						<section><p>Any <span class="dictionary">party</span> to a proceeding under this chapter may, upon application to the <span class="dictionary">Commission</span> setting forth the materiality of the information requested, serve <span class="dictionary">interrogatories</span> or cause the <span class="dictionary">depositions</span> of witnesses residing within or without the Commonwealth to be taken, the costs to be taxed as expenses incurred in connection with the filing of a claim, in accordance with &#xA7;&#xA0;<a class="law" title="Commission awards for birth-related neurological injuries; notice of award" href="/38.2-5009/">38.2-5009</a>. Such <span class="dictionary">depositions</span> shall be taken after notice and in the manner prescribed by <span class="dictionary">law</span>, for <span class="dictionary">depositions</span> in actions at <span class="dictionary">law</span>, except that they shall be directed to the <span class="dictionary">Commission</span>, the <span class="dictionary">Commissioner</span> or the Deputy <span class="dictionary">Commissioner</span> before whom the proceedings may be pending.</p></section></text><history>1987, c. 540; 1989, c. 523; 2003, c. 897.</history><metadata></metadata></law>
