						<section><p>Notwithstanding the provisions of &#xA7;&#xA7;&#xA0;<a class="law" title="Confidentiality of court records" href="/16.1-305/">16.1-305</a> and <a class="law" title="Commitment hearing for involuntary admission; recordings and records" href="/37.2-818/">37.2-818</a>, at the request of the <span class="dictionary">Department</span> and as provided in this section, the Office of the Executive Secretary of the Supreme <span class="dictionary">Court</span> shall provide to the <span class="dictionary">Department</span> electronic data, including individually identifiable information, on the proceedings provided for in Article 16 (&#xA7;&#xA0;<a class="law" title="Short title" href="/16.1-335/">16.1-335</a> et seq.) of Chapter 11 of Title 16.1 and Chapter 8 (&#xA7;&#xA0;<a class="law" title="(Effective July 1, 2026). Applicability of chapter" href="/37.2-800/">37.2-800</a> et seq.). For the purposes of this section, &#x201C;individually identifiable information&#x201D; shall include the name and date of birth of the <span class="dictionary">individual</span> who is the subject of the proceeding and the last four digits of the <span class="dictionary">individual</span>&#x2019;s social security number.
		Electronic data collected by the <span class="dictionary">Department</span> pursuant to this section may be used by the <span class="dictionary">Department</span> for the purposes of developing and maintaining statistical archives, conducting research on the outcome of proceedings provided for in Article 16 (&#xA7;&#xA0;<a class="law" title="Short title" href="/16.1-335/">16.1-335</a> et seq.) of Chapter 11 of Title 16.1 and Chapter 8 (&#xA7;&#xA0;<a class="law" title="(Effective July 1, 2026). Applicability of chapter" href="/37.2-800/">37.2-800</a> et seq.), and preparing analyses and reports for use by the <span class="dictionary">Department</span>.
		The <span class="dictionary">Department</span> shall take all necessary steps to protect the security and privacy of the electronic data to the same extent required by <span class="dictionary">state</span> and federal <span class="dictionary">law</span> and regulations governing health information privacy. Such electronic data shall not be subject to the Virginia Freedom of Information Act (&#xA7;&#xA0;<a class="law" title="Short title; policy" href="/2.2-3700/">2.2-3700</a> et seq.).</p></section></text><history>2017, cc. 188, 719.</history><metadata></metadata></law>
