A licensed bail bondsman is responsible for ensuring that his employees, partners and individuals contracted to perform services for or on behalf of the bonding business comply with all of these provisions, and do not violate any of the restrictions that apply to bail bondsmen. Violations by a bondsman&#8217;s employee, partner, or agent may be grounds for disciplinary action against the bondsman, including probation, suspension or revocation of license.B\n\nA licensed bail bondsman shall not:1\n\nKnowingly commit, or be a party to, any material fraud, misrepresentation, concealment, conspiracy, collusion, forgery, scheme or device whereby any other person lawfully relies upon the word, representation, or conduct of the bail bondsman.2\n\nSolicit sexual favors or extort additional consideration as a condition of obtaining, maintaining, or exonerating bail bond, regardless of the identity of the person who performs the favors.3\n\nConduct a bail bond transaction that demonstrates bad faith, dishonesty, coercion, incompetence, extortion or untrustworthiness.4\n\nCoerce, suggest, aid and abet, offer promise of favor, or threaten any person on whose bond he is surety or offers to become surety, to induce that person to commit any crime.5\n\nGive or receive, directly or indirectly, any gift of any kind to any nonelected public official or any employee of a governmental agency involved with the administration of justice, including but not limited to law-enforcement personnel, magistrates, judges, and jail employees, as well as attorneys. De minimis gifts, not to exceed $50 per year per recipient, are acceptable, provided the purpose of the gift is not to directly solicit business, or would otherwise be a violation of Board regulations or the laws of the Commonwealth.6\n\nFail to comply with any of the statutory or regulatory requirements governing licensed bail bondsmen.7\n\nFail to cooperate with any investigation by the Department.8\n\nFail to comply with any subpoena issued by the Department.9\n\nProvide materially incorrect, misleading, incomplete or untrue information in a license application, renewal application, or any other document filed with the Department.10\n\nProvide bail for any person if he is also an attorney representing that person.11\n\nProvide bail for any person if the bondsman was initially involved in the arrest of that person.C\n\nA licensed bail bondsman shall ensure that each recognizance on all bonds for which he signs shall contain the name and contact information for both the surety agent and the registered agent of the issuing company.D\n\nAn administrative fee may be charged by a bail bondsman, not to exceed reasonable costs. Reasonable costs may include, but are not limited to, travel, court time, recovery fees, phone expenses, administrative overhead and postage.E\n\nA property bail bondsman shall not enter into any bond if the aggregate of the penalty of such bond and all other bonds, on which he has not been released from liability, is in excess of four times the true market value of the equity in his real estate, cash or certificates of deposit issued by a federally insured institution, or any combination thereof.F\n\nA property bail bondsman or his agent shall not refuse to cover any forfeiture of bond against him or refuse to pay such forfeiture after notice and final order of the court.G\n\nA surety bail bondsman shall not write bail bonds on any qualifying power of attorney for which a copy has not been filed with the Department.H\n\nA surety bail bondsman shall not violate any of the statutes or regulations that govern insurance agents.I\n\nA licensed bail bondsman shall not charge a bail bond premium less than 10 percent or more than 15 percent of the amount of the bond. A licensed bail bondsman shall not loan money with interest for the purpose of helping another obtain a bail bond.\n\t\t\tFor the purposes of this subsection, &#8220;bail bond premium&#8221; means the amount of money paid to a licensed bail bondsman for the execution of a bail bond.J\n\nA licensed bail bondsman who has been arrested for a felony offense shall not issue any new bonds pending the outcome of the investigation by the Department.K\n\nIf a recognizance is forfeited pursuant to &#xA7; 19.2-143 and such recognizance is not paid by 4:00 p.m. on the last day of the 150-day period from the finding of default, the clerk shall notify the Department of such default and the Department shall suspend the license of any bail bondsman on the bond in the forfeited recognizance until the forfeited recognizance is satisfied, unless suspended for another cause. Violations by a bondsman&#8217;s employee, partner, or <span class=\"dictionary\">agent<\/span> may be grounds for disciplinary action against the bondsman, including <span class=\"dictionary\">probation<\/span>, suspension or <span class=\"dictionary\">revocation<\/span> of license. <a id=\"paragraph-206893\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> A licensed <span class=\"dictionary\">bail bondsman<\/span> shall not: <a id=\"paragraph-206894\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Knowingly commit, or be a <span class=\"dictionary\">party<\/span> to, any <span class=\"dictionary\">material<\/span> <span class=\"dictionary\">fraud<\/span>, misrepresentation, concealment, conspiracy, collusion, <span class=\"dictionary\">forgery<\/span>, scheme or device whereby any other person lawfully relies upon the word, representation, or conduct of the <span class=\"dictionary\">bail bondsman<\/span>. <a id=\"paragraph-206895\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Solicit sexual favors or extort additional consideration as a condition of obtaining, maintaining, or exonerating <span class=\"dictionary\">bail bond<\/span>, regardless of the identity of the person who performs the favors. <a id=\"paragraph-206896\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Conduct a <span class=\"dictionary\">bail bond<\/span> transaction that demonstrates bad faith, dishonesty, coercion, incompetence, extortion or untrustworthiness. <a id=\"paragraph-206897\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Coerce, suggest, <span class=\"dictionary\">aid and abet<\/span>, offer promise of favor, or threaten any person on whose bond he is <span class=\"dictionary\">surety<\/span> or offers to become <span class=\"dictionary\">surety<\/span>, to induce that person to commit any <span class=\"dictionary\">crime<\/span>. <a id=\"paragraph-206898\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Give or receive, directly or indirectly, any gift of any kind to any nonelected public official or any employee of a governmental agency involved with the administration of justice, including but not limited to <span class=\"dictionary\">law<\/span>-enforcement personnel, <span class=\"dictionary\">magistrates<\/span>, <span class=\"dictionary\">judges<\/span>, and jail employees, as well as attorneys. De minimis gifts, not to exceed $50 per year per recipient, are acceptable, provided the purpose of the gift is not to directly solicit business, or would otherwise be a violation of <span class=\"dictionary\">Board<\/span> regulations or the <span class=\"dictionary\">laws<\/span> of the Commonwealth. <a id=\"paragraph-206899\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Fail to comply with any of the statutory or regulatory requirements governing licensed bail bondsmen. <a id=\"paragraph-206900\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Fail to cooperate with any investigation by the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-206901\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Fail to comply with any <span class=\"dictionary\">subpoena<\/span> issued by the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-206902\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Provide materially incorrect, misleading, incomplete or untrue information in a license application, renewal application, or any other document filed with the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-206903\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Provide bail for any person if he is also an attorney representing that person. <a id=\"paragraph-206904\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Provide bail for any person if the bondsman was initially involved in the <span class=\"dictionary\">arrest<\/span> of that person. <a id=\"paragraph-206905\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#B11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> A licensed <span class=\"dictionary\">bail bondsman<\/span> shall ensure that each <span class=\"dictionary\">recognizance<\/span> on all <span class=\"dictionary\">bonds<\/span> for which he signs shall contain the name and contact information for both the <span class=\"dictionary\">surety<\/span> <span class=\"dictionary\">agent<\/span> and the registered <span class=\"dictionary\">agent<\/span> of the issuing company. <a id=\"paragraph-206906\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> An administrative fee may be charged by a <span class=\"dictionary\">bail bondsman<\/span>, not to exceed reasonable costs. Reasonable costs may include, but are not limited to, travel, <span class=\"dictionary\">court<\/span> time, recovery fees, phone expenses, administrative overhead and postage. <a id=\"paragraph-206907\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> A <span class=\"dictionary\">property bail bondsman<\/span> shall not enter into any bond if the aggregate of the <span class=\"dictionary\">penalty<\/span> of such bond and all other <span class=\"dictionary\">bonds<\/span>, on which he has not been released from liability, is in excess of four times the true market value of the <span class=\"dictionary\">equity<\/span> in his real estate, cash or <span class=\"dictionary\">certificates<\/span> of deposit issued by a federally insured institution, or any combination thereof. <a id=\"paragraph-206908\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> A <span class=\"dictionary\">property bail bondsman<\/span> or his <span class=\"dictionary\">agent<\/span> shall not refuse to cover any forfeiture of bond against him or refuse to pay such forfeiture after notice and <span class=\"dictionary\">final order<\/span> of the <span class=\"dictionary\">court<\/span>. <a id=\"paragraph-206909\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> A <span class=\"dictionary\">surety bail bondsman<\/span> shall not write <span class=\"dictionary\">bail bonds<\/span> on any qualifying <span class=\"dictionary\">power of attorney<\/span> for which a copy has not been filed with the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-206910\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> A <span class=\"dictionary\">surety bail bondsman<\/span> shall not violate any of the <span class=\"dictionary\">statutes<\/span> or regulations that govern insurance <span class=\"dictionary\">agents<\/span>. <a id=\"paragraph-206911\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> A licensed bail bondsman shall not charge a <span class=\"dictionary\">bail bond premium<\/span> less than 10 percent or more than 15 percent of the amount of the bond. A licensed bail bondsman shall not loan money with interest for the purpose of helping another obtain a bail bond.\n\t\t\tFor the purposes of this subsection, &#8220;<span class=\"dictionary\">bail bond premium<\/span>&#8221; means the amount of money paid to a licensed bail bondsman for the execution of a bail bond. <a id=\"paragraph-206912\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> A licensed bail bondsman who has been arrested for a <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span> shall not <span class=\"dictionary\">issue<\/span> any new bonds pending the outcome of the investigation by the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-206913\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"K\"><p><span class=\"prefix-number\">K.<\/span> If a <span class=\"dictionary\">recognizance<\/span> is forfeited pursuant to &#xA7; <a class=\"law\" title=\"Where default recorded; process on recognizance; forfeiture on recognizance; when copy may be used; cash bond\" href=\"\/19.2-143\/\">19.2-143<\/a> and such <span class=\"dictionary\">recognizance<\/span> is not paid by 4:00 p.m. on the last day of the 150-day period from the <span class=\"dictionary\">finding<\/span> of <span class=\"dictionary\">default<\/span>, the clerk shall notify the <span class=\"dictionary\">Department<\/span> of such <span class=\"dictionary\">default<\/span> and the <span class=\"dictionary\">Department<\/span> shall suspend the license of any bail bondsman on the bond in the forfeited <span class=\"dictionary\">recognizance<\/span> until the forfeited <span class=\"dictionary\">recognizance<\/span> is satisfied, unless suspended for another cause. If any employer of such bail bondsman receives notice pursuant to &#xA7; <a class=\"law\" title=\"Where default recorded; process on recognizance; forfeiture on recognizance; when copy may be used; cash bond\" href=\"\/19.2-143\/\">19.2-143<\/a> to pay a forfeited <span class=\"dictionary\">recognizance<\/span> within 10 business days and such forfeiture is not paid within 10 business days of the notice to pay, the <span class=\"dictionary\">Department<\/span> shall suspend the licenses of the employer of the bail bondsman and the <span class=\"dictionary\">agents<\/span> thereof until the forfeited <span class=\"dictionary\">recognizance<\/span> is satisfied, unless suspended for another cause. <a id=\"paragraph-206914\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/9.1-185.8\/#K\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPROFESSIONAL CONDUCT STANDARDS; GROUNDS FOR DISCIPLINARY ACTIONS (\u00a7 9.1-185.8)\n\nA. Any violations of the restrictions or standards under this statute shall be\ngrounds for placing on probation, refusal to issue or renew, sanctioning,\nsuspension or revocation of the bail bondsman&#8217;s license. A licensed bail\nbondsman is responsible for ensuring that his employees, partners and\nindividuals contracted to perform services for or on behalf of the bonding\nbusiness comply with all of these provisions, and do not violate any of the\nrestrictions that apply to bail bondsmen. Violations by a bondsman&#8217;s\nemployee, partner, or agent may be grounds for disciplinary action against the\nbondsman, including probation, suspension or revocation of license.\n\nB. A licensed bail bondsman shall not:\n\n   1. Give or receive, directly or indirectly, any gift of any kind to any\n   nonelected public official or any employee of a governmental agency involved\n   with the administration of justice, including but not limited to\n   law-enforcement personnel, magistrates, judges, and jail employees, as well as\n   attorneys. Provide bail for any person if he is also an attorney representing that\n   person.\n\n   11. Provide bail for any person if the bondsman was initially involved in the\n   arrest of that person.\n\nC. A licensed bail bondsman shall ensure that each recognizance on all bonds for\nwhich he signs shall contain the name and contact information for both the\nsurety agent and the registered agent of the issuing company.\n\nD. An administrative fee may be charged by a bail bondsman, not to exceed\nreasonable costs. Reasonable costs may include, but are not limited to, travel,\ncourt time, recovery fees, phone expenses, administrative overhead and postage.\n\nE. A property bail bondsman shall not enter into any bond if the aggregate of\nthe penalty of such bond and all other bonds, on which he has not been released\nfrom liability, is in excess of four times the true market value of the equity\nin his real estate, cash or certificates of deposit issued by a federally\ninsured institution, or any combination thereof.\n\nF. A property bail bondsman or his agent shall not refuse to cover any\nforfeiture of bond against him or refuse to pay such forfeiture after notice and\nfinal order of the court.\n\nG. A surety bail bondsman shall not write bail bonds on any qualifying power of\nattorney for which a copy has not been filed with the Department.\n\nH. A surety bail bondsman shall not violate any of the statutes or regulations\nthat govern insurance agents.\n\nI. A licensed bail bondsman shall not charge a bail bond premium less than 10\npercent or more than 15 percent of the amount of the bond. A licensed bail\nbondsman shall not loan money with interest for the purpose of helping another\nobtain a bail bond.\n\t\t\tFor the purposes of this subsection, &#8220;bail bond premium&#8221; means\nthe amount of money paid to a licensed bail bondsman for the execution of a bail\nbond.\n\nJ. A licensed bail bondsman who has been arrested for a felony offense shall not\nissue any new bonds pending the outcome of the investigation by the Department.\n\nK. If a recognizance is forfeited pursuant to &#xA7; 19.2-143 and such\nrecognizance is not paid by 4:00 p.m. on the last day of the 150-day period from\nthe finding of default, the clerk shall notify the Department of such default\nand the Department shall suspend the license of any bail bondsman on the bond in\nthe forfeited recognizance until the forfeited recognizance is satisfied, unless\nsuspended for another cause.
