						<section id="A"><p><span class="prefix-number">A.</span> The Board shall develop and make available to each local <span class="dictionary">school board</span> a model parental notice of students with disabilities&#x2019; rights and obligations relating to <span class="dictionary">dual enrollment</span> courses, including detailed information on the process for ensuring that any student with disabilities enrolled in <span class="dictionary">dual enrollment</span> courses is receiving both a free and appropriate public education pursuant to the federal Individuals with Disabilities Education Act (20 U.S.C. &#xA7; 1400 et seq.) as a student enrolled in a public high school and the necessary educational accommodations pursuant to the federal Americans with Disabilities Act of 1990 (42 U.S.C. &#xA7; 12101 et seq.) as a student enrolled in a comprehensive community college. <a id="paragraph-260145" class="section-permalink" href="https://vacode.org/22.1-215.3/#A"><i class="fa fa-link"/></a></p></section>
						<section id="B"><p><span class="prefix-number">B.</span> During the annual individualized education program (IEP) planning process prior to any year in which a child with a disability who is enrolled at a public high school is entering the eleventh grade or twelfth grade, the IEP team shall provide to the <span class="dictionary">parent</span> of such student written notice of the student&#x2019;s rights and obligations relating to <span class="dictionary">dual enrollment</span> courses, consistent with the model notice made available by the Board pursuant to subsection A, including detailed information on the process for ensuring that the student is receiving both a free and appropriate public education pursuant to the federal Individuals with Disabilities Education Act (20 U.S.C. &#xA7; 1400 et seq.) as a student enrolled in a public high school and the necessary educational accommodations pursuant to the federal Americans with Disabilities Act of 1990 (42 U.S.C. &#xA7; 12101 et seq.) as a student enrolled in a comprehensive community college. <a id="paragraph-260146" class="section-permalink" href="https://vacode.org/22.1-215.3/#B"><i class="fa fa-link"/></a></p></section></text><history>2025, c. 145.</history><metadata></metadata></law>
