						<section><p>When any person is convicted, or found guilty in the case of a juvenile, of any theft of a <span class="dictionary">motor vehicle</span> or its unauthorized use, or the theft of any of its parts, whether the <span class="dictionary">motor vehicle</span> is used in the <span class="dictionary">commission</span> of a theft or not, then in addition to any penalties provided by <span class="dictionary">law</span>, the <span class="dictionary">driver</span>&#x2019;s license of the person shall be suspended by the <span class="dictionary">court</span> for a period of not less than sixty days nor more than six months. In case of <span class="dictionary">conviction</span> the <span class="dictionary">court</span> shall <span class="dictionary">order</span> the surrender of the license to the <span class="dictionary">court</span> where it shall be disposed of in accordance with &#xA7;&#xA0;<a class="law" title="(Effective July 1, 2026) Disposition of surrendered licenses on revocation or suspension" href="/46.2-398/">46.2-398</a>. If the <span class="dictionary">conviction</span> is a second or subsequent <span class="dictionary">offense</span>, the license shall be suspended at least sixty days and not more than one year, and the <span class="dictionary">court</span> shall transmit the license to the <span class="dictionary">Department</span> as provided by <span class="dictionary">law</span>. If the person has not obtained a license as required by this chapter, or is a <span class="dictionary">nonresident</span>, the <span class="dictionary">court</span> shall direct in the <span class="dictionary">judgment</span> of <span class="dictionary">conviction</span> that the person shall not drive any <span class="dictionary">motor vehicle</span> in the Commonwealth for a period to coincide with the <span class="dictionary">judgment</span> of the <span class="dictionary">court</span>. This section shall not apply in the event that the theft is one in which the <span class="dictionary">revocation</span> of the license of any person is required under the provisions of subdivision 5 of &#xA7;&#xA0;<a class="law" title="Required revocation for one year upon conviction or finding of guilty of certain offenses; exceptions" href="/46.2-389/">46.2-389</a>. Sections <a class="law" title="Suspension of registration certificates and plates upon suspension or revocation of driver's license" href="/46.2-391.1/">46.2-391.1</a> and <a class="law" title="Reinstatement of suspended or revoked license or other privilege to operate or register a motor vehicle; proof of financial responsibility; reinstatement fee" href="/46.2-411/">46.2-411</a> shall not apply to any person whose license is suspended under this section.</p></section></text><history>1966, c. 533, &#xA7; 46.1-417.1; 1984, c. 780; 1988, c. 860; 1989, c. 727; 1992, c. 109.</history><metadata></metadata></law>
