						<section id="A"><p><span class="prefix-number">A.</span> Any criminal or civil <span class="dictionary">offense</span> that concluded with any final <span class="dictionary">disposition</span> as a charge or <span class="dictionary">conviction</span> of former &#xA7; <a class="law" title="Repealed" href="/18.2-250.1/">18.2-250.1</a> shall be <span class="dictionary">sealed</span> without the entry of a <span class="dictionary">court order</span>. The Central Criminal Records Exchange, any court, any <span class="dictionary">law</span>-enforcement agency, and the Department of Motor Vehicles shall identify and seal the records of any such <span class="dictionary">offense</span> in its <span class="dictionary">possession</span>. <a id="paragraph-308315" class="section-permalink" href="https://vacode.org/19.2-392.6_1/#A"><i class="fa fa-link"/></a></p></section>
						<section id="B"><p><span class="prefix-number">B.</span> The Department of Motor Vehicles shall not seal any charge or <span class="dictionary">conviction</span> under subsection A in violation of (i) federal regulatory record retention requirements or (ii) federal program requirements if the Department of Motor Vehicles is required to suspend a person&#x2019;s driving <span class="dictionary">privileges</span> as a result of the charge or <span class="dictionary">conviction</span> to be <span class="dictionary">sealed</span>. <a id="paragraph-308316" class="section-permalink" href="https://vacode.org/19.2-392.6_1/#B"><i class="fa fa-link"/></a></p></section></text><history>2025, cc. 634, 671.</history><metadata></metadata></law>
