						<section><p>In accordance with applicable federal <span class="dictionary">law</span> and regulations, including those under Title XIX of the Social Security amendments of 1965, the <span class="dictionary">Department</span> may make claim against the estate of an <span class="dictionary">indigent</span> or medically <span class="dictionary">indigent</span> <span class="dictionary">person</span> for the amount of any medical assistance payments made on his behalf by the <span class="dictionary">Department</span>. The <span class="dictionary">Department</span> may <span class="dictionary">waive</span> its claim if it determines that enforcement of the claim would result in substantial hardship to the heirs or dependents of the individual against whose estate the claim exists.</p></section></text><history>1984, c. 781.</history><metadata></metadata></law>
