						<section><p>The holder of a certificate revoked pursuant to &#xA7;&#xA0;<a class="law" title=" Board action; suspend, revoke, or take other action" href="/45.2-528/">45.2-528</a> shall be entitled to examination by the Board of Coal Mining Examiners after three months have elapsed from the date of <span class="dictionary">revocation</span> of the certificate if he can prove to the satisfaction of the Board that the cause for <span class="dictionary">revocation</span> of his certificate has ceased to exist. However, no person convicted of violating &#xA7;&#xA0;<a class="law" title=" Tampering with methane monitoring devices prohibited; penalty" href="/45.2-848/">45.2-848</a> or <a class="law" title=" Allowing persons to work in mine where methane monitoring equipment disconnected; penalty" href="/45.2-849/">45.2-849</a>, subsection A of &#xA7;&#xA0;<a class="law" title=" Smoking materials prohibited; penalty" href="/45.2-856/">45.2-856</a>, or &#xA7;&#xA0;<a class="law" title=" Allowing persons to work in a mine with smoker's articles; penalty" href="/45.2-857/">45.2-857</a> shall be eligible for examination for a period of not less than one year nor more than three years following such <span class="dictionary">conviction</span>, such period to be set by the Board in its discretion at the time of <span class="dictionary">revocation</span> of the certificate.</p></section></text><history>Code 1950, &#xA7;&#xA7; 45-29, 45-31; 1954, c. 191; 1966, c. 594, &#xA7; 45.1-13; 1978, c. 729; 1994, c. 28, &#xA7; 45.1-161.36; 2021, Sp.
