All such fees and costs shall be paid to the Attorney General&#8217;s Office by the defendant and shall not be included in any damages or civil penalties recovered in a civil action based on a violation of this section.B\n\nIf the court finds that (i) the person committing the violation of this section furnished officials of the Commonwealth responsible for investigating false claims violations with all information known to the person about the violation within 30 days after the date on which the defendant first obtained the information; (ii) such person fully cooperated with any Commonwealth investigation of such violation; (iii) at the time such person furnished the Commonwealth with the information about the violation, no criminal prosecution, civil action, or administrative action had commenced with respect to such violation; and (iv) the person did not have actual knowledge of the existence of an investigation into such violation, the court may assess not less than two times the amount of damages that the Commonwealth sustains because of the act of that person. <a id=\"paragraph-309930\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/8.01-216.3\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> <span class=\"dictionary\">Knowingly<\/span> buys or receives as a pledge of an <span class=\"dictionary\">obligation<\/span> or debt, public property from an officer or <span class=\"dictionary\">employee<\/span> of the <span class=\"dictionary\">Commonwealth<\/span> who lawfully may not sell or pledge the property; or <a id=\"paragraph-309931\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/8.01-216.3\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> <span class=\"dictionary\">Knowingly<\/span> makes, uses, or causes to be made or used, a false record or statement <span class=\"dictionary\">material<\/span> to an <span class=\"dictionary\">obligation<\/span> to pay or transmit money or property to the <span class=\"dictionary\">Commonwealth<\/span> or <span class=\"dictionary\">knowingly<\/span> conceals or <span class=\"dictionary\">knowingly<\/span> and improperly avoids or decreases an <span class=\"dictionary\">obligation<\/span> to pay or transmit money or property to the <span class=\"dictionary\">Commonwealth<\/span>;\n\t\t\t\tshall be liable to the <span class=\"dictionary\">Commonwealth<\/span> for a civil <span class=\"dictionary\">penalty<\/span> of not less than $10,957 and not more than $21,916, except that these lower and upper limits on liability shall automatically be adjusted to equal the amounts allowed under the Federal False <span class=\"dictionary\">Claims<\/span> Act, 31 U.S.C. &#xA7; 3729 et seq., as amended, as such penalties in the Federal False <span class=\"dictionary\">Claims<\/span> Act are adjusted for inflation by the Federal Civil Penalties Inflation Adjustment Act of 1990, as amended (28 U.S.C. &#xA7; 2461 Note, P.L. 101-410), plus three times the amount of <span class=\"dictionary\">damages<\/span> sustained by the <span class=\"dictionary\">Commonwealth<\/span>.\n\t\t\t\tA <span class=\"dictionary\">person<\/span> violating this section shall be liable to the <span class=\"dictionary\">Commonwealth<\/span> for reasonable attorney fees and costs of a <span class=\"dictionary\">civil action<\/span> brought to recover any such penalties or <span class=\"dictionary\">damages<\/span>. All such fees and costs shall be paid to the <span class=\"dictionary\">Attorney General<\/span>&#8217;s Office by the <span class=\"dictionary\">defendant<\/span> and shall not be included in any <span class=\"dictionary\">damages<\/span> or civil penalties recovered in a <span class=\"dictionary\">civil action<\/span> based on a violation of this section. <a id=\"paragraph-309932\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/8.01-216.3\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> If the <span class=\"dictionary\">court<\/span> finds that (i) the <span class=\"dictionary\">person<\/span> committing the violation of this section furnished officials of the <span class=\"dictionary\">Commonwealth<\/span> responsible for investigating false <span class=\"dictionary\">claims<\/span> violations with all information known to the <span class=\"dictionary\">person<\/span> about the violation within 30 days after the date on which the <span class=\"dictionary\">defendant<\/span> first obtained the information; (ii) such <span class=\"dictionary\">person<\/span> fully cooperated with any <span class=\"dictionary\">Commonwealth<\/span> <span class=\"dictionary\">investigation<\/span> of such violation; (iii) at the time such <span class=\"dictionary\">person<\/span> furnished the <span class=\"dictionary\">Commonwealth<\/span> with the information about the violation, no criminal <span class=\"dictionary\">prosecution<\/span>, <span class=\"dictionary\">civil action<\/span>, or administrative action had commenced with respect to such violation; and (iv) the <span class=\"dictionary\">person<\/span> did not have actual knowledge of the existence of an <span class=\"dictionary\">investigation<\/span> into such violation, the <span class=\"dictionary\">court<\/span> may assess not less than two times the amount of <span class=\"dictionary\">damages<\/span> that the <span class=\"dictionary\">Commonwealth<\/span> <span class=\"dictionary\">sustains<\/span> because of the act of that <span class=\"dictionary\">person<\/span>. A <span class=\"dictionary\">person<\/span> violating this section shall also be liable to the <span class=\"dictionary\">Commonwealth<\/span> for the costs of a <span class=\"dictionary\">civil action<\/span> brought to recover any such <span class=\"dictionary\">penalty<\/span> or <span class=\"dictionary\">damages<\/span>. <a id=\"paragraph-309933\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/8.01-216.3\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> For purposes of this section, the terms &#8220;<span class=\"dictionary\">knowing<\/span>&#8221; and &#8220;<span class=\"dictionary\">knowingly<\/span>&#8221; mean that a <span class=\"dictionary\">person<\/span>, with respect to information, (i) has actual knowledge of the information; (ii) acts in deliberate ignorance of the truth or falsity of the information; or (iii) acts in reckless disregard of the truth or falsity of the information and require no proof of specific <span class=\"dictionary\">intent<\/span> to defraud. <a id=\"paragraph-309934\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/8.01-216.3\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Except as provided in subdivision A 5, this section shall not apply to <span class=\"dictionary\">claims<\/span>, records, or statements relating to state or local taxes. <a id=\"paragraph-309935\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/8.01-216.3\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nFALSE CLAIMS; CIVIL PENALTY (\u00a7 8.01-216.3)\n\nA. Any person who:\n\n   1. Knowingly presents, or causes to be presented, a false or fraudulent claim\n   for payment or approval;\n\n   2. Knowingly makes, uses, or causes to be made or used, a false record or\n   statement material to a false or fraudulent claim;\n\n   3. Conspires to commit a violation of subdivision 1, 2, 4, 5, 6, 7, 8, or 9;\n\n   4. Has possession, custody, or control of property or money used, or to be\n   used, by the Commonwealth and knowingly delivers, or causes to be delivered,\n   less than all such money or property;\n\n   5. Has possession, custody, or control of an illegal gambling device, as\n   defined in &#xA7; 18.2-325, knowing such device is illegal, and knowingly\n   conceals, avoids, or decreases an obligation to pay or transmit money to the\n   Commonwealth that is derived from the operation of such device;\n\n   6. Manufactures for sale, sells, or distributes an illegal gaming device\n   knowing that such device is or is intended to be operated in the Commonwealth\n   in violation of Article 1 (&#xA7; 18.2-325 et seq.) or Article 1.1:1 (&#xA7;\n   18.2-340.15 et seq.) of Chapter 8 of Title 18.2;\n\n   7. Is authorized to make or deliver a document certifying receipt of property\n   used, or to be used, by the Commonwealth and, intending to defraud the\n   Commonwealth, makes or delivers the receipt without completely knowing that\n   the information on the receipt is true;\n\n   8. Knowingly buys or receives as a pledge of an obligation or debt, public\n   property from an officer or employee of the Commonwealth who lawfully may not\n   sell or pledge the property; or\n\n   9. Knowingly makes, uses, or causes to be made or used, a false record or\n   statement material to an obligation to pay or transmit money or property to\n   the Commonwealth or knowingly conceals or knowingly and improperly avoids or\n   decreases an obligation to pay or transmit money or property to the\n   Commonwealth;\n   \t\t\t\tshall be liable to the Commonwealth for a civil penalty of not less than\n   $10,957 and not more than $21,916, except that these lower and upper limits on\n   liability shall automatically be adjusted to equal the amounts allowed under\n   the Federal False Claims Act, 31 U.S.C. &#xA7; 3729 et seq., as amended, as\n   such penalties in the Federal False Claims Act are adjusted for inflation by\n   the Federal Civil Penalties Inflation Adjustment Act of 1990, as amended (28\n   U.S.C. &#xA7; 2461 Note, P.L. 101-410), plus three times the amount of damages\n   sustained by the Commonwealth.\n   \t\t\t\tA person violating this section shall be liable to the Commonwealth for\n   reasonable attorney fees and costs of a civil action brought to recover any\n   such penalties or damages. All such fees and costs shall be paid to the\n   Attorney General&#8217;s Office by the defendant and shall not be included in\n   any damages or civil penalties recovered in a civil action based on a\n   violation of this section.\n\nB. If the court finds that (i) the person committing the violation of this\nsection furnished officials of the Commonwealth responsible for investigating\nfalse claims violations with all information known to the person about the\nviolation within 30 days after the date on which the defendant first obtained\nthe information; (ii) such person fully cooperated with any Commonwealth\ninvestigation of such violation; (iii) at the time such person furnished the\nCommonwealth with the information about the violation, no criminal prosecution,\ncivil action, or administrative action had commenced with respect to such\nviolation; and (iv) the person did not have actual knowledge of the existence of\nan investigation into such violation, the court may assess not less than two\ntimes the amount of damages that the Commonwealth sustains because of the act of\nthat person. A person violating this section shall also be liable to the\nCommonwealth for the costs of a civil action brought to recover any such penalty\nor damages.\n\nC.
