						<section><p>No <span class="dictionary">collision damage waiver</span> subject to this chapter shall contain an exclusion from the waiver for <span class="dictionary">damages</span> caused by the ordinary <span class="dictionary">negligence</span> of the <span class="dictionary">lessee</span> or shared vehicle driver, as defined in &#xA7;&#xA0;<a class="law" title="Definitions" href="/46.2-1408/">46.2-1408</a>. Any such exclusion in violation of this section shall be void. This section shall not be deemed to prohibit an exclusion from the waiver for <span class="dictionary">damages</span> caused intentionally by the <span class="dictionary">lessee</span> or shared vehicle driver or as a result of his willful or wanton misconduct or gross <span class="dictionary">negligence</span>, driving while intoxicated or under the influence of any drug or alcohol, or <span class="dictionary">damages</span> caused while engaging in any speed contest.</p></section></text><history>1988, c. 349; 2020, c. 1266.</history><metadata></metadata></law>
