						<section><p>The <span class="dictionary">Commissioner</span> is hereby authorized to examine the condition of the <span class="dictionary">state</span> facilities operated by the <span class="dictionary">Department</span> based upon the practices and methods employed by the <span class="dictionary">Department</span> in the care and treatment of <span class="dictionary">individuals</span> admitted to any <span class="dictionary">state</span> <span class="dictionary">facility</span>. No property that is being used for the care and treatment of <span class="dictionary">individuals</span> receiving services or that is reasonably related to the present or future needs of the <span class="dictionary">Department</span> for care and treatment of <span class="dictionary">individuals</span> receiving services shall be declared surplus.</p></section></text><history>Code 1950, &#xA7; 37-34.2:2; 1958, c. 556; 1968, c. 477, &#xA7; 37.1-13; 1976, c. 671; 1978, c. 770; 1980, c. 582; 2005, c. 716; 2012, cc. 476, 507.</history><metadata></metadata></law>
