						<section id="A"><p><span class="prefix-number">A.</span> No <span class="dictionary">person</span> shall use a commercial <span class="dictionary">motor vehicle</span> in the <span class="dictionary">commission</span> of any <span class="dictionary">felony</span> involving manufacturing, distributing, or dispensing a controlled substance or <span class="dictionary">possession</span> with <span class="dictionary">intent</span> to manufacture, distribute, or dispense such controlled substance. No <span class="dictionary">person</span> who holds a commercial learner&#x2019;s permit or commercial <span class="dictionary">driver</span>&#x2019;s license shall use a noncommercial <span class="dictionary">motor vehicle</span> in the <span class="dictionary">commission</span> of any <span class="dictionary">felony</span> involving manufacturing, distributing, or dispensing a controlled substance or <span class="dictionary">possession</span> with <span class="dictionary">intent</span> to manufacture, distribute, or dispense such controlled substance. For the purpose of this section, a controlled substance is defined as provided in &#xA7; 102(6) of the federal Controlled Substances Act (21 U.S.C. &#xA7; 802(6)) and includes all substances listed on <span class="dictionary">Schedules</span> I through V of 21 C.F.R. 						<section id="B"><p><span class="prefix-number">B.</span> Violation of this section shall constitute a separate and distinct <span class="dictionary">offense</span> and any <span class="dictionary">person</span> violating this section is guilty of a Class 1 <span class="dictionary">misdemeanor</span>. Punishment for a violation of this section shall be separate and apart from any punishment received from the <span class="dictionary">commission</span> of the primary <span class="dictionary">felony</span>. <a id="paragraph-289329" class="section-permalink" href="https://vacode.org/46.2-341.19/#B"><i class="fa fa-link"/></a></p></section>
