						<section><p>An <span class="dictionary">authority</span> created under the provisions of this chapter is hereby vested with the power of eminent domain and the same <span class="dictionary">authority</span> to exercise the power of eminent domain as is granted in Chapter 2 (&#xA7;&#xA0;<a class="law" title="Chapter controls condemnation proceedings" href="/25.1-200/">25.1-200</a> et seq.) of Title 25.1 and as is granted in Chapter 3 (&#xA7;&#xA0;<a class="law" title="Definitions" href="/25.1-300/">25.1-300</a> et seq.) of Title 25.1, subject to the provisions of &#xA7;&#xA0;<a class="law" title="Condemnation of property of corporations possessing power of eminent domain" href="/25.1-102/">25.1-102</a>, provided that this power shall not be used to acquire existing power supply facilities or plants held for future use. Furthermore, no <span class="dictionary">authority</span> may condemn property outside of the territorial limits of its member <span class="dictionary">governmental units</span> without obtaining the consent of the <span class="dictionary">governing body</span> of the <span class="dictionary">locality</span> in which such property is located; however, in any case in which the approval by such <span class="dictionary">locality</span> is withheld, the <span class="dictionary">authority</span> seeking such approval may <span class="dictionary">petition</span> for the convening of a special <span class="dictionary">court</span>, pursuant to &#xA7;&#xA7;&#xA0;<a class="law" title="Disputes between jurisdictions involving dams or water impoundment; constitution of special court; vacancies occurring during trial" href="/15.2-2135/">15.2-2135</a> through <a class="law" title="Conflicting petitions for same territory; petition seeking territory in two or more counties" href="/15.2-2141/">15.2-2141</a>.</p></section></text><history>1979, c. 416, &#xA7; 15.1-1628; 1997, c. 587; 2003, c. 940.</history><metadata></metadata></law>
