						<section><p>The <span class="dictionary">Commissioner</span> shall disqualify, for a period of two years, any <span class="dictionary">person</span> convicted of violating an <span class="dictionary">out-of-service order</span> while operating (i) a commercial <span class="dictionary">motor vehicle</span> designed to transport 16 or more passengers, including the <span class="dictionary">driver</span>, or (ii) notwithstanding the provisions of &#xA7;&#xA0;<a class="law" title="Disqualification for certain offenses" href="/46.2-341.18/">46.2-341.18</a>, a commercial <span class="dictionary">motor vehicle</span> while used in the transport of <span class="dictionary">hazardous materials</span> required to be placarded under federal <span class="dictionary">Hazardous Materials</span> Regulations (49 C.F.R. Part 172, Subpart F). If the <span class="dictionary">person</span> is convicted of two or more violations of this section, and each <span class="dictionary">offense</span> arose from a separate incident committed within a period of 10 years, the <span class="dictionary">disqualification</span> shall be for five years.</p></section></text><history>2008, c. 190; 2009, c. 102.</history><metadata></metadata></law>
