						<section id="A"><p><span class="prefix-number">A.</span> The <span class="dictionary">Commissioner</span> shall have access during business hours to a registered <span class="dictionary">regulated hemp product</span> retail facility and to a business that offers for sale or sells at retail a substance intended for human consumption, orally or by inhalation, that is advertised or labeled as containing a cannabinoid for the purpose of: <a id="paragraph-211193" class="section-permalink" href="https://vacode.org/3.2-4125/#A"><i class="fa fa-link"/></a></p></section>
						<section id="A1" class="indent-1"><p><span class="prefix-number">1.</span> Inspecting to determine if any of the provisions of this article are being violated; and <a id="paragraph-211194" class="section-permalink" href="https://vacode.org/3.2-4125/#A1"><i class="fa fa-link"/></a></p></section>
						<section id="A2" class="indent-1"><p><span class="prefix-number">2.</span> Securing samples of any <span class="dictionary">regulated hemp product</span> or substance intended for human consumption, orally or by inhalation, that is advertised or labeled as containing a cannabinoid. It shall be the duty of the <span class="dictionary">Commissioner</span> to make or cause to be made examinations or laboratory analysis of samples secured under the provisions of this section to determine whether any provision of this article is being violated. <a id="paragraph-211195" class="section-permalink" href="https://vacode.org/3.2-4125/#A2"><i class="fa fa-link"/></a></p></section>
						<section id="B"><p><span class="prefix-number">B.</span> This section shall not apply to products that are (i) approved for marketing by the U.S. Food and Drug Administration and scheduled in the Drug Control Act (&#xA7; <a class="law" title="Citation" href="/54.1-3400/">54.1-3400</a> et seq.) or (ii) dispensed pursuant to Article 4.2 (&#xA7; <a class="law" title="Repealed" href="/54.1-3442.5/">54.1-3442.5</a> et seq.) of Chapter 34 of Title 54.1. <a id="paragraph-211196" class="section-permalink" href="https://vacode.org/3.2-4125/#B"><i class="fa fa-link"/></a></p></section></text><history>2023, cc. 744, 794.</history><metadata></metadata></law>
