Delivery of a declaration of loss is a warranty of the truth of the statements made in the declaration. If a claim is asserted in compliance with this subsection, the following rules apply:1\n\nThe claim becomes enforceable at the later of (i) the time the claim is asserted, or (ii) the ninetieth day following the date of the check, in the case of a cashier&#8217;s check or teller&#8217;s check, or the ninetieth day following the date of the acceptance, in the case of a certified check.2\n\nUntil the claim becomes enforceable, it has no legal effect and the obligated bank may pay the check or, in the case of a teller&#8217;s check, may permit the drawee to pay the check. Payment to a person entitled to enforce the check discharges all liability of the obligated bank with respect to the check.3\n\nIf the claim becomes enforceable before the check is presented for payment, the obligated bank is not obliged to pay the check.4\n\nWhen the claim becomes enforceable, the obligated bank becomes obliged to pay the amount of the check to the claimant if payment of the check has not been made to a person entitled to enforce the check. Subject to &#xA7; <a class=\"law\" title=\"Payor bank&#039;s responsibility for late return of item\" href=\"\/8.4-302\/\">8.4-302<\/a> (a) (1), payment to the <span class=\"dictionary\">claimant<\/span> discharges all liability of the <span class=\"dictionary\">obligated bank<\/span> with respect to the <span class=\"dictionary\">check<\/span>. <a id=\"paragraph-295807\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/8.3A-312\/#b4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"c\"><p><span class=\"prefix-number\">c.<\/span> If the <span class=\"dictionary\">obligated bank<\/span> pays the amount of a <span class=\"dictionary\">check<\/span> to a <span class=\"dictionary\">claimant<\/span> under subsection (b) (4) and the <span class=\"dictionary\">check<\/span> is presented for payment by a person having rights of a holder in due course, the <span class=\"dictionary\">claimant<\/span> is obliged to (i) refund the payment to the <span class=\"dictionary\">obligated bank<\/span> if the <span class=\"dictionary\">check<\/span> is paid, or (ii) pay the amount of the <span class=\"dictionary\">check<\/span> to the person having rights of a holder in due course if the <span class=\"dictionary\">check<\/span> is dishonored. <a id=\"paragraph-295808\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/8.3A-312\/#c\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"d\"><p><span class=\"prefix-number\">d.<\/span> If a <span class=\"dictionary\">claimant<\/span> has the right to assert a claim under subsection (b) and is also a person entitled to enforce a cashier&#8217;s <span class=\"dictionary\">check<\/span>, teller&#8217;s <span class=\"dictionary\">check<\/span>, or certified <span class=\"dictionary\">check<\/span> which is lost, destroyed, or stolen, the <span class=\"dictionary\">claimant<\/span> may assert rights with respect to the <span class=\"dictionary\">check<\/span> either under this section or &#xA7; <a class=\"law\" title=\"Enforcement of lost, destroyed, or stolen instrument\" href=\"\/8.3A-309\/\">8.3A-309<\/a>. <a id=\"paragraph-295809\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/8.3A-312\/#d\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nLOST, DESTROYED, OR STOLEN CASHIER&#8217;S CHECK, TELLER&#8217;S CHECK, OR\nCERTIFIED CHECK (\u00a7 8.3A-312)\n\na. In this section:\n\n   1. &#8220;Check&#8221; means a cashier&#8217;s check, teller&#8217;s check, or\n   certified check.\n\n   2. &#8220;Claimant&#8221; means a person who claims the right to receive the\n   amount of a cashier&#8217;s check, teller&#8217;s check, or certified check\n   that was lost, destroyed, or stolen.\n\n   3. &#8220;Declaration of loss&#8221; means a written statement, made under\n   penalty of perjury, to the effect that (i) the declarer lost possession of a\n   check, (ii) the declarer is the drawer or payee of the check, in the case of a\n   certified check, or the remitter or payee of the check, in the case of a\n   cashier&#8217;s check or teller&#8217;s check, (iii) the loss of possession\n   was not the result of a transfer by the declarer or a lawful seizure, and (iv)\n   the declarer cannot reasonably obtain possession of the check because the\n   check was destroyed, its whereabouts cannot be determined, or it is in the\n   wrongful possession of an unknown person or a person that cannot be found or\n   is not amenable to service of process.\n\n   4. &#8220;Obligated bank&#8221; means the issuer of a cashier&#8217;s check or\n   teller&#8217;s check or the acceptor of a certified check.\n\nb. A claimant may assert a claim to the amount of a check by a communication to\nthe obligated bank describing the check with reasonable certainty and requesting\npayment of the amount of the check, if (i) the claimant is the drawer or payee\nof a certified check or the remitter or payee of a cashier&#8217;s check or\nteller&#8217;s check, (ii) the communication contains or is accompanied by a\ndeclaration of loss of the claimant with respect to the check, (iii) the\ncommunication is received at a time and in a manner affording the bank a\nreasonable time to act on it before the check is paid, and (iv) the claimant\nprovides reasonable identification if requested by the obligated bank. Delivery\nof a declaration of loss is a warranty of the truth of the statements made in\nthe declaration. If a claim is asserted in compliance with this subsection, the\nfollowing rules apply:\n\n   1. The claim becomes enforceable at the later of (i) the time the claim is\n   asserted, or (ii) the ninetieth day following the date of the check, in the\n   case of a cashier&#8217;s check or teller&#8217;s check, or the ninetieth day\n   following the date of the acceptance, in the case of a certified check.\n\n   2. Until the claim becomes enforceable, it has no legal effect and the\n   obligated bank may pay the check or, in the case of a teller&#8217;s check,\n   may permit the drawee to pay the check. Payment to a person entitled to\n   enforce the check discharges all liability of the obligated bank with respect\n   to the check.\n\n   3. If the claim becomes enforceable before the check is presented for payment,\n   the obligated bank is not obliged to pay the check.\n\n   4. When the claim becomes enforceable, the obligated bank becomes obliged to\n   pay the amount of the check to the claimant if payment of the check has not\n   been made to a person entitled to enforce the check. Subject to &#xA7; 8.4-302\n   (a) (1), payment to the claimant discharges all liability of the obligated\n   bank with respect to the check.\n\nc. If the obligated bank pays the amount of a check to a claimant under\nsubsection (b) (4) and the check is presented for payment by a person having\nrights of a holder in due course, the claimant is obliged to (i) refund the\npayment to the obligated bank if the check is paid, or (ii) pay the amount of\nthe check to the person having rights of a holder in due course if the check is\ndishonored.\n\nd.
