						<section id="A"><p><span class="prefix-number">A.</span> If the <span class="dictionary">declaration</span> expressly so permits, a <span class="dictionary">unit</span> may be subdivided into two or more <span class="dictionary">units</span>. Subject to the provisions of the <span class="dictionary">declaration</span> and other provisions of <span class="dictionary">law</span>, upon application of a <span class="dictionary">proprietary lessee</span> to subdivide a <span class="dictionary">unit</span>, the <span class="dictionary">association</span> shall prepare, execute, and record an amendment to the <span class="dictionary">declaration</span> subdividing that <span class="dictionary">unit</span>. All costs for such preparation, execution, and recordation shall be borne by the <span class="dictionary">proprietary lessees</span> involved. <a id="paragraph-260642" class="section-permalink" href="https://vacode.org/55.1-2123/#A"><i class="fa fa-link"/></a></p></section>
						<section id="B"><p><span class="prefix-number">B.</span> The amendment to the <span class="dictionary">declaration</span> must (i) be executed by the <span class="dictionary">proprietary lessee</span> of the <span class="dictionary">unit</span> to be subdivided, (ii) assign an <span class="dictionary">identifying number</span> to each <span class="dictionary">unit</span> created, and (iii) reallocate the <span class="dictionary">allocated interests</span> formerly allocated to the <span class="dictionary">cooperative interest</span> of which the subdivided <span class="dictionary">unit</span> is a part to the new <span class="dictionary">cooperative interests</span> in any reasonable manner prescribed by the <span class="dictionary">proprietary lessee</span> of the <span class="dictionary">cooperative interest</span> of which the subdivided <span class="dictionary">unit</span> is a part. <a id="paragraph-260643" class="section-permalink" href="https://vacode.org/55.1-2123/#B"><i class="fa fa-link"/></a></p></section></text><history>1982, c. 277, &#xA7; 55-449; 2019, c. 712.</history><metadata></metadata></law>
