						<section><p>Within thirty days following the receipt of any personal property other than money delivered pursuant to any <span class="dictionary">preneed funeral contract</span>, the person receiving it, if title thereto is transferred, or the person making such delivery, if title thereto is not transferred, shall execute in writing a declaration of trust setting forth all the terms, conditions and considerations upon which the personal property is delivered, which shall be acknowledged in the same manner as the contract and recorded in the clerk&#x2019;s office of the <span class="dictionary">circuit</span> <span class="dictionary">court</span> of the city or county in which the person delivering the personal property resides; provided, that if such terms, conditions and considerations are contained in the <span class="dictionary">preneed funeral contract</span>, the contract shall be recorded.</p></section></text><history>1989, c. 684.</history><metadata></metadata></law>
