						<section><p>Whenever any <span class="dictionary">motor vehicle</span>, <span class="dictionary">trailer</span>, <span class="dictionary">semitrailer</span>, or combination or part of a <span class="dictionary">motor vehicle</span>, <span class="dictionary">trailer</span>, or <span class="dictionary">semitrailer</span> is immobilized on any <span class="dictionary">roadway</span> by weather conditions, due to an accident that does not result in injury or death, or by other emergency situations, the <span class="dictionary">Department</span> of Transportation, individuals, or entities acting on behalf of a <span class="dictionary">Department</span> of Transportation safety service patrol program as defined in subsection B of &#xA7;&#xA0;<a class="law" title="Operation of tow trucks or vehicles owned or controlled by the Department of Transportation under certain circumstances; incident management" href="/46.2-920.1/">46.2-920.1</a> or individuals or entities acting pursuant to a <span class="dictionary">contract</span> with the <span class="dictionary">Department</span> of Transportation for, or that includes, traffic incident management services as defined in subsection B of &#xA7;&#xA0;<a class="law" title="Operation of tow trucks or vehicles owned or controlled by the Department of Transportation under certain circumstances; incident management" href="/46.2-920.1/">46.2-920.1</a> may move or have the vehicle removed to some reasonably accessible portion of the right-of-way off the <span class="dictionary">roadway</span>. <span class="dictionary">Disposition</span> thereafter shall be effected as provided by &#xA7;&#xA0;<a class="law" title="Unattended or immobile vehicles, generally" href="/46.2-1209/">46.2-1209</a>.</p></section></text><history>Code 1950, &#xA7; 46-5; 1952, c. 508; 1958, c. 541, &#xA7; 46.1-2; 1964, c. 103; 1972, cc. 267, 402, 408; 1976, c. 454; 1978, cc. 47, 605; 1988, c. 293; 1989, cc. 256, 727; 2017, c. 350.</history><metadata></metadata></law>
