						<section><p>In any case in which an officer proceeds under &#xA7;&#xA7;&#xA0;<a class="law" title="Execution and return of warrant, capias or summons; arrest outside county or city where charge is to be tried" href="/19.2-76/">19.2-76</a>, <a class="law" title="Duty of arresting officer; bail" href="/19.2-80/">19.2-80</a> and <a class="law" title="Procedure upon arrest without warrant" href="/19.2-82/">19.2-82</a>, such officer shall, to the extent possible, obtain and provide the <span class="dictionary">magistrate</span> or <span class="dictionary">court</span> with the arrested person&#x2019;s criminal history information prior to any proceeding under Article 1 (&#xA7;&#xA0;<a class="law" title="Definitions" href="/19.2-119/">19.2-119</a> et seq.) of Chapter 9 of this title. A <span class="dictionary">pretrial services</span> agency established pursuant to &#xA7;&#xA0;<a class="law" title="Purpose; establishment of pretrial services and services agencies" href="/19.2-152.2/">19.2-152.2</a> may, in lieu of the arresting officer, provide the criminal history to the <span class="dictionary">magistrate</span> or <span class="dictionary">court</span>.</p></section></text><history>1999, cc. 829, 846; 2007, c. 133.</history><metadata></metadata></law>
