C. &#xA7; 1396p(d)(4)(C); or\n   \t\t\t\tb. Contain payback provisions complying with reimbursement requirements of\n   Medicaid law under 42 U.S.C. &#xA7; 1396p(d)(4)(A).\n\n   2. Subdivision C 3 of &#xA7; 64.2-779.8 does not apply to the interests of the\n   beneficiary with a disability.\n\n   3.
