						<section><p>Any person licensed by the State Board of Pharmacy who violates any of the provisions of the Drug Control Act (&#xA7;&#xA0;<a class="law" title="Citation" href="/54.1-3400/">54.1-3400</a> et seq.) or of this article, and who is not criminally prosecuted, shall be subject to the monetary <span class="dictionary">penalty</span> provided in this section. If, by a majority vote, the Board shall determine that the respondent is guilty of the violation complained of, the Board shall proceed to determine the amount of the monetary <span class="dictionary">penalty</span> for such violation, which shall not exceed the sum of $1,000 for each violation.
